Horrible experience! They mislead me in text and then had me waiting on their contractor to show up, telling me he would arrive in 20 minutes. No heads up, no discussion, simply last minute notice, giving my busy household 20 minutes notice! We waited OVER AN HOUR for him and he NEVER showed!

They then wanted him to come out the following day but we had prearranged plans to be out of state that day so the last thing Jill King and I discussed was they would check with the contractor and see about Sunday or Monday. Instead they told my agent I denied them access and they backed out of the contract! Unbelievable and VERY unprofessional!

I have the conversation recorded with Jill King and I NEVER denied them access. They are required per the contract to recieve access "at a reasonable time" and giving us 20 minutes notice was NOT reasonable but we accommodated that, yet they back out because Saturday didn't work for us, despite having proof of the plans we had made back on 8/20/22!!!

They haven't even paid escrow/option fees to Title as of 5pm on Friday. I believe this was malicious and they absolutely wasted my time and my agent's. I will be filing a formal complaint with TREC about this!

The sheer fact Jill knew we have an agent and she continued to communicate directly with me and not our agent and pressured me into returning the contract to her directly and not wait on my agent should have been my first red flag.

 On 9/19/2022 I contacted the title company to inquire about the option fee and discovered Brittany lied in calls and text messages, claiming that the title company was sending it to me directly. Title never received the earnest nor option fee in the required time frame. Brittany then began telling me in text and a recorded phone call that SHE sent the check to me.

Title has no record nor proof as Brittany never provided proof or even a option fee/earnest money receipts. Therefore Brittany is in default, despite her sending $100 to me via Zelle today, that further proves she knew she was in default.

It does not, however release her from the earnest money and the termination is invalid, therefore, legally, she is in default and can be held liable for specific acts (purchase the home) or sued for fraud. We have given her a demand letter, as required by law. We are filing complaints with the BBB and TREC and once we are settled in our new home in a few weeks we will begin filing civilly against her and her company in court

Speaking with Brittany Berryman again today and she failed to accept Jill's fraud. They literally had me believing they were buying my home, only to discover they are NOT and never were! They listed my house for $16k more than what they offered me and were looking for a buyer.

They went under contract as though they were the buyer !!!!! Do not trust these women. Record EVERY interaction and phone call with them! Document everything they tell you!!!! Little does Brittany Berryman realize she was caught in a lie and it's documented in a text she sent me.

I will be filing a claim for fraud and damages now that I have officially obtained proof with her lying.

I spoke with Brittney Berryman. She stated they didnt say I denied access, just they couldnt coordinate it. (my agent will be sending me the screenshots of the text messages/communications). She then offered to reach out to someone she said wants to actually buy my home.

Come to find out this is the same person her partner represented as their "contractor"! So what appears to have happened is they *may have* intended on reassigning the contract and not actually planning on purchasing it. This is very identical to a situation I already experienced with another "investor" company.

I literally have text messages with Jill King saying the reason she was offering the pricing she offered is because they were not requiring an inspection, yet she still attempted to send someone to our home to "look".

I also mentioned to Ms. Berryman how pressured I felt by the text messages from Jill King, one in particular over how she was waiting for my agent to get the contract over to her. The message she sent me states " I feel bad for you. Every day is critical for you". 

1.  The contract closing date was not until the 7th, so waiting an hour for my agent to upload everything into DotLoop should not have been a big deal, but she made it seem as though it did, even though I had 24 hours to accept the offer.

2. Ms. King KNEW I had an agent representing me and yet she continued to message me directly, versus my agent.

3. Ms. King also attempted to get me to submit a signed/accepted offer knowing my agent's information was missing from the contract, along with my name and my spouse's name! Big no-no!

There are MANY red flags on this whole experience. Sadly I really trusted these women to be honest and forthcoming but hearing the person they were sending out was a interested BUYER and they claimed he was their contractor, that just really is disturbing.

I plan on getting everything gathered, recorded phone calls, text, emails, etc and filing a formal complaint with TREC. Ms. Berryman sent me a text asking me to "feel free to notify TREC that we cancelled within our option of five days", of which I am not even sure she understands is NOT the issue.

There seems to be a huge disconnect on comprehending how Jill King represented this and handled this matter. THAT is what needs and will be investigated by TREC. I believe these actions to be violations of TREC rules/policies/guidelines and will update this review with the outcome of the case.
