Lion Heart Floors Kyle Caracciolo-Clayton Wrote a bad check for subcontractor work Mascotte Florida

I own South Lake Floors in Groveland, FL.  I subcontract flooring installs through Lion Heart Floors (owner- Kyle Caracciolo-Clayton). (Lion Heart Floors; 376 E. Myers Blvd., Suite C, Mascotte, FL). 

My last project for Lion Heart was completed on Tuesday, July 19th at 15524 Charter Oaks Trail, Clermont, FL. On Friday(July 22nd), Kyle wrote me a company check (check#1028) in the amount of $3,552.00. I deposited the check (Fifth Third Bank at 1350 Roper Blvd. Clermont)  The check cleared the next day.

However, Tuesday, July 26th, my bank removed the funds from my account. I was notified that the check was flagged for confidential reasons, that if the funds cleared, they would not be available to me until August 1.

I contacted Kyle who said he would cancel the check and write me a new one(#5564). My bank advised the new check would most likely also be flagged due to being written from the same account. So I went to Ace Cash Express in Clermont and received the funds from the second check (paying out 4% to do it this way).

Several days later I received a letter from Ace dated 8/2/22 that due to nonsufficient funds, I was now responsible to repay them that money with penalty fees. ($3,729.60 in total) I have contacted Kyle several times and he has promised to pay and told me that he has paid the amount, but Ace keeps calling me for this balance.

I would like to make this deceitful business practice known to potential contractors and clients. I would also like to have this situation resolved and not have this unnecessary debt being held over me.
