This is a public documentation of what happened during my residency at The Monroe Apartments in Austin, Texas — managed by Fortis Property Management.

For three weeks, I lived in the unit without a functioning AC system. Management sent multiple emails claiming repairs had been completed — but no one ever entered the unit. I have full digital proof using:

  • Smart lock logs (SimpliSafe) confirming no maintenance entry

  • Thermostat photos showing unsafe temperatures for 10+ days

  • Voicemail from the property manager confirming the issue was still unresolved

  • Email chains with false service updates

After verifying the fraud and submitting formal complaints to HUD, TDHCA, the Texas Attorney General, and the Texas Department of Insurance, I followed up via email with management — citing:

  • Their pattern of deception

  • Legal filing status

  • Potential class action escalation

  • Safety violations

  • Proof that no repairs had occurred

After giving notice and emails throughout today including latest that they are no longer allowed into the unit and that I am contacting other residents with the same problems, I was retaliated against. Exactly 9 minutes after this final email, I received a cease-and-desist email from Fortis VP Kristina Davis.

This was not a response. It was retaliation.

In addition to the AC issue, I was told by staff to file a renters insurance claim for damages related to their own repair failure — a move I reported to the Texas Department of Insurance as potential insurance misrepresentation.

I have now filed a lawsuit. My claims include:

  • Retaliation under Texas Property Code § 92.331

  • Failure to repair and habitability breach (§ 92.056)

  • Negligence

  • Emotional and financial damages

  • Ongoing agency filings across four departments

This property is still leasing units while pretending this didn’t happen. If you are reading this, be aware:
