On November 22, 2020, I looked at several properties located at Shadow Lakes located in Wilmington Illinois. One of the properties was 195 Tummy Tooth Lane. I quickly made an offer which was accepted on November 26, 2020. The property was set to close on January 14, 2021. I met with the owner of the property (Thomas Modjewski) approximately one week after I made the offer to look at the roof. Mr. Modjewski met with me and we had a nice discussion as I looked at the roof and checked the furnace.
I informed Mr. Modjewski everything was ok and I intended to proceed with the purchase. A contract was accepted and signed on November 27, 2020. Over the next week, we exchanged text messages about winterizing the property. On December 2nd, 2020, I was informed I needed to provide an Earnest money check for $1,500. December 3rd I dropped the Earnest check to Pro Real Estate which was cashed the following day. My original financing was going to be a cash-out on my permanent residence during a re-financing. I changed the financing to a loan with Manhattan Bank and Trust (the Bank that the seller suggested). My realtor Gina Knight from Re/Max properties informed Pro Real-estate of this change.
On December 18th I was contacted by my realtor stating the seller wished to speak with me. I contacted Mr. Modjewski on Monday, December 20th at 5:54 p.m., we spoke for 8 minutes. I started the conversation by apologizing for not calling him on Saturday and I explained that I recently was diagnosed with Cancer and that I had Chemo Therapy days before which made me very sick. He stated he understood and he stated that my attorney's documents had some errors in the document about the A/C unit on the property being broken. I informed him I would speak to my attorney about that and have the document corrected and sent back. I discussed the loan paper-work with the Bank of Manhattan and that there were no issues and the closing was still scheduled on-time. Furthermore, I told him to keep my phone number and if he had any questions or concerns he could call me at any time.
Unbeknownst to me the next morning the contract was canceled by Mr. Modjewski and Pro Real Estate subsequently the property was re-listed by Pro Reality and a contract was agreed upon on the same day!
On Wednesday, December 23, 2020, my real-estate agent contacted me saying that they were contacted by the seller’s realtor (Judith Sundline) canceling the purchase even though it was under contract. The reason they provided was that they did not like the loan officer “lying Ryan” at Manhattan Bank.
I contacted the bank and the seller immediately, the bank provided the seller the pre-approval for the loan. By obligation of the contract, I had 45 days to provide the pre-approval letter this pre-approval was well in advance of the 45 days. I made the initial contact via text message with the seller stating I don’t understand why you are canceling the transaction and that everything was moving forward including a pre-approval for the loan. At 3:44 p.m., Mr. Modjewski contacted me stating he apologized but his wife, the realtor, and his attorney thought it was in their best interest to cancel the deal. I informed him again that nothing was holding the transaction up in the fact that I was putting down the required 30% for the purchase. He stated he didn’t feel right about canceling the purchase but it wasn’t only up to him and “unfortunately there is nothing I can do now about it because there was a contract drawn up”.
I explained to him we had a contract and that not only was this illegal it wasn’t a moral thing to do. I asked him if this was due to my medical condition to which he did not respond. I elaborated telling him that I purchased several Christmas presents for my children relevant to having a Lake House such as a Kayak that now makes zero sense. In the purchase, it was agreed upon that a boat, canoe, and furnishings came with the purchase. On December 24th, I observed a for sale listing on the Market place of the canoe from this property.
According to the law, it is not legal to break the contract to take another contract after the fact. It is clear what Pro Real Estate (Judith Sundine) and Mr. Modjewski did was illegal, not moral, and in bad taste. However, what is not clear is why the transaction was canceled. I could only assume it was one of two things. The night before the cancelation in which Mr. Modjewski made no mention of canceling the transaction, I divulged I had Cancer and I was receiving Chemo Therapy. Or was Mr. Modjewski offered more money? The agreed-upon purchase price was $66,000. I have an excellent credit rating and I was putting the required 30% down for the loan. I met with Mr. Modjewski on one occasion and we texted and chatted on at least 3 occasions since the contract was drawn up.
There was no reason to cancel the transaction nor was I given any indication that the transaction was being canceled. Shame on the Pro Real Estate for allowing the seller to break the contract and conducting business this way! There was nothing about this that was done professionally as suggested by the name Pro Real Estate. What is the point of having a deposit and a contract if Pro Real Estate and Mr. Modjewski can cancel at will?
