I am writing to file a formal complaint against RK Autowerks for failure to pay $6500 as agreed upon for the return of automotive parts, two turbos, and the engine core from a 2017 BMW M6.* 

I purchased a BMW M6 Motor, referred to as a Forged S63tu, from R K Autowerks for $32,073 on December 12, 2022, which was shipped to Four Arrows for installation. As agreed upon, R K Autowerks was to purchase shipping and insurance both ways and, in this case, chose Global Logistics. Upon completion, the original engine core and two turbos were packaged correctly and shipped to R K Autowerks. Per RK Autowerks policy, $2500 would be refunded for the turbos, and up to $4000 could be refunded for the core.

RK Autowerks indicates the box containing the engine and turbos arrived on 05/15/23 upside down and damaged and that the turbos were missing. R K Autowerks claims to have emailed me requesting I file a claim. Forensic research of my email going back to 2015 indicates I did not receive that email.

RK Autowerks asserts it was my responsibility to file the claim, and it was too late due to my failure to respond to the email. This is incorrect; the contract exists between RK Autowerks and Echo Global Logistics, and it was their responsibility to file. RK Autowerks also provided no documentation showing an inability to file due to time passing.

One: It was RK Autowerks' responsibility to pay for shipping and insurance. Two: Four Arrows safely packaged the turbos and core upon shipment. Three: RK Autowerks was aware that the turbo should have been in the container, as evidenced by their request I file an insurance claim. Four: the container arrived damaged, as documented by RK Autowerks. Five: It was RK Autowerks' responsibility to promptly file a claim with Echo Global Logistics upon receipt of the damaged package. Six: RK Autowerks is responsible for promptly refunding the $6500, as agreed upon. 

I attempted to reach Razza Kalid, the owner, directly by restricted delivery certified mail. I received a response from Mike Dominski from sales@rkautowerks.com. The response was the same as before, denying liability.

Absolutely incorrect

You assume it was incorrectly prepared for shipping but all evidence indicates the package was upturned during shippment.

How would anyone ship an engine upside down as evidenced by the box label "this side up" being upside down.

Notifying me is irrelevant and your pattern of address all emails to and from yourself with the fist CC being yourself before listing the recipient is suspect.

Legally, your responsibility was to file a claim upon reciept and let R+L Carriers investigate. You falied to exercise due diligence, signed off and do not want to pay for your mistake.

Furthermore, your photos are dated the day after reciept. In all likelhood, the items were delivered undamaged and your people flipped the pallet damaging the engine, dumped the broken turbos and trying to cover up your mistakes. 

How many people are going to trust you to build an engine for $40K for their prized BMW when you can't be trusted to check a shipment and file an insurance claim?

You're willing to trash your reputation over $6500 when you charge as much as $40K for an engine. Anyone who reads this will know of your lack ethics and business accumen. They will have to wonder what other short cuts you will take and failures will occur in building their engine, should they be so foolish as to hire you.

Shipper confirmed no damage all contents present upon arrival.

RK Autowerks should have refunded $10,500, $8000 for the engine core, and $2500 for the twin turbos. They have repeatedly claimed it was not their responsibility to file an insurance claim, nor the shipper's responsibility to pay for improper package preparation. They also claimed it was my responsibility to file a claim and that it was too late, yet they provided no supporting documentation.

 

I filed a claim with the shipper R+L Shipping. They denied providing documentation that Raza Kalid, RK Autowerks founder, was present and signed for the shipment indicating it was undamaged and the contents complete. 

 

The only explanation is that one of RK Autowerks employees turned over the pallet with the engine, as documented by the photos they provided, and they have attempted to hide this, not to pay the agreed-upon refund of up to $10,500.

 

All damage would have had to occur after Rk Autowerks accepted the shipment.

 

To establish a fraud claim under Texas law, a plaintiff must demonstrate the following elements:

  • The defendant made a material representation.
  • The representation was false.
  • The defendant knew the declaration was false or made it recklessly without knowing its truth.
  • The defendant intended to induce the plaintiff to act upon the representation.
  • The plaintiff justifiably relied on the representation, which caused the plaintiff injury.

I believe Raza Kalid and RK Autowerk's actions meet all these criteria and are guilty of fraud. The court will decide.

False Claims

You stated you never received any emails from us. This was false, we showed you proof of the email chain, date stamped. An email chain started by you. 

 

Yes we setup the pickup, but your negligence in packaging something is not something we will be responsible for. Once again, when we shipped you the product, everything arrived without issues. When you shipped back the product to us, it was receieved the way the pictures show. This is not something up for debate or discussion. The proof is right there in the pictures.

 

Shipping companies do not all you to file claims for missing product when it is because of improper packaging. This is standard procedure with any shipping company. You failed to ensure the packaging would make it intact to us. As we have shown it did not. 

 

Your packaging had zero straps, the box was not secure to the pallet, the engine was not secured to the pallet. This is once again shown in the images. 

 

Your engine, per terms and condition, shows why there would be no refund for the core. The block had 2 holes, the oil pans had a hole, the oil pump was destroyed, cylinder heads damaged, and the crankshaft. Please refer to your terms and conditions to understand how the core process works. 

 

It is in your best interest to take this up with your shop because we have done our due diligence. Never have phone calls been ignored, no emails go unresponded to, and now this "ripoff report" website you've reported to; we've still promptly responded to you.

Response to core charge not being refunded.

Customer states that the he was never notified but email chain shows he was notified on May 16th with pictures and documentation. These images were taken with the truck driver standing in the picture to prove these were current and not faked. 

It is the customers responsibility to package the items correctly, a claim cannot be filed when the customer does not package everything. We shipped him his items and they arrived without any issues. He shipped back core items, we received and engine upside down, box torn up, and everything scattered. No straps were used to secure the engine and there were no boxes on the pallet with missing items. 

 

Customer also states we are ignoring him but as the images linked show, he was sent everything via email and his phone calls were answered. He sent a letter in the mail, which he received an email response to as well, within days of us receiving it. 

 

Upon reviewing his engine, the entire engine was completely destroyed, pictures of this were provided to the customer as well. He was given a terms and condition outlining how core refund process work, which he agreed to. We provided him pictures of the status of the engine and outlined why he would not receive a refund for the core. This was once again ignored.

The contents were packaged correctly as stipulated by Four Arrows. The shipment was overturned, and the turbos were lost during shipping. It is the responsibility of the business that paid for shipping and insurance to file the claim promptly.

It is not your place to determine when or where it occurred or the responsibility to determine culpability. It is your place to file the claim, permit the shipper to investigate, and either approve or deny the claim.

You neglected your responsibility and expected me to assume the loss. It has been said that "what we do in the most insignificant situations speaks volumes to our true nature." You have clearly demonstrated no concern for your customers and a complete and utter lack of understanding of fundamental business procedures.
