San Diego attorney Salvatore Nicholas Padula is with a low tier defense law firm called CGS3.  Although the law firm advertises itself as a top firm, I did not see it in the annual list of top firms for the last two years.

One reason that may be are hires like Salvatore Padula who was living with his parents until recently and now resides in an older run down apartment near downtown. Salvatore Padula also was licensed in California, but still holds him self out to be realtor, but the fact remains Salvatore Padula is no longer licensed.

Another reason could be that Salvatore Padula recently filed an appeal, was sanctioned by the court for not filing his brief, and the appeal was DISMISSED!!! As here, the court docket shows,

Case Number D080436 ,

06/09/2022        Default notice sent; no case information statement filed, or statement incomplete.

06/28/2022        Abandonment of appeal filed in trial court.


Salvatore Padula filed a writ (expedited appeal) in the 4th Appellate District Division 3, Case No. G061047, where the court docket reflects in part,

01/27/2022        Order denying petition filed.       THE COURT:*

The petition for a writ of mandate and request for immediate stay are DENIED. Petitioner's third application for a fee waiver is DENIED as MOOT.

So not only did the Court of Appeal DENY the writ which was doomed from the start,  but it appears as attorney Salvatore Padula also wanted to defraud the court from the filing fee by having the court issue a fee waiver excusing the client from paying all fees.

I believe such conduct is frivolous and is defined under Civil Code of Procedure § 128.5(2) “Frivolous” means totally and completely without merit or for the sole purpose of harassing an opposing party. Here, Salvatore Padula is not an appellate attorney, does not have any appellate wins to his name, is not a certified specialist in appellate law, however filed a poorly written brief in support of his writ which only had a 2-3% chance of winning - while charging the client for his time. Since I do not see Salvatore Padula having any history of doing pro bono work and most attorneys charge for his/her time, I find San Diego attorney Salvatore Padula charged the client thousands of dollars for a writ which would inevitably fail. To me, this is billing fraud and want to bring this to the attention of the public.

If you suspect an attorney intends to charge you for legal work, but is not a specialist in that area of law, get a second opinion. Do not allow fraudulent conduct by an attorney to succeed.
