Dear Sir/Madam

 

On July 30, 2015 Joey Borgetti explained membership requirements.  As always, I recorded this business transaction.

Once Borgetti employee #8979P explained that I was paying $24.99 and a total of $49.37 in full up front to join, I asked him as I always ask, is there any additional costs, or hidden fees that will pop up later.  His reponse was no, this is what it will cost, $49.37 now which includes a monthly rate of $24.99.  He said he would have to fax me a copy of the contract (lie #1).  I waited several days, and when the contract did not appear, I asked the Mgr. of this location for a copy.  He handed me 7 pages of fine print.

The first thing I noticed was taxes which was not explained.  I couldn't imagine with all the emphasis on health that Missouri collected tax on people getting healthier.  I also know now this is under consideration in Jeff City and will likely go away soon.

The next thing I noticed was an annual fee of $39.99.  No annual fee was ever mentioned in my initial meeing with Borgetti.  He only said the enrolment fee was being discounted (lie #2). Reading further, I found that the annual fee was coming due on 12-8-2015 or 5 months after I signed up.  You would expect this fee, if it had been explained, to come due after one year, not 5 months into the contract.  By now my three days to cancel have past, due to the delay in getting me an email of the contract.  A copy that was not apparently available when I signed up, but, was immmediatley availbable when I returned to the gym four days later and requested it.

I told Borgetti I was waiting for a passport and would be leaving soon for Costa Rica and probably would not reuturn to the States.  He said when I was ready to leave, let him know and he would freeze my contractfirst and when the freeze ended, my membership would be canceled.

After waiting 15 weeks for my passport to arrive, I returned to 24 Hous Fitness and asked the Manager to freeze my memebership.  He informed me that longest freeze would be for 8 months, not 12 months like Borgetti told me when I signed up for the membership.  If this policy had changed in the meanwhile, I would think the sales staff would be the first to know.  The Mgr. also said  i would be billed at a rate of $10.00 a month.  Once more thing Borgetti forgot to tell me, and one more thing I can't find in the contract.

The contract spells out reasons for the freeze with no mention of a charge equal to a full membership at Club Fitness while out of the country. I didn't fill in fax, phone, or e-mail address for this St. Charles Mo. 24 Hour Fitness because it does not appear anywhere in the contract.  There were lies, misssinformation, and  inportant information left out of the sign in for membership.

I talked to Collin who apparently manages the 24 Hous Fitness in Chesterfield Mo.  He said, the information that was omitted upon signing up for a membership is not the procedures he was trained to follow, and Borgetti failed to follow his training.  He refuesed to give me this statement in writing, but, I do have that recording on VOIP as well.

I canceled my Credit Card, not to stop payments eventhough I feel like I was scammed, but, because my move is under way and I closed all American Accounts except for this e-mail which I will use momentarily. I plan to rent first and buy later in San Jose Costa Rica.  My address there is the Blue Palm Hotel,in Jaco.  The address is as follows: *****************************  This is a beach town near the capitol that doubles as a motel/ice cream parlor.  The phone for the business is *******************

All I want is to cancel this membership permanently, according to the contract because I'm moving, and I refuse to pay for a freeze when I no longer officially live in St. Charles Mo.
