He quoted a price of $7,000.00 and is fighting $13,000.00 more. I am left with a scar on my nose that he said he would remove. My coverage sent a check of $11.000.00 but he is taking me to court for $2,000.00He quoted a price of $7,000.00.

He recevied $2,100.00 from my coverage. I paid him $4,000.00. My coverage then sent a check for approximately $13,000 which I felt was excessive and I returned to my coverage. They reconsidered and changed the amount to approximately $11,000. His attorney and I had a verbal agreement that I would remit this amount upon receipt with my coverage's explanation for the change in amount.

Next thing I know is that I'm being advised to hire an attorney. My coverage told me to return the check in the first place. I thought that I had the right to question charges without the threat of a lawsuit.

Additionally, with respect to the rhinoplasty that he performed for which $4,000 came out my pocket, I still have a scar on my nose which I had prior to the surgery and he promised to remove. For $4,000, I think that I would want the scar removed. He has received over $6,100 and I have a check for him in excess of $11,000 and he wants to sue. There is something wrong with this picture.

This patient is leaving out pertinent information: She had cosmetic nasal surgery along with medically necessary nasal surgery (deviated septum and sinus surgery). Dr. Guida quoted her an out-of-pocket amount for the cosmetic portion of the surgery and agreed to accept her insurance for the medical portion, even though he is an out-of-network provider for all insurances.

He could not in good faith have her pay for the entire surgery up front and then have to wait for the insurance company to reimburse her as most other doctors would have done.

In any event, the surgery was a success (we keep very accurate medical records and photos of all patients).

Months had gone by and the Doctor still hadn't received payment from the insurance company. When the staff looked into the insurance matter with the company, we found out the a check for almost $12,000 was sent to the patient and the patient kept the money. For months!!!!!

When the staff tried to tell the patient that she agreed to sign over the insurance check to Dr. Guida (and signed papers to that affect) she was not willing to do so and then started to say that she was not happy with surgery and that was the reason for keeping the money.

Dr. Guida was advised BY THE INSURANCE COMPANY to go after the patient for the money that was clearly legally Dr. Guida's. Since the patient would no longer respond to Dr. Guida's office, there was no other recourse buy to bring her to court.

Please let it be known that Dr. Guida took her to court not because he was not paid for the procedure, but because the patient actually became $12,000 richer because of the surgery and he could not stand by and watch that happen.
