I met Daniel on a Saturday at 1pm in my house regarding a Pet Sitting Service in my home.  We were planning a trip up north the following week. I agreed to pay him $280 for 7 days, 30 minutes, twice a day pet service.

 

The very next day (Sunday evening) we decided NOT to take our trip so I emailed Daniel at 10:30pm requesting he return my check or refund my money. I did not hear from him anytime Monday, and I neglected to cancel my check.  The minute my check cleared on Tuesday, Daniel finally contacted me saying he would NOT refund my money.  He cashed my check the week before our scheduled trip, and once it cleared he refused to refund my money.

 

I tried speaking civily with Daniel, but he doesn't understand how to build a business.  I even offered to give him a $65 "consultation fee" for his 60 minutes at my house and because I felt bad that I cancelled my trip.  He was very short with me and kept saying "you signed a contract" so I am not due a refund.  But he doesn't understand that contract or not, if no service is rendered that there is no contract, and I am due a FULL REFUND.

 

I gave Daniel prompt notice of my intent.  The "contract" I signed he will NOT give me a copy of it.  I offered to him that if he gives me a $225 refund, this all goes away.  My next steps are to take him to Small Claims and I will seek full restitution, plus legal fees, and restitution for my time and mental anguish over this situation.

 

I cannot imagine allowing Daniel anywhere near my beloved pets!!

A solution to a dead report.

When you make accusations about other people, we compare their actions with alternative actions, evaluating the choices they have made. In this situation I would be embarresed to put down this wonderful company. Petsitters of AZ. Down to earth. friendly, helpful, businesslike. Yes business like. Funny how you offered him some lessons in business when you didn't even get a copy of the contract yourself. This just shows me that this website and whoever can post anything on it is ...well...simply put retarded. Block heads, as my dad would say. BBB is and will be the only place for smart kids who want to know the truth.

Daniel,

 

I will directly address your rebuttal with facts: (Daniel's statements underlined.)

I gave you every option to extend services to another time.  Under no circumstance will I ever use your "service".  You and your company are untrustworthy and for this reason alone you will not be allowed anywhere near my home or pets.

Our contract clearly states that we give no refunds for cancelations on holidays.  Your "contract" is null and void as I cancelled within 3 days (check AZ statute azleg.state.az.us/ars/44/05002.htm ) You even confirmed my request to cancel the "contract" via email at 4:20pm on 5/20... well within the 3 business day AZ law.

You telling me you will allow me 65 dollars doesn't make a difference as this is not your business to run.  I was trying to be considerate of your "consultation" time.  If you see this as a "doesn't make a difference" then I formally remove this option.  I will be seeking a full refund.

I already had the multiple slanderous reviews that you posted on Craigslist removed as they contained untrue and terrible accusations of abuse when I haven't done a single visit at your house. I have never slandered you - Just posting facts of your business practices.  I've received numerous "thank you's" from honest people, including how to post my experience on other sites as to inform everyone about your business practices.  I will continue to post the facts, as this is my right.

The bottom line is that you didn't follow the terms of your contract and tried to bully us into giving you a refund.  I am not bullying - Just stating facts.  1- contract or not, AZ law nullifies your contract.  2- NO service was performed, nor will ever be performed.  3- Refusal to refund monies without a servie rendered is theft.

Continuing to slander my business will not accomplish anything as we have plenty of great reviews from customers.  Once again, slander is a big word - Maybe you should lookup the definition (a malicious, false, and defamatory statement or report) as I have never defamed you or your business.  I have simply shared my facts as to how I've been treated by your "business". I also feel it's my moral responsibility to inform as many of your potential customers as possible.

 

Daniel, you leave me no choice but to take you to Small Claims Court.

You didn't contact us on sunday you contacted us outside of normal business hours at 10:07 pm. I wasn't short with you i told you that you had until 5pm monday to ask for a refund and you neglected to do so. Also you were extremely rude and made threats to us saying

"I can very easily post negative comments about how you cashed my check without offering any services - How do you think that will play on social media sites as you try and start your business?"

I tried my best to work with you and offer you services at a different time even though according to your contract (which i DID email to you the moment you requested a copy) that you signed you are entitled to no refund. you refused to accept all of our offers.
