I had posted an earlier contact regarding this company, but here is some more information:

(1) Their Address is shared by another company called:

They told me when they called back (re-read this after you have read this note) that they hhave 2 businesses at this address.

(2) I sent 2 Emails to them to cancel but they both got returned as "undeliverable". I then left them 2 voice mails on their customer care line at 888-549-2111. The first was my home phone, the second was my work number which happens to be an 800 number. They called me (total surprise) at my 800 number. I told them I wanted a full refund of $79.95 sent by check because I had to cancel the credit card to stop any further charges. After a lot of "being put on hold", I got handed to a supervisor who is very well entrenched into saying the company line, as follows:

(3) "...Mr. xxxxxxx, you did not read the terms..." Ah, yes, the terms. Never in my 28 years of customer service have I heard that thrown in my face so many times - they are truly deeply engrained into what they say in their "Terms".

They told me that they would reimburse me if I sent back the trial bottle minus 25% or $19.98. Second, they would put it as a credit card credit.

OK, I have already cancelled the original card. Why on earth would I want to give them another credit card number? I told them to send me a check for the full amount and I would stop my campaign to trash them on the internet. They said they can't write a check. Of course they can't! If I found out their bank, I might contact their bank and put the bank on the spot.

oh, oh... Here we go again... I'm being read the "you didn't read the terms" line.

So how did I leave it?

(a) They refuse to reimburse the full amount, only $59.97. So tangling with them would have cost me $19.98 of pure agony if I send the bottle back. Why would I do that? Read the notes on this company and you will see why (they have an itchy CHARGE finger). So why not a check? Read on, my friend...

(b) They will not send a check - ever. Got to keep things a secret after all. I'm sorry, but every legitimate business I know has a checking account. Oh, sorry, I forgot - this is not a legitimate company... And I forgot to read the terms.

(c) Domain names, let me count the many ways... They have registered the varient web site with ...SCAM. Ah yes, let's try and keep this a secret. If you do a Domain lookup on acaiberrymaxx.com, you will find it was registered with GODADDY, but the Administrative and Technical Contacts are listed as private. While you are at it, check out:
acaiberryscam.org and acaiberrytruth.org. Both are registered at the same time as acaiberrymaxx.com. And both sing praises about the product. Coincidence?

(d) I got the call today (Saturday) from their customer care but their customer care service line says their offices are closed. (I checked). The number listed above is the number where I received the call from them to me.

(e) They called my on my 800 number, not my home number. This could be a simple way for them to save money - so I won't fault them. But the funny part? When I left them the 2 voice mail messages, I gave them my home number first; then 4 hours later gave them the second 800 number.

(f) The product is shipped with no shipping notices or receipts. My wife does not remember when the product arrived exactly. Again, Ms. Supervisor threw this in my face and the fact that I did not read the terms.

(g) If you search for the address, you find the Hitchfinder.com. Why not Acuiberrymaxx.com ? Because both of the major search engines allow you to comment on the company. Rule 65 of the scam playbook says to never present an opportunity for customer comment (at least not on your dime).

Throughout the entire phone conversation, I kept refering to the operation as a "scam". You would think they would want to correct me - but neither the first clown nor the clowns supervisor ever corrected me.

I have only just begun to fight. THIS is not fair and, by God, not right.
