With this not being my first complaint with ACCC General Insurance it annoys me that I have to waste time again and file a report. ACCC is not a legitimate and honest insurance company and we are getting to the point where here at our dealership will not accept any policy's from ACCC General Insruance. Even though my customer was not the one with ACCC General Insurance I was advised of a claim my customer had filed against the company for an automovitve acciedent.
When I contacted the adjuster her voice mail stated that she would be out of the office until 8/15/13 and the date I called was 8/7/13, a whole week. She was good about calling back either the same day or the following day. I also had conflicting statements from my customer that she was contacting to get full information about the accident that had occured and the statement she would provide my customer with was totally different from what we would speak about.
I am unaware till now what day the accident occured. As the lein holder for the car I called around to get information as to what happened. The adjuster did mention to me that her insured was denying the statements my customer provided them with and did not belive he was at fault. As the accident happened, per the adjuster, my customer failed to yield to a car driving 60 mph on a highway. My customer was on the emergency lane trying to steer back into the lane after having had changed a flat tire. At 35 mph he had his signal light on trying to merge into the lane when the other driver failed to move a lane over and reduce speed for a vehicle in the emergency lane and struck my customer from the rear bumer to the rear left side panel.
Both parites agreed to not contact authorities and the man that struck my customer from behind gave his insurance information to my customer. There was also no witnesses. After the arrangement was made to take up the claim with the driver with ACCC Insurance the driver that struck my customer and my customer, per the adjuster, had conflicting statements as to how it happened and with no police report no witnesses the adjuster chose to take her insureds statement for fact.
The adjuster soon declined to pay any amount for any repairs or claim the car as a total loss. To her, my customer failed to yield to a moving car that was driving at 60 mph so that was the reason for denial. After contacting her supervisor he assured me he would have her open the claim again and revise it. About 15 minutes after I got off the phone with him she called me and stated that she would NOT revise the claim again and she was going to leave the denial for the supervisor to have the final say. She said there was no witnesses and no police report so she would ake her customers statement for fact.
I believe she was wrong in doing this. My customer was struck from the rear on bumper and left side panel ann she even stated her customer was driving 60 mph. Its understnable it's a highway BUT by law a vehicle should switch lanes if there is any vehicle in the emergency lane moving or not. And by law if you are driving next to the emergency lane you must reduce speed if you see a car is in the emergency lane.
I hope this gets resolved soon, I will file as man complaints needed to have a different adjuster overlook this case to determine coverage. Also besides the fact the adjuster was rude and loved to talk over me while I was trying to explain I really hope ACCC General Insurance takes fast action to reconsider.
