Acctown --> Acctown.com --> Bronx , NY - Counterfeit Bronx New York

On 6/11/13 I purchased an Otterbox through Acctown.com and received the order on 6/23/13 which was both damaged and COUNTERFEIT. I emailed Acctown of the damage and the questionability of the Otterbox being a fake, along with PHOTOS OF THE DAMAGE and the PACKAGING. Acctown said they were sending replacement. When it didn't arrive by 7/9/13 and I couldn't get a resolution I called my credit card company and they issued immediate refund. Additonally I posted reviews of my experience with this company and found others who were also scammed.  Yesterday I was THREATENED by ACCTOWN and they tried to BULLY me into Removing my Reviews. Read the emails and the dates, you can see they are victimizing the public. ----->>>>

I just received my order, it was sent in a manila envelope, in a clear plastic bag and was crushed in my condo mailbox, the front window of the box is smashed inward and broken.  I don't believe this is an authentic Otter Box.  Otter Box does not package this way, I have owned several.  I am requesting a full refund for $22.94, how do you want to handle this? Thank you

Can you please inform me of when a replacement will be sent?  My original order took 12 days to get to me, so If I have to wait another 12 days then I would prefer a refund and buy from amazon.com today so I can get it quickly.  Thank You

You did not return anything to us, so a refund would require a return of the initial order in full, plus the return of the replacement shipment, all with valid RMA numbers and according to the procedure outlined on our website. **THIS IS WHERE I DREW THE LINE IN THE SAND______ and called my credit card company.  Acctown never asked for a return until this moment and they expected me to eat the shipping on their damged, counterfeit item. The Order was only $22.94, I think this represents the kind of SCAM COMPANY ACCTOWN IS!

We are prepared to initiate an action to recover damages as specified in the contract via a breach of contract or related action. Your order was refunded in full. The item sent to you was as described. It was to be the case only, no packaging and we added a clear film to it. We purchase items from reputable vendors in lots and cannot inspect/test all items. If there is any problem we promptly resolve any issue any customer has. In your case, we refunded you instantly. Yet, you chose to wait, and then try to ruin our reputation and breach the terms of sale contract. Said contract is a legally binding agreement, enforceable in NY State per the forum selection clause, subjecting you to jurisdiction.

Further, we have no return noted here, and the refund was given in good faith to expedite a resolution. We reserve the right to initiate a collections action for the transaction amount of $22.94 and any related costs. If you cure the breach of the agreement, and remove your public comment, then we will consider all issues resolved and we will thereby waive our right to a collections action and to initiate any action for damages. We ask for your prompt attention to this matter and for your cooperation to resolve this issue amicably without any harm to either side. Thank you.

ACCTOWN is scamming and victimizing the public, read other reports on other sites.  They tried to Harrass and Threaten me with a "Forum Selection Clause", they know this law does not apply.  The only way a person can be held to that particular law is if the binding party is aware of it and has agreed to it.  Acctown buries this clause somewhere on their website, but it's not applicable unless you hare aware of it by agreeing to it. The only way to agree to it is if you sign your name or there is some digital signature that is provided showing that the party has read and accepted the terms. Acctown is BREAKING LAWS and trying to Bully consumers on top of it. AVOID THIS COMPANY!
