I ordered a complete system at a good price of $3200 which includes delivery.  After a week I started calling because they had charged my credit card but I had no system yet.

While waiting for delivery, I called an installer to find the price of the install.  They quickly told me the factory warranty was null and void if ordered over the internet.  This is something AC Direct neglected to tell me.

I also called the manufacturer.  They also told me the system would have no warranty.
I then called to cancel the system.  That is quite a dealbreaker if it has no warranty.  

AC Direct is impossible to get a hold of.  Only goes to voice mail and they do not respond to email.  After a week of constant emails and calls I gave up and disputed the charge on my credit card

Conditional credit is given.  However, I did get an email from them stating they have filed for chapter 11 bankruptcy on 1-6-10.  Below is the email.  Apparently I am not 
the only one with an issue with this compan.

Below is the email they sent me 2 days ago.

AC Direct, Inc., has filed for protection under Chapter 11 of the United States Bankruptcy Code in the Middle District of Florida, Orlando Division on January 5th, 2010, and has been assigned Case Number 6:10-bk-00080-ABB. You have been listed as a creditor in this case. 

Under bankruptcy law AC Direct, Inc., is prohibited from refunding your deposit for merchandise. If you purchased by using a credit card you may have the rights of a chargeback pursuant to your agreement with the credit card company. However, to exercise this right you must contact the credit card company immediately. 

Otherwise, you have a right to consult legal counsel and/or to file a claim in the bankruptcy case. You will be soon receiving a notice from the bankruptcy court which sets out the times and dates important to your rights in this case. 

The bankruptcy court has issued an injunction, called the automatic stay, which prohibits you as a creditor from further contact with AC Direct, Inc. You are prohibited from calling, writing, emailing, faxing or in any way contacting the company to collect the debt. If you have any further questions regarding your rights under the Bankruptcy Code please contact your attorney or seek out a bankruptcy attorney to determine your rights under law.

No response to date from Mr. Stanovsky

I have not heard any response from Mr. Stanovsky concerning the claim he has improperly posted here. I have previously made available my personal contact information for him to reach me and discuss his claim, but he has not called or emailed. We have no order ever placed under that name. I am left to assume that he was (or is) a competitor with no basis whatsoever to his claims. I have not heard from Mr. Sherman either and have no record of an order placed in the name provided. I will correct any issues for either of these two provided I can verify they were actually a customer. At this point I'm left to conclude that neither of these two posts are from actual customers. Unfortunately for many businesses and individuals, reports posted on rip off report require no verification whatsoever so  anything can be said or claimed with impunity. I just want our customers to be happy each and every time and am willing to do whatever is required to achieve that goal.

I contend that your statement above Refunds or charge backs have been offered to all customers, a few of which are still pending certain customer action to be finalized is inaccurate.  I was not offered this or contacted?  This makes your statement false.

The poster above, Derek Stanovsky is making statements that he cannot possible know or confirm, specifically;

 "It is perfectly clear that while ac direct was filing their bankruptcy, they continued to take credit cards, process orders, and
take customers' money in full knowledge that they could not ship the equipment we ordered!  They did not have it in inventory, nor could they procure from their manufacturers because they were on credit hold or lost their accounts altogether. This is blatant fraud perpetrated by an evil, corrupt president and his cronies and workers who knew exactly what they were doing!" 

How does Derek know what was happening internally during our bankruptcy , our inventory levels, or our credit situation with our suppliers? This is information that is held in strict confidence in all companies. The information he claims to somehow has access to in his post can only be described as unavailable to him at best, and an outright misrepresentation at it's worst.

The other plausible explanation is that he is a competitor taking advantage of a tough time that we briefly encountered and have since corrected as evidenced by these reviews of our company;

This is an independent company that posts reviews they obtain from our customers. These reviews cannot be edited in any way and we have no access to the posting of them. This person, Derek Stanovsky is overly harsh in his judgement and is claiming to have access to private information about our company that it is simply not possible for him to know.

We hold an HVAC contractors license in Florida, #CAC1813846 which can be verified here:

This license is active and valid with absolutely no complaints whatsoever, either resolved or unresolved.  I have previously admitted to our previous challenging time in late 2009 and apologized to any customers who experienced any inconvenience whatsoever during this time frame. If Derek wishes to call me I am available and will happily speak with him. I'm assuming he will not contact me unless he can prove the attacks he has posted about me and my company. I eagerly await the opportunity to speak with Mr. Stanovsky concerning this matter and will post an update if he does indeed take me up on my invitation to call me.

In the meantime, I stand by my previous post available above to all of our customers. I would like to reassert that all of our customers have received either a refund or their equipment and that not one single customer was left without one or the other. I also stand by my assurance that any customer who still has an issue with us in any way can contact me personally at 407-951-8908.
This is a new number from the one shown in my post earlier this year as we have moved
into a new showroom in beautiful downtown Winter Park, Fl at 710 West Fairbanks Avenue. I encourage anyone reading this post to stop in and say hello. AC Direct President is a Liar and fraud and company is a scam

Yes, Eric is right. The president of Ac Direct is a liar. I have spoken to other customers who were defrauded by acdirect.com and we made earlier complaints and exchanged information. It is perfectly clear that while ac direct was filing their bankruptcy, they continued to take credit cards, process orders, and take customers' money in full knowledge that they could not ship the equipment we ordered! They did not have it in inventory, nor could they procure from their manufacturers because they were on credit hold or lost their accounts altogether. This is blatant fraud perpetrated by an evil, corrupt president and his cronies and workers who knew exactly what they were doing!

They continued to accept internet orders without a clue as to how they would fulfill these orders. That is blatant fraud. Then they ran for cover under the protection of bankruptcy knowing full well they would get away with the scam. I looked up the house the owner lives in and he still has several other properties in the State of Florida. No doubt he used our money to continue to pay the mortgages on his properties and his rent in his building. He has one house worth more than $800,000. I am sure I made one of his mortgage payments when ac direct and michael haines never shipped me my goodman furnace system. Shame on him and the fact that he can still sell to the public after so much fraud!

The rebuttal from the president of AC Direct is inaccurate.  I was affected by the restructuring in Jan 2010, it is now August of 2010, I have not been refunded, contacted, nor revieved my order of approximately $1500.

AC Direct acknowledges that this customer and others were greatly inconvenienced by our temporary reorganization plan. Under the agreement, we were prohibited from contacting the few affected customers and mentioning the chapter 11 filing until it was actually entered with the courts. This resulted in a temporary shut down of all operations including our customer service phone lines. That is why we were forced to cut off communication with this customer and others until they received the filing notification. Chapter 11 keeps us in business through a reorganization plan which is being formulated now. All orders placed after January 5th, 2010 and forward will ship as usual.We sincerely regret any inconvenience we caused this particular customer and are willing to speak with him now that we are legally able to do so. Refunds or charge backs have been offered to all customers, a few of which are still pending certain customer action to be finalized. All customers who paid by cash, check, certified funds, or wire transfer were refunded their money or had their merchandise shipped prior to the court filing. Therefore, no customers are left without either full refunds or order fulfillment. We understand and take full responsibility for the frustration a few of our customers experienced throughout this unfortunate legal proceeding. AC Direct has a long, proud record of excellent service without complaints and we intend to maintain and even improve this record moving forward.
