This company called me several times and left messages.  I returned the call to be told that I must be quiet and listen to them.  They advised that I had taken a loan out from their client on the internet using an internet address and place of employment for references.  The loan was denied, but they are claiming I received the funds.


I explained I did not receive the funds and asked how this could be cleared up.  They explained they were filing a lawsuit against me in three days and that I had better pay and hung up on me.


They refused to give me any information on this, refused to send me anything and refused to give me an account number on this. 


I double checked my bank statement and no funds were ever deposited to me!

This STINKS of "scam"

There are a few grifters pulling this stunt of late. They'll call up, as they did with you, say you owe money for some sort of debt, threaten legal action, all with hazy, fuzzy "details" or without really any at all.

Remember that any legit collector has a legal obligation to provide "proof of debt" upon request. You should always request proof of debt for any debt that you are unsure you owe. Also, they're obligated to tell you for whom they're collecting, what collection agency they are employed by and provide a physical address and contact information. I've had to deal with some pretty aggressive collectors in the past who thought nothing about bending, or even breaking, the Fair Debt Collection Act laws in other areas, such as calling outside the legal times of 8am to 8pm, yelling, threatening and the like, but they cannot escape the fact that they are bound by law to provide proof of debt and contact info.

Besides, if you think about it, they claim to be collecting for a loan that was denied. Do they have any idea how stupid that sounds on the surface? Looks to me they were hoping to make a fast shake down, hoping you were in fear of a) "legal action" and b) fear of having your credit rating blemished, and make off with your money.

If they attempt to contact you again, which, given the type of scam this smells like, is doubtful, be ready to assert your rights in this area. Demand that proof of debt, demand contact details... be prepared to lodge a complaint with the A-G's office and/or the Internet Crimes Center of the FBI if they can't or won't provide these details.
