action packaged inc Failure to refund money for returned Toshiba DVR670 hyde park massachusetts

On 10/23/2018 I ordered Toshiba DVR670 from Action Packaged Inc.  The condition was refurbished.  The cost was $329.48.  I recieved the recorder on 11/8/2018.  The box was not damaged however when I opened it the recorder was broken.  The front of the recorder was broken off.  It is clear it was broken before the item was packaged.  On 12/1/2018 I sent the toshiba DVR670 back to Action Packaged Inc.  On 12/4/2018 the package was delivered and left with an individual.  I requested a refund of $329.48.

On 12/12/2018 I recieved a e-mail from Action Packaged Inc.  The e-mail reads as follows "Hello John.  Thank you for your email.  We have submitted your refund and you will be seeing it shortly from Sears.  I apologize again for the trouble and please let me know if you need anything else.  Thank you.  Monica Order manager."

Action Packaged Inc has failed to refund my $329.48 as of 1/4/2019.  Action Packaged Inc has the recorder I returned to them for sale again on the Kmart website.  Action Packaged Inc has taken my money and is now selling the Toshiba DVR recorder again.  Please do not do business with this company.
