I received a collection notice from Afni Inc, Dated January 2, 2007. They are trying to collect on a Verizon land line phone acount opened by someone else, in my name. The phone was in service May - Sept of 1998. In a city I have nerver lived in.
When I tried to get a loan in April 2004, I found this debt was on my credit reports. Verizon was no help so I called KCA Financial Services the collecting agency. I filed a police report and got proof of my address during time period of the phone service(phone, water and elec bills).
I sent all this information to KCA checked my credit reports. Soon after credit reports were soon cleaned. No further contact with KCA
Thought nothing else of the matter, then comes the mail Saturday. AFNI states I need to respond buy 30 days or they report to credit bureau. I called them this morning and no help. They say I need to send them my police report and showing proof I did not live at the address of service. If I do I will black out my SS and DL numbers and DOB on the police report.
Iam pissed that KCA did not delete the debt, they just passed it on-sold it to someone else.
Any suggestions?

Yes, I agree with the former Ex- Employee. Steven Gayheart and Dave Widrick are very professional and stick w/ FDCPA guidelines at all times. It looks as if Verizon and AFNI Inc. are the culprits here. Did you send your information to Verizon ? You see Verizon and AFNI are the companies that you need to send this information to. KCA reported to the credit bureaus that this was a bad debt. I hope you get everything straightened out. I worked for Mr. Gayheart and Mr. Widrik at their Indpls, IN company Credit Bureau of Greater Indpls. They are sticklers on professionalism.

AFNI Inc. May have violated your rights as a consumer but not KCA. You said KCA took care of the matter then you say they didnt...which is it? See heres what it is KCA was the primary collection agency collecting the debt. So it went from Verizon to KCA to AFNI... OK well when KCA deletes the accounts which you said they did WELL THEY DID! Verizon got the account back and sent it off to their secondary third or fourth collection agency on the list. Thats how those work.
Who is reporting the account on your credit report now? Not KCA they took their reporting off -- right? Thats what you stated. So then who is the bad guy here? Not KCA they did what they had to do but Verizon didnt. They should have (just as KCA did removed your account from their records. Afni Inc. should have asked for proof of the deletion of your account at KCA due to fraud. If you didnt get a deletion letter from KCA call them back and have them specify on their letter that your account was deleted from the credit report due to fraud. Afni will have no choice but to do the same because you have proof that the account is invalid. Once you get to that point ask Afni Inc for a deletion letter also. Really I dont think KCA would violate your rights as a consumer.
Its seems like Afni is the bad guy here and Verizon is just as guilty for sending your account to collections again...after KCA returned it or cancelled it due to fraud. I hope I helped a little and by the way Steve Gayheart is a great man business or personal. He's doing his job. I can understand why he came off like that though. He has better things to do than talk about problems HIS clients created not the company he runs. GOOD LUCK!

The burden of proof is ALWAYS on the collector! You NEVER have to send them anything. And STAY OFF THE PHONE! Never call, or speak to any collector on the phone! NEVER!!
I have outlined the DEBT VALIDATION procedure and the Credit Bureau dispute procedure here on ROR dozens of times. You should read it and follow it.
You also have a right to sue for the damages the frivolous collections and credit reporting has caused you.
I would file suit immediately. However it seems as this ROR may not be timely, as the incident you mentioned was April 2004. However, it is a blatant violation of the law to "re-age" a debt. get copies of all credit reports and then do the validation request as described.
AFNI is a lowlife bunch of scumbags. I never heard of KCA. The ONLY thing they understand is a lawsuit.

Check the internet Verizon did not exist until 2000. Bell Atlantic and GTE merger created new name Verizon, so Verizon can not be original creditor. Also on mine the area code of the phone number they said the service was on did not exist back then. FRAUD.

Your original supposedly phone service was in 1998 and negative credit can only be on your credit report for 7 years from the original delinquency date. Reporting any date other than 90 days from the original deliquenccy date would be fraud. They can't come up with a new deliquency date everytime the same debt gets sold to new collector per the Fair Credit Reporting Act. Also the Statue of Limits has passed so they can't do squat. You are in control of this one.
