Allen Adkins called and tried to get me to sign an agreed judgment for $10,000 representing Citibank. I asked her to define "Agreed Judgment". This would save me from going to court, she willingfully added. She stated my balance with them was $14,000 but they were going to settle with me and do a judgment for $10,000.
The conversation was confusing so I took notes because one time she said that was not really a "settlement" amount - they would contact me in 60 days with a settlement. So I wrote down $10,000 judgment would come in mail. I was willing to sign this even though I was very apprehensive to sign anything that wasn't settled in court.
When I received this in the mail, lo and behold, it says judgment amount is over $14,000. So basically they did not work with me at all or try to lower this even though we discussed that a lot of that 14,000 was fees and interest that needed to be negotiated.
Now I have to hire any attorney which I cannot afford. My chances are better to get a workable settlement in court even if I represent myself.
Oh by the way, isn't Citibank getting a huge bailout from our government? So GEEZ, these credit card companies are getting money from US TWICE! Through our taxes and our payments. The American citizens are screwed!!

Summary Judgment

Thanks, John for the advice. But now Citibank is asking for a Summary Judgment, 3 days before the trial date. On Friday, October 9, 2009 Allen Adkins (the lawyer/debt collectors) are asking the judge to rule for summary judgment. I checked the actual court date (Monday, Oct. 12) to see if it is still set and it is. Also, I am not the only one up for trial that day at 10:00 a.m. There are at least 2 others being sued by Cititbank/Allen Adkins on the same day at the same time. In other words, we will be sitting there most of the day, until our name is called. Just like a herd of cattle, Citibank is going after us. My name is listed last, so I'm sure that I will be there until 5 pm. I'm not even sure that we will still be called that day, because if the summary judgment is granted on Friday, who will notify me that the court date is cancelled especially since a weekend falls inbetween the motion and the court date. I plan on calling the courthouse and asking them how to find out if the summary judgment was granted before Monday's court date.
This is just another trick by Allen Adkins and Citibank. They know that I will be intimidated and think that the court date is cancelled so they hope that I won't show up. HOwever, things will probably rule in their favor with the summary judgment anyway. I feel like the U S. government is favoring the banks and we are helpless as citizens to fight back. The gov't gave them all kinds of money and now they have the ammunition to take us down. I have no money from the gov't and have faithfully paid all my bills on time for years and years, until last year when I fell behind due to the economy and my wages dropping because I am commission sales and was affected by a drop in sales. But alas, the gov't is not helping the poor, they are helping the rich banks so that the politician will get their monetary support some day.
I am judgment proof so Citibank and Allen Adkins are wasting their time going after the little people like me. I wont be able to pay them. But it will affect my credit for a long long time.

On the court date: DO NOT be a no-show under any circumstances whatsoever. People often make the HUGE mistake of not showing up because they think theyd loose anyway. Not showing up is the worst thing you can possibly do. Even if you are frightened....or you're sick with a 102 degree fever...or if you think that you'd loose, show up anyway! If you don't, the other side will get a default judgement and they will get this on THEIR terms. They will tack on all sorts of add-on fees and the amount of the judgment could end up being two or three times the actual amount of the debt.
IMPORTANT: bring complete documentation of your income and living expenses: Pay stubs and copies of bills. Even if you loose, you can use this to negotiate much more favorable repayment terms. Request the following info from the other side on the court date:
- a copy of the original application with your signature
- a fully itemized statement for the amount they are asking which clearly details how this amount was calculated, including the interest rate being charged - How much was this debt purchased for?

Citibank and Allen adkins are taking me to court. We have a court date. I can't hire an attorney. I have no money for this. I am going to tell the court how they put the summons on my front door with no envelope for all the world to see (invasion of Privacy and violation of privacy laws) and beg for the courts' mercy. If anyone else can think of a way to help me fight this lawsuit, please send a comment. I have discussed sending them $30 a month, this is all I can afford. I have had 2 other credit card companies work out an equitable agreement with me but Citibank is not willing to do this. Why do the Big corporations get money from the Government? They aren't using it to help consumers. Neither is the federal bureaucracy. Sad day and time for this country.
