I was contacted today by phone on a line that isn't even listed as my own. A Mr. Bill Dorsey (I am unsure if I am spelling that correctly) contacted me and told me that he had been given this account by another agency and trhat I had 2 hours to come up with someone who had a credit card for the complete balance of what was owed. He never stated what company he was from, or even really who he was other than his nameand call back info. I explained my circumstances regarding the account and he told me that he frankly didn't care and that I had two hours to come up with the money and call him back. He then hung up the phone on me without giving me a chance to respond. He didn't exactly threaten me with a specific recourse, but his manner was threatening and very upsetting.

I contacted Employee Services where I work and they gave me the number of legal aid in my state, who in turn gave me the number for the FTC. I called the FTC and filed a report. They instructed me to call back and get an address and name of Company to send a cease contact letter. I called back the Company where a secretary answered with the company name. She stated the name extremely fast so I asked her to repeat it, then asked her for an address where I could send info to. She told me she didn't give addresses and asked who I spoke with. I told her Bill Dorsey and she forwarded me to the man without even asking my permission. A different person answered and I asked him if I coould get an address to send information to them.

He was immediately defensive and aked what kind of information. I told them I contacted the FTC and told them they instructed me to get the address informtion so I could send them in writing what I could afford to do. He told me that he didn't believe I contacted the FTC, that they were a federally backed collections agency, that he didn't have to give me ANYTHING, and that Mr. Dorsey had a "right" to be angry with me, and that the payment options given to me were the only ones that they would accept. I told them that I did indeed contact the FTC, didn't appreciate the rude, threatening behavior, and again requested the address. I was then told if I wanted the information so badly I could do the research myself, and again hung up on. I recontacted the FTC with the name and they looked it up online for me and gave me the conatct info I needed with further instructions to not deal with these people by phone anymore, to just send the letter by certified mail.

they have tried the same thing with me, asking for my account, well, I have none, so they asked me for a friends or relatives account!!!! I am 37, ya I'll ask mommy to use her account and get screwed. I was told they only use checking accounts, then 3 days later after being called at work, they would accept western union, "as a courtesy, and favor". These guys are such scammers, we need to take them down. they say they are lawyers, 2 of them said they were to me. conned me into giving me my work phone #. I just posted a new complaint read that for the whole story!!!

Laws regarding post dated checks vary from state to state so the best practice is not to even go this route when dealing with collectors.

Post dated checks are kind of a double edged sword. On one hand if someone sues you because a postdated check bounced then the courts may not necessarily givwe them much relief because they knew when they took the check that money may not have been available when time came to cash it.

Technically speaking a postdated check is good the day it is written you should not write the check if the funds are not there. A person can cash a post dated check in some states with no problem.

808. Unfair practices [15 USC 1692f]

A debt collector may not use unfair or unconscionable means to collect or attempt to collect any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:

(2) The acceptance by a debt collector from any person of a check or other payment instrument postdated by more than five days unless such person is notified in writing of the debt collector's intent to deposit such check or instrument not more than ten nor less than three business days prior to such deposit.

(4) Depositing or threatening to deposit any postdated check or other postdated payment instrument prior to the date on such check or instrument.

I would contact an attorney and see if you can recoup some of your payment in the way of fines.

Never give Bank or Credit card account number over the phone

You are setting yourselves up giving this info to collectors over the phone. No matter what they threaten or say.

Giving them the routing and account number verbally once gives them the authority to use it anytime for a payment.

I cannot stress that enough. Call your bank if you don't believe me.

Like looking in a mirror

I was just reading this report on Allen Lewis and Associates and it was almost like looking in a mirror. I had almost the exact same situation happen to me in July with the same Mr Bill Dorsey. I could not believe the similarities in which this persons story compared to mine. In my case, my issue with the company was the deception in which they went about collecting this debt. I was full willing to pay my debt, I knew it was legitimate but Mr Dorsey told me he was an attorney.

I also set up specific payment arrangement for a specific date when I provided my account information. No surprise to me, they debited my account on a non authorized date and caused big headaches(and fees). When talking to them again, I was told I could no longer talk with Mr Dorsey and the rep I spoke with indicated what was on their "tape" was a different story. I guess they only "tape" what they want taped. My only advice is before you commit to paying a debt, be sure you research the debt, the collection agency and document everything.

Florida Attorney General Investigates

I have been looking up this company and doing some on-line research and found out there is an ongoing investigation by the Floida Attorney General against these guys. I have filed a complaint with him also and urge others who have been harrassed by these people to do the same.

I have an update. I contacted my bank once I realized this was the same company that had contacted me numerous times before, even calling 5 of my relatives saying that I had better have my lawyer contact a Peter Gibbons for a "federal matter". I told my bank of the situation and they noted my account that any withdrawals made from this point on would be unauthorized. I contacted the BBB of Northeastern FL also and filed a report with them. I called the company I had the original debt with and made payment arrangements with them then called Allen Lewis and Associates to tell them that they need not contact me anymore because I made arrangements with the originator of the loan and they replied that they would contact the company and tell them I "bounce checks" and that would take care of that...and was immediately hung up on. I sent a certified cease communication letter this morning and will hopefully never hear from these jerks again!
