I was at work today and Allied Interstate called my mom and told her I had until 12 to take care of my debt. I called them back to try and settle this case.

Well they threatned me and told me that they had my bank account information and said that I had 3 options. 1) to pay off the whole balance 2) make monthly payments 3) make payments until I can pay off in full.

I agreed to making 2 payments of 104.71 and then one of 50.00 until my income tax is ready. Now I did not feel safe about the situation but they said that the conversation was recorded and that there was no way that they could touch my bank account for any more than agreed.

Now I am reading all this information on them and I am scared to death. Is there anything I can do? They told me since I agreed to this there is nothing I can do now. Please help me!

Danika, NEVER give a debt collector your banking info!

AUTHOR: Steve - (U.S.A.)

POSTED: Monday, November 13, 2006

Danika,

NEVER speak to any third party debt collector. It will never do anything positive for you, and will in most cases cause you more problems.

NEVER give ANY debt collector your banking, employment, or personal information. NEVER. You are under no legal obligation to do so.

NEVER pay any third party debt collector. making the payment will hurt your credit score, AND will reset the SOL where the debt may have not been legally collectable before. ALWAYS ignore collectors until you get a summons. Then, and only then, you deal with it.

Unless you are a minor, they violated the law in discussing your debt with your mother. That is a blatant FDCPA violation that can pay you up to $1000 plus costs. Sue them now.
