We suffered storm damages to our property and Allphase presented themselves as a General Contractor for both Construction and Roofing.  We checked them out as a local company in good standings.  First, their false statement lead us to believe they could offer us full service for our property damages that would us to limit separate contractors related to all of our repair needs.

Next. finding multiple contractors were necessary, our total damages assessment and insurance payment was for work related to multple companies.  However, when our insurance payment came in we understood the "standard practice" was to forward the check to our mortgage carrier for their required third party endorsement.  Allphase, and specifically Mr. Chance Williams, assured us this was neccessary and that they would handle this process for us since they had documents that needed to accompany our insurance check, understanding the check would be returned to us by your mortgage carrier, allowing us to release actual payments.

There were supplemental damages submitted to our insurance for payment from Allphase, and Allphase caused damage to our property due to their neglect and inexperience.  We reviewed all the damage assessments Allphase had submitted to our insurance adjuster, and we felt many were unneccessary or falsely stated. 

Then in questioning our mortgage carrier about the status of our insurance check and their internal endorsement process we found Allphase had simply deposited our entire insurance damage check in their bank account.  Allphase was FIRED from our job and we were able to obtain another contractor to at least finish the roofing mess they left us with.

We requested a refund for the overpayment of other contractor company funds, and we have filed complaints with the Phoenix Police, the AZROC, the BBB, our insurance, our mortgage carrier, and the Allphase Merchant Bonding Carrier.

Our mortgage carrier is investigating against the improper endorsement, the Banks are investigating against the improper endorsement and the Phoenix Police are investigating against the improper endorsement and retained funds.

Allphase has tried to pass off their depost of our insurance check as a simple banking error by their staff.  However, Allphase would not return the amount of payment that was designated for other contractors, and for work cancelled, they did not complete.

Now the banking industry has "RECALLED" our payment from their bank account, and sounds like our property insurance will re-issue a check to "CORRENTLY" be submitted by only us to our Mortgage carrier, for their proper endorsement.  They then will FEDX the check back to us so we can remit all the separate payments properly.

Actions still speak better than words, so from the police report this was a charge of Grand Theft against the contractor that took the coordination of three banks to cancel payment on our Homeowner insurance check the contractor should have never asked for from us.  We understand these contractors come into our neighborhoods, over-sell their labor on projects subsequently causing their own business cash flow problems.  Cashing insurance checks that do not belong to them is a "quick fix". 

WE undersstant this is a "GAME" against homeowners, contractors can use, and the Arizona Attorney General is aware of this contractor money "GAME".  We now know the homeowner is to endorse the insurance check and send it to the mortgage holder themselves, typically by express mail, get the mortgage holder endorsement back and the homeowner is to deposit THEIR insurance check into their bank and pay all the damages with their own personal checks.  A contractor is not to be trusted to send the homeowners insurance check to the homeowners mortgage holder under the "excuse, to attach their own paperwork". 

It was stated as just an unfortunate error by the allphase owner that our check was endorsed by him instead of our mortgage holder, and deposited into his business account, and his bank did not catch the endorsement missing.  We had a separate company finish our roofing project and they were paid in full on a separate homeowner insurance check that we express mailed to our mortgage insurance for endorsement, and our personal check payment went to the second company without issue.  Work with this company at your own RISK.

While most people that file insurance claims use  the money to repair the damage to thier property, some people use the situation to "pocket" the money. Such was the case with Debbie and Charles Fehr in my opinion. 

When the Insurance company and the home oweners mortgage company suspects this is what will happen, the check is made out to the homeowner and the mortgage company. 

Greed is a terrible thing..
