I was told on the phone twice that I could sign up for month to month service with no penalty to stop the service (my spouse heard the same commitment). After a few months I stopped the service and got a bill for $295 as a cancellation penalty.
I must have had 10 phone calls and emails to both AllSat and DISH - telling them what i was told on the phone. They basically said I lied and kept sending me bills with threats to go to collection.
I wrote a letter to the CEOs of both companies but never heard back.
I convinced them to listen to the tape of my conversation - they said they would. I the get the same bill noting that the written contract states the penalty. I told then that salesperson on the phone told me that he is authorized to offer me the month to month deal.
Either they never listened to the tapes or they heard their salesperson tell me exactly what I said and they will not admit it.
Looks like I have to pay or my credit rating will suffer.
I did send complaints, for each respective state, to the BBB, Attorney General and FCC. These are all on line and you just find the correct state. We'll see what happens.
If anyone has advice, let me know. Thanks.

I'm sorry for your misinformation, but maybe this will clear something up

Hello, I'm a Partner Technical Service Rep at Echostar, i.e. Dish Network.
Looking at your complaint, I can say the following things that might clear some things up.
A) Sales Reps don't get commission until the customer has been active for 3+ months. This prevents any "incentive" to lie or fail to disclose proper and vital business procedures.
B) When ANY new customer is installed, through a retailer, partner, or directly through DISH, one of the following things gets applied to your account:
1-$99.00 Activation Fee
OR
2-A 24 month (2 year) commitment (contract) to DISH network, that comes with a prorated cancellation fee of $10 (ten) dollars per month remaining in the contract. Example: You sign up for the commitment, take off service 6 months in, you pay $180 dollars cancellation fee (18 months at $10/mo). $295 sounds a little exaggerated, so if you could post the itemized charges it would help me understand the bill a little better.
The reason for the 2 year commitment are unfortunately customers who "promotion surf". Basically switch their service to whatever company has the latest and greatest promotional rate. This is almost across the board an industry standard now, since each company is looking for long term customers.
C) DISH network does not offer month-to-month service contracts. Specifically for the reason above. Other than the two options above, some retailers will offer incentives, like a free TV or Ipod or something, but the base contract remains the same. 2 year commitment to service, or $99.00 activation fee.
I do apologize for the misinformation via whichever sales rep you spoke with. I hate to see these cases where a couple sentences could have avoided a huge mess. In the future I would (and do myself) get full contracts sent out to me in writing (you have a right to this), read them fully, and sometimes I'll speak to a couple different people to avoid misinformation (including a supervisor).
I can't speak for the whole company, but I myself strive to provide accurate information first. I'm not out to screw people. I doubt DISH is either. But in this world and economy you've always got to CYOA first (excuse the language).
I again am sorry for your situation, and wish you luck in future endeavors.

Maybe equipment fee?

I'm sorry to hear about your situation, but I hope I can help. DISH does offer a month to month plan. If you're being charged an early termination fee, you can fight it simply by requesting them to show you a signed contract. If you didn't make a commitment, then this should be impossible for them to do. I'm wondering, though, if you're actually being charged for the equipment though. The early termination fee doesn't go any higher than $240. If you're on the month to month plan, you don't own the equipment and are required to return it. If you haven't returned it, maybe that's actually what you're being charged for. The bottom line, though, is that the company does in fact offer a month to month plan. Hope this helps!
