August 2013 I became very ill and forced myself to work.  I made a autopayment and ended up in the hpspital and was granted temporary disability. I called ally auto several times to negotiate a payment as soon as I left the hospital.  Ally refused to take my payment and instead closed the loans hung up on me.  Then ally auto representative belle at 

(866) 722-2142 called me using a spoof fake number to threaten me with criminal court action if I did not return the vehicle that I was trying to pays the entire time. They disrespected the fact I was on dusability the woman threaten me subtly and was very nasty and rude to me.  Then to make matters worse she lied about my ability to get the truck back and instead set me up with mike at ally in Dallas Texas who pretty much insulted me by stating I need to get a new loan from someone else. 

This company goea after people like sharks.

As a Consumer and well respected local licensed contractor business we ourselves are dealing to the unscrupulous financial doings regarding Ally Bank as well for over 2 1/2 years. It was regarding a loan from RV dealership in which we returned highly defective product back to dealership within days and even hired lawyer to file C & D with them- and this involved in the dealership (4 MEN INCLUDING GM) ACTUALLY BERATING AND ACCOSTING MY WIFE WHEN SHE RETURNED THE DEFECTIVE PRODUCT TO THEIR LOT to where she froze and broke down in tears crying (I didn't kniow till hours later)... 

fOR OVER 2 1/2 YEARS WE HAVE BEEN IN A NIGHTMARE. My wife having PTSD even and we have gone through hell and back trying to get satisfaction as a consumer to no avail- Ally seemingly getting away with financial extortion as several persons in their own Financial Collection Department even reiterated in August 2016 when we last talked to them...

Our situatuion saw a lawsuit filed, then after months of delays, Sunrise Camping Center's lawyer requested mediation which was another waste of time & monies. All we wanted was for the dealership to refund all the payments we made monthly as advised to protect my personal & business credit and the loan balance so Ally would be satisfied and the dealership could receive the title thereafter to re-sell that product. Dealership said camper depreciated so much in a year (been in their possession since 2014), that they only offered to pay us $10,000.00. That meant we would still have to pay several thousand dollars more to Ally for loan balance to be paid off and be out of all the former monthly payments already made plus legal costs! 

Then lawsuit prevailed after mediation and court dates rescheduled by Sunrises' lawyer on several occasions again. IN this time, our lawyer started to reverse himself from the hard hitting caring guy we first hired and paid and filed C&D and lawsuit with charges, to the guy sho was afraid of his local business and good old boy network that prevails here in Hickory, NC legal realms as he put it... He thought we should have taken Sunrise's offer in Mediation, so filed to stop representing us, leaving us hang...

SO we get to point of actual day of a trial hearing (February 2016), we were told from another lawyer to simply ask for continuance and should be no problem, to give us time to find new lawyer. In front of Judge Amy Sigmon we pleaded twice to her to allow us a continuance to find new lawyer (we already had contacted 17 in this time frame), and she refused us to do so and demanded a trial hearing proceed! We are not lawyers. We do not know processes. She didn't care! In one fell swoop, this Judge effectively swept everything and every charge under the rug and closed this case! Our RV industry expert in Phoenix we had from day one, tons of information, docs, etc never saw the light of day with her doing this because we were refused time to find new lawyer after ours walked away after mediation! EVEN fact the former GM of Sunrise (George Petree) called us at our home last October one night upset saying he quit working there after our mediation, due to evil operations and many good people being hurt finacniallly by the dealership and loans, that his conscience haunted him so long in our case and he wanted to help us! 

As a note, Sunrise's lawyer (Andrew Jackson Howell) works for the Sigmon/Mackie law firm in Hickory, NC- and the Judge's name is Amy Sigmon... 

The BBB and other resources are useless for consumers today. We even went to FTC and CFPB and all they do is recycle the same information between parties already known and never make any determination. We tried (still) to contact NC  Atty General Roy Cooper to re-open this case and never heard reply from him. We also contacted ACLU (Deborah Ross in NC), and they told us they were sorry and underfunded and had only 1 lawyer for entire State fo NC! 

And after 28 months of paying minimal payments to Ally (to preserve my creditworthiness throughout legal processes) since April 2014, we contacted Ally and told then Enough is Enough and we were tired of throwing monies to them for a defective product returned 2 1/2 years earlier to the dealership because the dealership refused to rescind & return said loan funds in the beginning to Ally!  All this could have been avoided if the "right thing" was done for the consumer in the beginning. August 2016 we talked to several persons inside Ally's Collection Department and they informed us that there never was anything ever inputted on their system about our demise and communications we had with a S. Gilliland from Ally since August 2014! NOW, as of last week, we have been served with papers from a Raleigh, NC law firm Ally has hired to go against us and "repossess" this camper  and the dammn thing has been with the dealership since April 2014 where it was returned highly defective then! My credit now has been hit badly for 2 months' time and ALL OF THIS IS VERY WRONG to see occur when we, as consumers, did nothing wrong, and the guilty parties get away doing this. NONE of them take any responsibility, and my wife is still haunted by how she was berated to tears by Sunrises' Owner (Paul Bowman) and GM (George Petree) and Maintenance person (Bobby) the day she dropped that camper off to rescind contract and return loan funds back in April 2014.... 

Then in all of this time, after a lawyer rating agency (AVVO) saw us give our lawyer 1 out of 5 stars, we received long messages on our home & business voicemails from our former lawyer (William Morgan/ Morgan Law Firm) hurt & upset saying he didn't deserve to get the 1 star rating we gave the service and was angry at us !!!

Plus?? Interesting how you left out every minus.

You left out just how far behind you were.  You left out just what "arrangements" you were trying to make.  You left out how much of a payment you were trying to make(ie. was it a full payment to bring you current or just a partial payment on a past due amount?).

You failed to mention if you had hid the car or were making it "hard to find".  The reason this is important is because if you were behind they have the legal right to reposess it.  If they are unable to do that because they can not get access to the car.  They have the legal right to take you to court.  In court the judge will require you to turn the car over.  If you refuse the judges order, it then at the very least becomes a contempt of court issue which is a CRIMIMAL matter.  On a worst case(for you) it becomes Grand Theft Auto because remember it is NOT your car until you pay off the entire balance.  Until then they hold the title.  Oh and one more thing about this, the harder you make it the more fees that are racked up and you are 100% responsible for them. 

FYI it isn't an "insult" to say that they no longer think you can fulfill your legal obligation and get a loan from some else.

ally refused payment. Plus I'm not the only one that this has happened to. Plus they could have put the payments at the end of the loan and extend it if needed with interest.  Plus I wonder how many naive people including myself were suckered into thinking that a criminal complaint would be filed to get the truck when this is obviously a civil matter.  Collectors can not intimidate people with arrest. Banisters win again.

There are no contract provisions to skip payments.  There are also no contractual provisions which require them to "help" you.  This is the norm for financial contracts, nothing different here.  No, I don't work for them!
