I was a manager within this company and I have much inside info for all to be aware of.

If you don't want to read everything I have to say, I at the very least implore you to avoid this company completely. Even if you think you can follow their "rules" and can protect yourself from getting scammed, the chances are very high that they will get you one way or another!

OK, so your taken in by the very convincing commercials (radio, TV, magazines, etc.) and wish to place an order for a "free sample"...

1. Be aware that this is not a limited time offer, this is how they initially get you to bite. This is a popular marketing/advertising scheme.

2. You have to pay for shipping/handling/processing by CREDIT CARD ONLY. This is so that they can charge your card again later (most likely without your knowledge).

3. You are automatically enrolled in Managed Care. This is the big one! If you order by phone they may not even let you know of this or will make it sound like you will be in control of the program. If you order via their web sites you will have to hunt to find the policy. It's tehrem but it's not made obvious upon ordering. The way it works is that they will automatically send you a 60 day supply at "discounted rates" (you get 2 months for what they would charge for a 1-month supply, normally arounf $69.95). Of course this is charged to your credit crad without any notice to you.

4. They will do this every 2 months unless you cancel. If you don't receive the shipment (mailing address error, quite commonly... isn't that convenient) and you don't carefully read you credit card statement, this could go on forever at your expense!

5. They used to send out this 60 day supply "conveniently for you" so that you would get the supply before your origianl free-sample supply ran out. So this meant processing your "order" 20 days after your original free-sample order, and of course charge you card. This repeated every 45-50 days (2 month supply remember).

6. Now the info I've gathered is that they apply Managed Care 10 days after your original order and every 45 days there after.

7. The compnay name changes often to avoid a long history and bad track record, however they are not that bright and it is easy to follow the paper trail. Warner Health Care, Lifekey Inc, Wagner Nutraceuticals, now Berkeley Premium Nutraceuticals. Oh, they can explain the changes, from each compnay focussing on a particular brand name to convergence of the off-shoot companys into one Mother-of-all ripoff companys.

8. With the name changes come physical location moves, again making it more difficult for the avergare customer to track. Of course there is absolutrly no notification to the customer of these changes takeing place.

9. They also change phone numbers with the name changes and moves, disconnect th eold ones with no forwarding info or notice to the customer. They're so mixed up that at times when you ask for product literature, they will send pamphlets with old company names, old phone numbers, old pricing, old guarantee info (more on this in a minute), etc.

10. The gurantee - it's never meant to be honored! Originally the out was the statement of Satisfaction Guaranteed with the small print saying no refund on shipped product (remeber they ship stuff to you without your knowledge). Now it's the 12-month challenge or 12-month guarantee where the plan is to change the offer over the 12 months making it so confusing and difficult to follow their "rules" that you'll either give up on trying or you wont be able to satify the small-print requirements. Warning - don't accept or sign any follow-up offer - it negates th guarantee! Anyhow - the only chance you have of getting any refund is through a BBB, FTC, or State Attorney General complaint which they may respond to with a refund if they feel like, They have an attitude that they are one level above all of these organizations.

11. The owner, Steve Warshak, is a very good business man who runs everything on the bordrline of being legal, however enrything is unethical. This is how he makes his money and continus to be in business. But this will catch up to him eventually.

12. The best phone numbers to try is the sales number in the ads for which ever product you got screwed on. Any other contact phone nu,ber will result in LONG hold times. But the problem is the sales department can not handle any questions or concerns post sale (again isn't this convenient) and will direct you to call another number, even though the department is in the next office in the same building on the same phone system.

13. Pamela Butler is the newest Customer Service Manager. Jim Teegarden is an Operatiosn VP. Greg and Sue Cossman are VP's as well (Sue is Steve Warshak's sister). Chip Clarke is the marketing VP.

14. The products themselves are herbal natural formulas, not regulated by anyone. The best true scientific studies show that these products are successful to the same extent as placebos and have worked well for few, but this group is a tiny minority. The overwelming majority see no benefit from using the product.

Research more via the BBB and Ohio State Attorney Generals office.

I joined this company with the anticipation of making changes in policies and making things more legitamate and honest for customers. After only a VERY short time I realized this was never going to happen. (as an aside... all employees are being used by the compnay. yes they offer a paycheck, but working condiitons are terrible).

Well, I probably will add more later when I realize I forgot to say something. I hope this info helps.

Enzyte and the Fine Print

AUTHOR: Norris - (U.S.A.)

POSTED: Sunday, January 21, 2007

One morning I am listening to the radio and hear the commercial for Enzyte, a safe, homopathic alternative to Viagra, and the manufacturer is so sure of its prowess you will get a month's supply free, pay shipping and handling. It went on to say that if you sign up for a 12 month supply, and it doesn't do as described you get your money back. I told the operator I just wanted the sample, and if it worked I would call back. If it didn't work I was out $6.95. The pills arrive and as I'm reading the ingredients and directions I notice some very, very fine print on the label.

Bottom line is: If you don't call and cancel within the first 30 days you will automatically be sent a two month supply at $69.95 plus S&H. I called and figuring the pills are nothing but sugar pills threw them away. the scamm is as the orginator states.

Their newest commercial says over three million satisfied customers. Which means that they billed that many before the customers knew what was going on.

Read carefully is not an idle suggestion.

So if this company is so wonderful....

AUTHOR: Deb - (U.S.A.)

POSTED: Wednesday, January 04, 2006

why were they raided by the FBI and why do none of their web sites work anymore? "Under Construction" my foot.

I too ordered from this company, bought the product as stated for over a year after being informed that was the deal in order to get a full refund. When the time came for a refund, the "policies" had changed and I got nothing back. Despite having a tape that recorded all my conversations with everyone I spoke to at Berkeley from DAY ONE. Each person knew they were being recorded because I told them. But despite all that, I was still out over $400.00 and I followed their policy that was in place and as instructed from day one. So not reading the materials or web site was not the issue for me. I did my homework. What I did not do was expect this was all just a rip off and that at no point was I ever going to get any satisfaction from this company.

Hopefully, they are now completely out of business and the class action lawsuits against this company and all of its bogus subsidiaries will prevail in favor of the thousands of people who have been scammed by this company.

If I have done this is my subscription really cancelled and will that $69 not be taken from my account every month. Do I have to call the company and request that the membership be cancelled that way too. Please anyone help me out. Im pissed that money is being taken from my account every month. Eight Squared Clarification, I'm an employee of that company and can assure you that we are not the same company as Berkeley

AUTHOR: Jonathan - (U.S.A.)

POSTED: Monday, November 08, 2004

In response to the mention of Eight Squared, I'm an employee of that company and can assure you that we are not the same company as Berkeley. Berkeley manufactures several products we sell, including Avlimil, which we obviously buy from them, but that's where the relationship ends.

We've had some bad luck with Berkeley ourselves, but it's mostly come in the form of their customer service sending any customer they can't handle our way. Today alone I've dealt with four calls from people whose credit card statements clearly said Berkeley was billing them, yet Berkeley's customer service had the gall to say they needed to get in touch with us. Let me clear the air on a few points:

1. Eight Squared, Inc. does not, has never, and will never fulfill an order for Berkeley Premium Nutraceuticals. We are separate entities with our own customers.

2. Eight Squared, Inc. bills as Eight Squared, not Berkeley Supplements or as the product name.

3. Eight Squared, Inc. does not honor any of Berkeley's policies, such as the manufacturer's guarantee on the products or any cancellation confirmations. Like I said, we have our customers, and they have theirs.

4. Eight Squared, Inc. is not a contracted distributor of Berkeley products. We are an authorized reseller.

It's a good thing I did some research before buying anything.

AUTHOR: William - (U.S.A.)

POSTED: Sunday, November 07, 2004

Anytime I am considering buying a product online, I have found it's always best to do a little research beforehand. I have fallen prey to other scams in the past and learned my lesson. I just want to encourage those who have been ripped off by this scam and applaud them for taking a stand. After all, the only true power an individual in the US has how they spend their money. And I have a couple observations I would like to make for the few defenders of this very disreputable company.

1. I worked at a technical support call center at Dell for 6 months. Now, reading the posts from the people who claimed to work for this company, I can easily say their call center sounds much more like a telemarketing call center than a customer support one. A reputable company will monitor their workers and make sure customers are receiving quality support. I am not going to hash out proper operation of customer support call centers because it would be a big post. None the less, any reputable company tries to keep existing customers, not place the blame on them.

2. I stumbled across this website doing research on the products this company was offering. I really do not understand how someone totally satisfied with their product would come across this web site at all, let alone seek it out and make a post. Usually satisfied customer will e-mail the company directly or post on the companies testimonial section.

I will defiantly not spend a dime with this company, and I will make as much noise as I can to warn any potential customers of this company to beware. Exercise your power of consumerism, don't be a victim of it!

POSTED: Friday, October 08, 2004

Russ, thank you for the heads up. But since enzyte worked for me, and my girlfriend will be visiting for 2 weeks, I will have other priorities than posting on here again. I am not worried about any snakepit or whatever you gentlemen may call it. This is a forum to express grievances and also rebuttals, which I did. So any personal attack is unwarranted and childish, me being new or now. If you two have so much energy to be hateful towards me over my comments, please come to Florida and help volunteer with the cleanup from Hurricanes Frances and Jeanne. We are all rebuilding from that right now, and there are many thousdands of people that would appreciate your time and expeertise. Heck, you can ever help me repair my roof which was torn off during Jeanne.
Best of luck to you all in receiving back the money which are owed to all. Maybe you can join the class action suit if you have not already...

AUTHOR: Russ - (U.S.A.)

POSTED: Thursday, October 07, 2004

David. You may have noticed. Anyone who mentions anything nice about this company on the Ripoff Report has just stepped into the snake pit.You are fair game and will easily be bitten. Guaranteed.

Jerry was being nice to you this time, seeing how you are new and don't know the way it really is .

Some may think you were lucky you did'nt end up in an oven with an apple in your mouth and a meat thermometor stuck in your butt.

For many who have posted on the RippoffReport, Berkeley seems to be a touchy subject. That you can see. Does'nt seem to matter if you think you are doing the right thing or not.No matter that you were merely stating your own personal point of view. You sinned David by being nice about Berkeley.Big time.

Proceed with caution if you wish to enter the Snakepit again David. Heed all warnings.

David Your one and only support of the Berkeley Scam will go a long way in warning the 3535 complaints filed against this company (by the way I did talk to the Ohio Attorney Generals

AUTHOR: Jerry - (U.S.A.)

POSTED: Tuesday, October 05, 2004

Good to hear there is one person out of the 4000 (excuse me 3535 in 3 years) who are so very happy with Berkeley Premium Nutraceuticals. Your one and only support of the Berkeley Scam will go a long way in warning the 3535 complaints filed against this company (by the way I did talk to the Ohio Attorney Generals Office (unlike yourself) and they are so aware of the complaints filed against this company, that they are having to bulk mail the complaints into this company). I sure feel warm and fuzzy inside knowing that you were fully aware of all of the deceptive measures this company used and were able to cancel your order with the greatest of satisfaction! Boy, what a relief that one out of over 4,000, and yes I said 4,000 complaints, (you need to add all of the various complaints to get the over 4,000, plus realize that they don't increase that number each time a complaint comes in), was taken care of in a professional manner. I didn't know I had even been scammed until I had received my so called FREE sample, cancelled any further shipments and done everything I was told to do. Oh, but excuse me because you, Kelly, and Sarah support this fine company, I wouldn't want to slander such a fine establishment, so the 500 or so complaints filed on Rip-Off Reports and over 4,000 complaints filed with the Ohio Attorney Generals Office and BBB are just a miss understanding. Dude, you need to pick your battles, unless ofcourse you are part of this scam. If that's the case then carry on, you are doing a great job lining your pockets!

Thanks John for posting the inside information on this scam operation. I think the class action lawsuit, Attorney Generals Office, BBB, people filing complaints, and the rip-off report site tend to believe your side of the story a little more than Berkeley's greatest fans David, Kelly, and Sarah.

Thank you David for sharing your cheery uplifting experience with Berkeley. I'm sure it gladdened the hearts of the legions who got hosed by this company. They now know there is hope for a better tommorow, there is a Santa Claus after all,and only good things are in store for them if they decide to do business with Berkeley again. Unfortunately for you, there is no way to prove your story one way or the other to Ripoff Report readers.Just what you wrote is all there is to go by.If your story is legit, then 3 cheers for you. Both you and Smiling Bob have something in common.Admittingly ,there is no way to disprove your story, but it could also be a fabrication from some Ministry of Propaganda Department somewhere. Sprucing up the company image?Spin control in conjunction with a possible class action lawsuit maybe.?Who knows for sure.If your story truly is legit, and I'm sure there are others that are, then my sincere apologies for writing this.Glad you had a good experience. If it is'nt legit, then you and Smiling Bob know what you can do with your Enzyte.I remain yours ,Forever Skeptical.

True to their words... Just my comments, take them for what they may be. But I am a satisfied customer

AUTHOR: David - (U.S.A.)

POSTED: Monday, October 04, 2004

Before anyone accuses me of being an employee etc of Berkley, I am not. Just someone who saw the commercial and thought, hey why not?

I went to the website, I believe it was 4enzyte.com but may be wrong. I saw the free trial, just pay shipping and handling. I saw the Managed Care part about automatic shipping. I received my product within 2 weeks, and cancelled becuase I was in school at the time and did not make a boatload of money.

I had no issue cancelling, and not only that, they sent a flyer on how to buy enzyte without the Managed Care program, which I did.

As for the effectiveness, lets say that my girlfriend loves the product, and I only take it the days I see her because she is in OH and I am in FL. I don't take it everyday and it still works very well.

I can understand everyones frustration. But the managed Care program is well defined if you go by the website. There is no way it is a scam because it says right there that you will be enrolled. And it is herbal, everyone reacts differently to different things.

Just my comments, take them for what they may be. But I am a satisfied customer

Totally Ripped off by Berkeley and Enzyte.

AUTHOR: Thomas - (U.S.A.)

POSTED: Tuesday, September 28, 2004

I believe that I was majorly ripped off. One this company doesn't even know how to spell their name right. They tell you to go to www.askberkley.com to cancel your membership which is a joke as there is NOTHING there to be able to cancel it. 2)Then on their home website it's spelled berkeley...notice the extra E there.

I haven't had a shipment for some time. But they still took $69.95 out of our account. They refuse to refund the money BUT the product has not been shipped to me. Or maybe I should say...I sure didn't get the shipment!!!!

Well...called to get the account canceled and my money back so that my utilities check doesn't get bounced back and our lights turned off!!! They refused. Suddenly I am on a 12 month continuous schedule for these useless pills. I know for a FACT that I signed up with a 90-day money back guarantee! They say that I have to be on the program for 12 MONTHS to get my money back!!!! This is false and fradulant..they say they only NOW have changed that. WRONG!!!!

Has anyone on here gotten their money back from their attorney general??? I'm filing tomorrow with them. I'm sure I'm not the only dumb smuck to have my money stolen.

Another Smuck Taken In!

AUTHOR: Jerry - (U.S.A.)

POSTED: Thursday, September 23, 2004

I guess I am just another one of the smucks taken in by this company. However, I saw their advertisement over the TV more times than I would like to count, I finally succumbed to the "Free Sample" hook line and sinker. I usually pride myself on being smart enough to be aware of such tactics, but low and behold they got me! I did everything they said to cancel this product, which was pretty deceptive in itself, and still got clipped for the $70 (cost of getting the "Free Samples"). Any way you look at it this company is a "Scam Job", just better than most at getting away with it. Had I seen the Ripoff reports on this company and the "over 4,000" complaints about this company on the Cinncinati, Ohio Attorney Generals & BBB websites, I would have run screaming away from this con-job, but needless to say I didn't find these reports until after I was burned. Yeah, Ask freaken Berkeley was real nice to me when I explained that they had fraudulently charged my credit card, but they became the typical monsters a boiler room scam does when I requested a refund of my monies. I've received nothing back, so far, but I have filed my complaint with the Cinn., OH Attn. Gen. Office and I have signed on with the first class action law suit I found against this outfit. All I expect to see out of this is a few lawyers get rich and I pray to god! to see this scam finally get wiped out. To sum up, all you employees of Berkeley Premium Nutraceuticals, all of its so call supporters, and to all of those "buyer beware" advocates that think we are just so stupid we deserve to get ripprd-off, there sure is a hell of a lot of people out there that now know and have proved this is nothing more than a scam. I believe we out number you fellow Berkeley worshipers by more than 4,000 to about

3. For you fellow employees of Berkeley Premium Nutraceuticals; maybe you should be looking for your next boiler room job, because with all the valid, registered complaints against this company and its numerous alias's I hope the Ohio State Attourney General's Office does the right thing and closes this SCAM down! By the way, the Attn. Gen. Office told me that Berkeley Premium Nutraceuticals is very popular around their office, it is almost laughable all the complaints they get on a daily, yes daily, basis. Good luck in your future endeavors, Caveat Emptor (Buyer Beware), these individuals are scum-bags, plain and simple!

Another Smuck Taken In!

Yo Tommy.Excuse me? Say What?

AUTHOR: Russ - (U.S.A.)

POSTED: Saturday, September 18, 2004

Tommy, Set up your own company selling product over the internet and phone ,where you won't need any guts to deal with your customers face to face. Vaugely mention an auto enrollment plan that many potential customers will understand, but a good many will not.Make cancellations and refunds a confusing, difficult, frustrating process for many. Then go by three basic rule of thumb business principals. 1."There is a sucker born every minute." 2."Never underestimate the stupidity of the public in general." 3."The world is full of gullible people ripe to be taken." With the following guidance in hand, you too could rack up alot of sales .Yes,you will anger alot of well meaning, trustworthy people in the process. But others will notice the booming business you are doing. They too, may comment that you "MUST BE DOING SOMETHING RIGHT".For that you can have a warm fuzzy feeling inside ,if nothing else.Love.

Money is not a measuring stick for true success.

AUTHOR: Darren - (U.S.A.)

POSTED: Friday, September 17, 2004

Tommy,

If money were a true measurement of real success then there are a lot of illegal drug dealers and organized crime groups with lots of money that I wouldn't consider a role model.

No one has a problem with a person trying to make a buck. Honestly, we all understand that and we are trying to do that ourselves in life.

What is important is how the money is earned. Is it done honestly? Above board. As a mutually benefical arrangement between the business and the customer?

Automatic enrollment into clubs, or programs when offering samples or sales is not honest. Period.

What is he doing right? Hooking people in until they find out and are able to extracate themsevles from the tangle?

You mention that there are so many negative feedback reports on this site yet he is making money.

Why do you think that there are so many negative feedback reports? It would seem that there are many that are getting caught in his "misunderstanding".

Any company that depends on "misunderstandings" is by definition a rip-off.

Justifying and rationalizing their behavior just makes you, me and eveyone a potential "sucker" not a customer in the future.

Thanks,

Fraudulent Charges

AUTHOR: Laurie - (U.S.A.)

POSTED: Tuesday, September 07, 2004

I wish I had gotten to speak with either Sarah or Kelly because I have spoken to Rob and Aaron and Jim and have been lied to. I was told by Jim last week I would be getting my full refund and this week I got half. What's that?

I have a 8/5 confirmation number and a 8/7 charge. How convenient is that? Don't worry I have reported this scamming company to the AG of Maine and I will report them to the AG of Ohio as well like many others I am sure. I am hoping they will take steps to ban this company from ripping people off in the State of Maine.

Unlike some of these people, I am not going away because I received half. I will be getting my other $35 back. Just so Berkeley Nutraceuticals knows, it's against the law in the state of Maine to charge someones credit card without 15 days notice. This is called a "negative option scam" and is illegal.

That is what Berkeley has going on here with their managed care program, which I did read and cancelled but that doesn't matter apparently because I got charged anyway. I could careless if everyone at this company got laid off and the company got shut down. Just keep on scamming people and that's what will happen eventually. I guess you all will just have to be Walmart Greeters!

Eight Squared or Eight Decieved?(And Counting)

AUTHOR: Russ (Not Really Very Mad) - (U.S.A.)

POSTED: Tuesday, September 07, 2004

Its interesting to see that if you order their Avlimil or Suvaril products among others, the consumer now has to deal with a company called "Eight Squared", located in Raleigh,North Carolina. Johns 3-30-04 Rebuttal at the top of the page mentions the company has frequent name and adress changes to avoid a long history and bad track record.Whats up with this latest move and name change? Don't know if Eight Squared is more reputable than Berkley(Lifekey, etc), but I see the Ripoff Reports on Eight Squared are starting to pile up as well.

To quote The Honest Legitimate Bridge Seller from New Jersey,"Caveat Emptor, buyer beware", if now dealing with this Eight Squared company. To Darren from Neenah. If you want tomatoes that badly,I'll glady sell you some from my garden.I'll send you a free sample for $4.95 shipping after you give me your credit card number. Then you're automatically enrolled so that you recieve a supply of tomatoes every 2 months for $70.You can cancel anytime. My phone number and email might or might not work.Darwinism at its finest.

Capitalistic Darwinism

AUTHOR: Darren - (U.S.A.)

POSTED: Monday, September 06, 2004

Darwinsim for a company is fine. Survival of the fittest provides for better products and lower prices. A company that can compete on these aspects and win are to be admired and encouraged.

Darwinsim for consumers is really sickening. It shouldn't be a matter of eat or be eaten when it is between a company and its customer.

Unfortunately, there are so many people out there taking advantage of customers and believing that they really are the epitome of a virtuous weaning of the gene pool.

Instead of a win-win situation for all involved, they look for a moments inattentiveness, deception and misconceptions to advance.

Thankfully we really don't have a jungle environment... because I have a gun and my neighbor has a tomato growing in his garden that I really, really, REALLY WANT! I see it every day when I am standing there washing my dishes and look out the window.

So large, so red, just hanging there waiting to be picked... I can just imagine the freshness, the juiciness....

Thanks,

POSTED: Saturday, July 31, 2004

I must recind my statement "don't try blame the company for the some what misleading marketing tactic". Blame them..but be aware, that's what I'm saying. And if everything is legal, though misleading, and you get duped, then what can you do? So you already have to know you are need to be aware of these things.

I guess it is a little Darwinism happening. Anyway, most advertising is misleading in some way. I could give 100's of examples. I'm sure you could too. And the purpose of equating the purches of natural enhancements to purchase of realestate was this: Know the whole story. Read the whole sales agreement, contract, lease etc YOURSELF, (the average person leaving it completely up to his attorney is foolish. Better at least make an effort to be informed. I say average b/c if you are runnning big business, then you have enough trust in your attorney that everything is Ok)

For Enzyte, to order the product you are presented with a page that is not jumbled, not confusing, and offers a full explanation of everything right there. It says clearly "With your order, you also receive free automatic enrollment in our Value-Added Program". Though in smaller print. The free 30 day cycle is listed under the "Order and Save with the Berkely Value-Added Program" header. The Non-BVAP is below that. NOT rocket science. No hidden link etc. If you can't figure this out you have other problems.

And no, I don't own a bridge, but I do help build them.

Another Rebuttal For Sarah & Kelly Those Two Nutraceuticals Employees Who Have Sold Their Souls.....

AUTHOR: Patrick - (U.S.A.)

POSTED: Friday, July 30, 2004

I'm going to keep this one short and keep my comment focused on one main topic. That neither of these customer service reps have a clue as to what is really in their product.

I'll quote "Kelly" first here and 'she' says in her 04/08/2004 letter that "Go with what works of course, but our products are ALL natural and that is why it takes time for the product to build up in the system."

I'll also quote Sarah in her 04/04/2004 letter saying "These products are all natural, no synthetic ingredients and are much like a vitamin...."

Now I'll take from the list of the ingrediants for Rovicid from their web site.....

"Other ingredients: Dicalcium phosphate, microcrystalline cellulose, croscarmellose sodium, stearic acid, silica, magnesium stearate, film coat (hypromellose, hydroxpropyl cellulose, polyethylene glycol, titanium dioxide, propylene gycol and FD&C blue #2 lake)."

The inert ingrediants are identical for Enzyte as well.... Pardon me but those are in fact "synthetic ingredients and about as far from "ALL natural" as they can be. She was correct about them being like a "vitamin" because this is what they basically are.

If these customer service reps are this ignorant to mis quote something as disputable as this, I'd be inclinded to take all thier other claims as being extremely dubious (a toned down word for lies girls!).

A little advice here.....I tried this product for 120 days and all I got was heart burn and a little poor in finances but richer in knowledge of how deceptive companies really can be.

To the honest legitimate bridge seller from New Jersey. Its the customers fault as usual

AUTHOR: Very Mad - (U.S.A.)

POSTED: Saturday, May 22, 2004

Good for you that you got a refund and you also accept a fair amount of blame for you ,yourself, getting sucked into the managed care issue to begin with. I had the same situation as you and yes, I do accept the responsibility of not spending enough time wading through the various webpages to eventually learn about an unknown managed care program, wherever the hell it was on their web site back then. However, I personally question your statement when you say,"Dont blame the company for the somewhat misleading marketing tactic".

Who came up with the misleading marketing tactic to begin with? Who approved of it and let it continue to happen?Obviously not the customer. Then who? Are you implying that if you have been suckered by a somewhat little decieving company policy, then totally blame the customer for his momentary lack of common sense , and dont let the company share any part of it?

The company may have purposely instigated a somewhat deceptive website in order to get your business and make as much money off of you as they can, but its still not thier fault at all if you felt you were mislead? One other issue. How did you come in possession of a bridge to sell to begin with. Hopefully someone didnt sucker you into buying it, and now you are trying to unload it yourself? I'm personally not in a buyers mood for a bridge right now myself.Try Ebay.

To M from somwhere ..anyone ever says anything about "FREE" then they should run, not walk away!

AUTHOR: Darren - (U.S.A.)

POSTED: Saturday, May 22, 2004

Sigh,

"M", I guess I do have to agree with you and I am glad that you had a good experience with the company in question. Customers really are stupid because they don't have the time to read each and every bit of fine print for each and every purchase that they make. Shame on them and bravo to all those people that write those things.

That is why I explain to my children that if anyone ever says anything about "FREE" then they should run, not walk away! That is because there is nothing free and it will end up costing you money.

It is interesting to see that you are completely at ease with being responsible for reading all the details and warnings and FAQ's that a website has. Plus the ability to understand it when there appears to be conflicting information or confusing wording.

If there is something that is important for a person to know, don't you think that it would be a nice to to have it in large type in an obvious place in clear words... not buried behind links and within paragraphs of text.

So, you equate buying some natural enhancements with buying a house or a bridge? I am sorry, I don't understand the similarity and I thought I would ask you how that works because I would love to know.

I wasn't aware that due dilligence was all equal. I sort of thought that it would be on a continuim. Say, starting buying a candy bar (not much thought or effort required) to buying some natural supplements (hmmm, will it work and what does all that big text tell me the cost it?) to buying a house (where I use an agent, inspector, appraiser, title search, etc.). So, I should get a lawyer to read the links on a website? Maybe some of them will do it pro bono.

To Sarah and Kelly. I apprecaited your efforts to clarify the situation with past problems and how things have improved today. Unfortunately, as we all know, if you don't provide good customer service then a company is going to get disgruntled customers and that is going to cost them business.

There is a maxim in business that it is cheaper to keep a customer than it is to attract a new one. Knowing this, then it would be better to have an exceptional customer service system in place from the very begining! If not, then the company will have to pay the price in the long run when upset customers voice their opinions.

I had problems with Toshiba over a laptop. They are probably a good company overall (when everything works within their corporate policy) but when something happens outside the norm they dug their heels in and refused to accept that they built a defective laptop. Would you care to guess how many lost sales I have caused them?

As a college student, substitute teacher and a computer knowledgable friend, I have been able to steer away at least 20 people. Yes, for a multi-billion company it is not much, but I feel better that their loss is more than their cost would have been to fix my problem.

Multiply my story by all the people that might have been hurt under the "old" system and I think you can see where you have a really big uphill battle to convince people that they are not going to be ripped off.

From your patience and professionalism I would say that you two are a good candidate for pulling it off... but it won't be easy.

Again, for "M" I am glad that you had a good experience with this company. I want to believe that your's was the rule rather than the exception. However, just because other people's experiences do not match with yours it doesn't mean that they are stupid or wrong about what happened to you. I can't know every experience you have ever had in life... but it would probably put your teeth on edge if I called you a liar each time you said something just because I wasn't there to witness it or beacuse it didn't happen to me.

Thanks

Interested in an honest legitimate customer's feedback?

I fell prey, so to speak, to the free sample/managed care issue. But the bottom line is I did not hold up my end and cancelled late. And then, this is the best part, I REALLY needed the money (I used my debit card), times were tight, and the customer care rep even refunded my money before I sent back the product. To top it off, the product, enzyte, actually worked very well for me.

Bottom line, don't try blame the company for the some what misleading marketing tactic, which admittedly it is. Caveat Emptor, buyer beware. Read carefully and dont be dumb. I hope the people that complain about the marketing scheme never try to buy a house or other asset. If they are in the market, I have a bridge to sell them.

nothing an ex-employee has to say matters

AUTHOR: Kelly - (U.S.A.)

POSTED: Thursday, April 08, 2004

www.96shoes was the website used to cancel Enzyte and Ogoplex before we merged into Berkely. Now it's www.berkely.com So, if you placed your order in December and then tried in January (which was when we merged) to cancel, it very well may not have worked for you. However I do know that in December is when the website changed. That's when they put Managed Care Direct under customer info and it's always been on the order page just above submit. I'm sorry you got a rude person on the line when you called, but I hope despite that you were taken care of to your satisfaction. If not ... call back, let us know you're still not satisfyed.

Like I said before, it does get very busy around 11am, when people begin taking lunches. If you can, call early or as late as possible. I'm on 1st shift, so I don't know how busy it is during the evening, but we usually always have calls waiting when I leave, that's why I suggest trying late at night, I'm sure it slows down.

If you have found another product that works better for you, by all means, enjoy that product. We are the leaders in QUALITY Nutraceuticals, it doesn't mean that for someone another product won't work better. Go with what works of course, but our products are ALL natural and that is why it takes time for the product to build up in the system. As Sarah stated, metabolisms vary from person to person, so for 1 person it may just take a couple weeks for resuls, for others it may take the whole 90 days, and that is when we consider optimal results.

To the ex-employees ... we take overflow sales calls in customer care ... and NEVER am I conspicuous or hidden about the info customers must know ... & I have no problems getting sales. I ALWAYS tell a customer "I am going to read you a disclaimer, if you have any questions or if theres anything you do not understand, please ask ... I go on to read the disclaimer, ask if they understood, and even if they say yes, I still explain it further. Even doing half of what I do with my sales, it's not being hidden or conspicuous, and like I said I have no problems with sales.

And besides, nothing an ex-employee has to say matters because Sarah and I are the ones who can help. A lot has changed since the merger that they have no knowledge of return/refund policy and additional free product to continue trying for results ... so BOTTOM LINE ... unhappy customers call us we can and will help ... and like I said if you're unhappy with the outcome of a call you made to us ... please call back ... you will get a rep you can talk to, relate with, and be satisfied the way you feel you need to be. I only take about 80-120 calls a day because I like to talk to my customers, relate with them. It's business when I'm on a call, but small talk if I can manage to. It releaves the tension and sometimes for someone who is very unhappy, settles them down enough for them to be able to talk to me and tell me enough so that I can adequately help them. Happy cutomers call me too! Let me know how the product is working for you, so I can notate a positive testimonial in your account.

Thanks again, for reading my poinnt of veiw and of course feel free to rebut.

Rebuttal questions for lifey key employees kelly and sarah

AUTHOR: Very - (U.S.A.)

POSTED: Wednesday, April 07, 2004

I for one am highly skeptical that you both are what you say you are. However, giving you both the benefit of the doubt, and that you truly are 2 of Steve Warshaks eager beaver customer care reps, can you adress a couple of issues Ive had with your company since you both state you really care and are there to help. .I suppose Im a dummy who does not know how to read well. I saw nothing in your December web site order page about your unwanted managed care program when I ordered my free sample only, unless it was purposely and deceptively buried elsewhere on the web site in general. Its all my fault for being unattentive and being an ignorant and stupid person in general.

However, can you tell me the real truthful reason why the customer care phone numbers and the website to cancel did not work when i tried them.96shoes my a*s.

My opinion is that it was done on purpose.Am i wrong. You said its easy to get ahold of you 24/7.Also,can your company come up with any truthful , scientific, and documented proof to the public to justify why we, the consumer, need to use enzyte roughly 3 months minimum to see results,as you reccommend,or even go along your 12 month challenge. Correct me if I'm wrong, but I think its nothing but a challege for the consumer to come up with hundreds of hard earned dollars to fork over to lifekey.

Ive had results with only a few pills from other companies at half the price lifekey is charging ,but thats just me personally, and lifekey has the right to charge what ever they want.

Thank you kindly for your time. Im assuming you are not like the rude snotty jerk I had to deal with on the phone after days of trying to get ahold of your company.

I've got your back, J. ..exact wrong attitude to take when dealing with customers

AUTHOR: Jason - (U.S.A.)

POSTED: Tuesday, April 06, 2004

A common theme that I've noticed among current employees posting rebuttals is that the consumer is stupid and "should have read" or "should have listened carefully." This is the exact wrong attitude to take when dealing with customers. Everything that is presented to the customer when making a sale should be CLEAR and CONSPICUOUS. There's really no other way to do business. There should be nothing at all that is unclear to a customer when you want them to purchase your product--they shouldn't have to be explained everything later, when everything's soured.

Current Berkeley custcare employees--what is the phrase you hear over and over again, every day? Don't answer--I'll do it for you. "I didn't know." That's the one. I used to work there; I used to do what you did. I was on the phone at the exact moment I had to be, and I left at the exact moment I could. The money may be good, but is it worth 1.) Getting berated all day and 2.) Knowing that the company you work for is preying on the public?

I'm not going to bother with making any conclusions for you, nor am I going to bother with arguing with anyone specifically--it really does no good. I'm just glad to be out of there...

Rock.

Oh--also, look at the FTC opinions on products of this type. It's interesting.

#2 UPDATE Employee

Employee of Berkeley, this company is not a scam

AUTHOR: Sarah - (U.S.A.)

POSTED: Sunday, April 04, 2004

I am currently a customer service representative for Berkeley. I am estimating that I take around 150-200 customer calls daily. Half are customers calling in to cancel their Managed Care Direct memebership knowing that it will be sent if they do not or to change the next shipment date, etc. The other half are customers calling after they have received their continuity shipment and they say they were unaware of the Managed Care Direct plan and want a refund. Other calls include testimonials/questions, etc.

I would just like to let people know that this company is not a scam and we do offer quality products. We have thousands of repeat and satisfied customers. All the information about Managed Care is clearly stated in writing in a pamphlet that comes with your shipment and on the side of the bottle or package you receive. Also, if you place your order online it is stated more than once and is even listed under important customer information for your convenience.

For our products we do offer a free supply to absorb some of the costs of the program and to get you started free! Most of our products we do recommend you try for a full 90 days to see the maximum results so the trial is just to get you started. I'm sure if you ordered the trial you ordered because you are interested and want to see full effects of the product so why would you only want the free supply? These products are all natural, no synthetic ingredients and are much like a vitamin meaning they do need to be taken daily in order to see results and to maintain those results, they do not work right away for everyone since they work differently according to your metabolisim.

There are non managed care packages also available where you can order on your own and not be enrolled in the auto ship program. But in order for the trial you do have to enroll but there is no obligation at all to remain on that membership! You can cancel 24 hrs after you order if you wanted.

We are here to help as the above cust care rep stated and if you really did want to see results(why else would you try it) we can definitly work with you to keep you happy and to reach those results.

I really hope that people are reading the packages and sides of the bottles that they are just popping those pills in their mouth from! That is just common sense.
Thank You

Employee Response

AUTHOR: Kelly - (U.S.A.)

POSTED: Friday, April 02, 2004

ok... I have no idea how long ago you were manager with the company ... sounds to me like a long time ago b/c all of your info is either incorrect or outdated. I am a current employee of the company and have been around through alot of the changes.

Of course the sales dept cannot help with existing customers, every company has a customer service dept!

Anyhow, I'm not even sure where to begin ... if you are a website customer, I urge you to visit the website again ... info on Managed Care Direct is located under the customer info link (just above the order link) and when you get to the actual order page you have a CHOICE b/c Managed Care OR Non-Managed Care packages. True the free sample does put you automatically on Managed Care Direct, but it is CLEARLY stated.

Enzyte and Ogoplex; the info regarding how to cancel is on the side of the bottle ... honestly we do tend to get busy around lunch time b/c we have people out for lunch so there are not as many reps on the phones.

All other products the info is in the literature that comes with the product.

True, we don't work in Trump tower! Although that would be nice. I'm not complaining about the work condidtions, I can complain about some of the teamleads, others are GREAT ... but that's the politics that come with any job.

Honestly for the customers, if you feel you have been scammed ... call us ... WE CAN HELP! That's what we are there 24/7 for. But ask yourself why you decided to try the product in the first place ... if you feel it's something that can help improve your life, give it time to build up in your system for results ... especially Avlimil ... I hear great things about this product daily from the customers!

There are new procedures in place regarding refunds/ return product and additional free prod to continue trying for results. Call us, we will help you. Some reps are better than others ... that's with any customer service place you call also! Keep trying until you get someone you can talk to and someone who can help you the way you feel you need helped.

Thanks for reading my point of view, & I read this forum often b/c I am conerned about customers satisfaction, I am an emplyee who genuinely does care, both about the company and the customers, so feel free to rebut.
