I paid $3,180.00 for 157 pair of shoes and sneakers combination from Etan Raz and Melissa both discussed our order and confirmed that we would be purchasing NEW items..  The items where new shoes and sneakers from Macy's overstock they are current stock that have not sold during the current season to which they purchase and resell.


The shipment arrived on Monday, June 24, 2013. 103 pairs of damages, used, worn shoes with no sneakers and short we paid for 157 pairs of new shoes and sneakers. 

My daughter immediately called and spoke with Melissa who stated that we probably received the wrong shipment and will correct it by noon today, June 24, 2013. 

My daughter informed her that she will pack them in the car and bring them to their office for a full refund she said that they don't usually do refunds, and the manager is not in the office today. 

She did not return my daughters call at noon she called again at about 3:18pm and spoke with  Camiella whom stated Melissa "was very busy attending to an oversea purchase".   My daughter left a detailed message for Etan (Tony) with Camiella. My daughter received an email from Meilissa detailing why we will not get a refund but offered credit for future orders.

EXPLAINED TO THE UTMOST EXTENT

Mrs. Mason and her daughter Ms. Kidd visited our office on Monday June 10, 2013. We discussed Mrs. Mason's store in Granada and the particular items she is looking for, which is men shoes. She was very clear that she wanted recognizable name brand shoes. Taking into consideration her particular request she was offered men shoes from Macy's Department Stores. It was explained to Mrs. Mason and Ms. Kidd why, where and how these major department stores liquidate their merchandise, why sometimes we have to repack it here in our warehouse due to the damaged boxes and poor packing from their distribution center. I explained that the reason for the pricing in the loads is due to the brands and assortment in them. I told Mrs. Mason that she would be purchasing the customer returns/shelf pulls from this stock. I further explain that typically the shelfpulls/customer returns are in good condition may show signs of handling, have sale or clearance stickers on them or be defaced, worn or with labels/inner tags removed to prevent return to store; they may be some in an open box or out of the box.

It was explained that they had to have some flexibility with the loads due to the fact that they are were going to purchase designer brands that have a retail value from $80.00 to $130.00 and they were going to pay $20.00 per pair. Mrs. Mason agreed that day and gave me a deposit of $200.00 cash. Then she and her daughter Angela came back on Wednesday June 12, 2013 to pay the balance for the invoice.

RS Trading does not provide shipping services, we simply referred a reputable freight vendor to advance Mrs. Mason's search. Ms. Kidd claims that the shipment was delayed due our internal problems, but it was not. The shipping took an additional day as we assisted Mrs. Mason with a different freight company to save her shipping charges. I discussed it with Ms. Kidd and Mrs. Mason; they agreed and were very grateful as they saved 50% of freight charges. It took an additional day to reschedule the pick up. Ms. Kidd contacted me when she received the merchandise since Mrs. Mason was already in her country. I indicated to Ms. Kidd that maybe Macy's made a mistake and sent the wrong pallet due to the description she gave me and stated "All of the shoes are torn". There was no mistake in the pallet; they shipped the one we ordered. I wasn't able to call Ms. Kidd back at the exact time she wanted, but I made sure to email her that same day and follow up in the status of her order.

Under normal circumstances we would ship any back order directly to the customer. Mrs. Mason's order had a back-order of 32 pairs that was held due that Ms. Kidd is unsatisfied with the merchandise received, so we will keep the rest of the merchandise and give her a check for the pairs that she didn't receive.

Further, Mrs. Mason signed our Condition of Sale agreement where it clearly states:

CONDITIONS OF MERCHANDISE/WARRANTIES

All merchandise is Salvage/Store returns merchandise and sold AS IS with no warranties of any kind or guarantees of any kind expressed or implied, including merchant ability. All merchandise is sold in AS IS condition, with no refunds, returns, credits, or exchanges offered or given. Loads may be sold as bulk loads (no wholesale value, percentage, or piece count given). The approximate value is merely a number that has been provided to AAA Closeouts Network by its providers as an estimate only of wholesale or retail value at the time of the purchase and AAA Closeouts Network in no way represents or guarantees that this is the true value of the products. The above listed department stores and AAA Closeouts Network will not be held liable for any dissatisfaction in regards to the sale or quality of merchandise.

METHOD OF FREIGHT TRANSPORTATION

Purchaser will be held responsible for transportation costs from the distribution center(s) and/or warehouse(s). All claims and/or shortages must be submitted directly to freight carrier of Purchaser's choice. By signing the agreement, Mrs. Mason declared that she unarguably consented to the terms and conditions.

I'm very sorry that they are disappointed with the load, but everything was explained to the utmost extent before making the purchase and they were both aware of the merchandise Mrs. Mason was purchasing so there were no surprises.

Keeping within our ethical & good faith business mentality, we would like to offer Mrs. Mason a ten percent discount towards her next order.
