I purchased nine replacement windows for my home for $6000, and gave American Design and Build 1/3rd down. ($2000) The balance was due upon completion. Due to an illness in my family, I couldn't come up with a suitable time to have the windows installed. The company was ureasonable, and began harrassing me at my work. The company obtained a judgement against me for the balance of $4000, plus attorney fees, court costs, and interest.
During this time, I lost my home due to a foreclosure, and tried to settle with the company. I had already paid them over $4000, but they said they had a judgement, and were going to get every penny. On May 18th of 2004, I finally completed my payments. (over $7000). I called the president of the company, Joseph Tunney, and he said that I am not due any services or refunds. The Better Business Bureau wouldn't accept my complaint because the courts had been involved. Joseph Tunney told them that he had donated my windows to charity, and that I was due nothing.

Obtained a judgement???

First off, I do not understand if you financial situation was such that you couldn't make your monthly housing payment, why on earth commit to new windows. Obviously, you were putting the cart before the horse. Secondly, they did not just obtain a judgement. You were served with papers affording you the opportunity to appear in court to state your case. Either you chose not to appear, in which case a default judgement was issued. Or, you appeared and the judge realized that your story was that you simply put them off because you couldn't afford the windows and a judgement issued. I know nothing of this company, but they were granted a judgement by the court so in all appearances they had a valid complaint, and you did not.
