We contracted with this person to make several garments. The first garment arrived. Later when I went to wear it for the first time I noticed the collar was sewn on upside down. We attempted to call the woman and explain to her the mistake. At no time were we abusive or critical of her. We assumed it was an oversight, and wanted her to repair it at a later date, and at her convenience.

On the phone, the woman at first immediately denied that the collar was attached incorrectly. Failing that, she launched into a screaming tirade, becoming abusive, and attacking me personally. My husband was on the extension and heard every word of the conversation. He managed to record it all on the answering machine tape. She refused to listen to anything we had to say, kept flinging accusations that were utter fabrications, and then refused to listen to us and hung up. Prior to this, we had a written contract with her to make a garment by a certain date, for an important event. She committed to this, and accepted money from us. After the phone call, we received an email from her stating she would not make the agreed upon garment, and would return our money, our fabric, and several other of our possessions that we had provided to her specifically to use in the making of said garment. She also said "do not reply to my email". My husband did indeed reply, reiterating that she had now broken a legal contract, and was extremely immature and unprofessional as well as unethical. It was now barely 2 months before our event, and we had no garment being made. In the email he formally requested the immediate return of our money and belongings so that we could try to find a reputable seamstress who might be able to make our needed garment in time. We also sent a letter, by certified mail stating all of this. We have NOT received  our money or our belongings back. We had an appointment set with a reliable seamstress and had to miss the meeting because this woman has not returned our fabric, money, etc. In addition to all of this, we received another garment that she had made for us TWO WEEKS AFTER it was originally promised, and only days before it was needed. The buttons came apart when I tried to try the garment on. Although we understand that she did not deliberately use faulty buttons, because she sent the garment so late we were forced to drive over 2 hours, buy buttons, cover them ourselves, and sew them all on in order to have our garment for the needed event. All of this could have been avoided if she had sent it in the middle of August as she said she would on July 30. Her recent actions are so grossly unprofessional and unethical. If someone had contracted with her to make a wedding dress and she had done this to them, they would be in a real mess, with no one to craft a gown in short order. Our event is as important to us, and she has done the same thing. We have her emails committing to the 18thc. jacket project, proof of monies we sent her, her email breaking the contract, before and after photos of the collar we had to have put on correctly at our expense by someone else, a tape of her hysterical and abusive phone 'conversation', photos of the jacket with faulty buttons, and proof of the the day it was delivered. We also have someone who heard the conversation on July 30th when she said we would have the first jacket by the 'middle of August'. All of this is now being sent to our attorney, and she will have to deal with him, if we do not receive our money and ALL or our belongings  back in perfect condition in a few days, when our new appointment with the new seamstress is scheduled.

From American Duchess Apparel

AUTHOR: American Duchess - (United States of America)

POSTED: Friday, September 10, 2010

I would like for everyone who reads this to note:

1. All of this person's items - wool cloth, embroidered stomacher, $150 deposit, linen collar - have been returned to this person, and were mailed 9/7/2010 at 12:47 pm, leaving Sparks, NV, and traveling to New Hampshire.  I have the receipt proving that these items were mailed.  This report was filed 3 days after the items were shipped parcel post.  There was no intention or personal reason for delay.  I ended business with this client 9/1/2010.  Monday, 9/6/2010, was a national holiday.

2. Many of the statements in this report are blatantly untrue.  This client chooses to use my full name, which makes this report slanderous in the eyes of the law.

3. The conversation between myself and this client was listened to and recorded by a third party without my knowledge, a violation of Federal Law.

4. I offered on several occasions to repair and correct the work that the client made complaint against, but the client refused.  The client accepted, paid for, and was in possession of the garment from July 4, 2010 until August 31st, 2010 before she made the complaint.

5. At no time did I sign a contract, nor did the client sign a contract outlining work to be done and fees to be paid.  There was and is no signed contract.  I completed work on two garments, which the client accepted and paid for, and refused work on the third.  The materials for the third garment were in no way altered and the full deposit ($150) has been returned to the client.

On a personal note, I would like to make these points again: the items have been returned, I have been slandered in this report, I was abused in e-mails, my private conversations were listened to and recorded, and these people have attempted to force me to continue working with them against my will.  I admit and own that I did not handle the situation to the best of my abilities.  After working with this client for months, and having to spend as much time calming her down and handling her emotional fits as on sewing her garments, I felt it necessary to defend myself and my work.  The client refused my three offers to repair and correct the garment, at which point I can do nothing more, and the conversation then only exists as a vehicle for her to berate me.  I was not able to speak in full sentences as I was being talked over, yelled at, and prohibited from explaining things properly.  I am appalled that this person has chosen to slander me.  I have stolen nothing, but merely refused to continue working with her, and will not be coerced by her or her partner henceforth.
