My ex and I leased a Honda Civic with American Honda Finance (AHF) in 1997. When we divorced in August of 1998, sole responsibility of the car (and its payments) were turned over to him and I forwarded a copy of the filed papers to American Honda Finance. I never heard from my ex or Honda Finance for another two years.

In August of 2000 I am turned down for a car loan and find out that my ex defaulted on the car loan in August of 1999, the car was reposessed, and the incident was recorded on MY credit report. I sent papers again to the last known address I had for AHF and received no response.

In Spring of 2001, lawyers representing AHF contacted me in an attempt to find my ex. AHF was suing him for breach of contact and any unpaid monies. I was informed that I was not in danger of being sued, and when I attempted to find out more about why MY credit was involved, I was told the lease "trumped" the divorce and was transferred to several different people who wouldn't give me a straight answer.

So my credit is crap and I was never given the opportunity to reconcile the issue. If the blemish is going on my credit, shouldn't AHF have given me an opportunity to prevent it? They can't say they were unable to find me. I have not listed an address or phone number for AHF because I can't find one! If any one can give me any advice or help I would GREATLY appreciate it!

The finance contract supercedes that of the divorce decree. Any finance company would try to find anyway they could to get ahold of you, but if you moved and didn't give them updated info, they would not be able to.

My advice to you is to place a consumer statement on your credit report stating the situation because you have no legal course of action.
