I am not a blogger. I read comments of others, sometimes entertained, sometimes shocked but usually helpful. So I am hoping my first attempt at this helps too.

To say Ive been burned is an understatement. However, I have. I have tons of debt based on the word of an ex business partner who decided to exert his position and leave with all the financial benefit of years of hard work. Unfortunately, I also lost years of my life. Okay, lesson learned the hard way.

Fast forward to today. I am in debt. I lost my home. And now, I am dealing with the collection agencies and finally a civil suit. So I get this letter from the American Mediation.us, which sounded quite helpful. A representative by the name of Alex Dukhovny offered to help settle my debt by negotiating with EMCC (I have no idea who EMCC is, except a collection agency). I thought to myself, great, Ive been sticking my head in the sand long enough, now its time to muster the strength to help myself. I decided to call this company and ask for help, and hope that it can.

My first impression of Alex, he sounded young. Im 47 so I thought, oh God, this is a call center operation. He talked over me, so it was obvious he talks to a lot of people. Therefore, I just listened. This is what I heard, in a matter of 10 days and $495.00 later he could settle my debt, (he did not have an estimated number of what that was), in which the company EMCC would drop the civil case and I would be done. When I said, You have to give me more than that, he immediately got defensive. He responded, I dont have to give you anything. So, I explained (all the while he is still talking) I have dealt with an unscrupulous attorney who I paid over $10,000 for a civil suit, and it was a waste of time and money. Therefore, I mean to say, how much experience have you had settling cases with Curtis Barnes and EMCC? Did they settle for 50% or more? Do I have to show up in court? Etcetera. He explained curtly he was not going to give me proprietary information on how they do it, just that they can. So I was curious, because their letterhead looks so court approved official it begs the question, Are you a for profit operation? He responded, Of course. At this point I had heard enough. I thanked him for the information, and told him I would have to think about it. Then he delivered the final blow. Dont wait too long, he said warning, time is of the essence, you dont want to show up in court and lose. Oh Jesus. What a piece of work. Then, he asked me to call him back and let him know as soon as possible. Right. Call him back. Sure.

Just to wrap it up, I have an attorney, who practices law, who is going to help me now with all my debt. An honest man, who charges an extremely fair price, who is mature, wise and compassionate. I guess along with the bad sometimes comes the good. Thank God.

To date, I decided not to return the call. Ever.

Done business with Alex

I have done business with Alex both as a business providing services to him, and as a individual.  First, as a business, Alex in Los Angeles is a very honest business man.  He is quick to respond to phone calls, and he pays his bills.  Unlike the main office he is associated with, Alex is great to work with.

After doing business with him for a year, I spoke to Alex about working with me on one of my debts.  Alex worked his butt off helping me, and was able to work out a deal with a debtor that had been previously impossible for me to work with.  I would highly recommend Alex and American Mediation of Los Angeles to anyone looking for an alternative.  The reason time is important is because once a creditor has a judgment against you (The court hearing) any chance of working something out with the creditor goes out the door.  Once they have that judgment, they can garnish your wages.  At the same time, if a creditor can work out a deal BEFORE going to court, they take that route.  Why?  Because they don't have to pay a local attorney to visit the courthouse.

My Experience with Alex

As an Independant court researcher I have had many dealings with Alex Dukhovny over the past 4 years.  I was totally shocked to read this article. 

My first thought was , do they have the right American Mediation office here?  I would have expected this type of complaint on the Home Office in Florida as they have ripped me off for several thousand dollars and have made no attempts to satisfy it. 

Alex Dukhovny has always been upfront , honest and very helpful to me. I have never felt that Alex has talked above me, There is a rule of thumb that applys to everyone..if you don't understand what someone is saying to you ....you simply ask..can you please explain it in simple layman terms so I understand better. Plain and simple. I have to agree where the article said...The man did not give the program a chance to work for him.

As an Independant Contractor I have worked with many different Law Firms, Mediation Companies and Private Companies across the nation over the years helping settle debts. They all charge about the same fee and do basically the same thing, they are all For Profit Companies.  The only difference between a Law Firms and a Mediator is: The Mediators work one on one with you as where 99% of all attorney's juggle multiple case loads so many times you have to wait longer for results.  Time is of the most essence because after a case has been filed in the court the clock is ticking away so you have to move quickly before your court date which could be just a few days away

Unprecedented accusations.

This is the first time my company has been included in Rip-Off Report or any other website or organization dedicated to consumer advocacy. However, I am sure it is not the last. 


Unfortunately, it is impossible to satisfy every individual who comes to us for assistance. What is interesting is that this particular individual did not give the process a chance at all, but after the interview decided to bluntly bash my organization. Even though I do not quite understand why, I respect the right of every consumer to express their opinion.

In response, I will say the following:
Mediation is a process of Alternative Dispute Resolution in which a third party to the conflict is invoked by either side, in this case the defense, in order to reach an amicable resolution. It is a negotiation process and no one, but no one, can tell you how a negotiation will end. From experience we always give the consumers a rule of thumb as to how similar cases have settled. We do not give out success percentage because these number are useless since everything is done on a case by case bases. In interest of satisfying the popular believe, I will say though, that almost every case we take on we are able to find a formula which works for both sides. It is extremely rare that we cannot settle a case. In addition, I, personally always advice every client interested in our service to do their do diligence about the company and my self so that they may feel confident in their choice. 

The fee which we charge depends on the case, difficulty of the client and estimate of time it would take to resolve the case. It is a flat fee. So that if we go over our estimate you do not pay a cent more. We give you a guarantee of our service, by charging you on a 50/50 bases. If we are not successful, you do not pay the second portion. However, many times, if we are not stressful we refund the first portion as well.

This is a consumer who blindly spoke ill of a process she/he did not know anything about nor gave it a chance. With over 3,000 of successful resolutions and growing this hardly qualifies as a bad mark on our reputation. If you do not believe it. Give it a try your self.
