I had hired this company to help me during the process of a loan modification for both of mi houses that at this moment are facing foreclosure for over 2 years. They have charged me $2.147.50 dollars for each house and we signed a contract were they guaranty the reimbursement of the deposit if they were not able to get a satisfactory loan modification. One of the Banks is Flag Start; this bank sent me several letters complaining that the documents were incomplete and recently we have received a letter to inform us that the file has been closed due to incomplete documentation. Every time they request for document we were fast faxing or going directly to their office with them but they were not doing their job. And to make it worst they have asked me to move money from one account to other to show enough money to pay the house, and they were doing the loss and profit reports in their office to have everything match perfectly their way so the modification will have more chances to be approved. The second Bank is AHMSI (American Home Mortgage Servicing Inc); with this bank was different history but not better. After 8 months this bank sent me a proposal that was a complete fraud and the President of American Recovery Mortgage, Mark Pascua, called me and pushed me to sing the contract telling me that it was a favor from one of their contacts at AHMSI and that I had only 2 days to sign the contract. When I called him whit all my questions he was extremely rude and treats me with losing the opportunity to save my house and with loosing the only opportunity to have a deal with the bank. At this point I started calling both banks and I had contact a financial advisor from Wachovia Securities that showed me the real picture of this deal. So I hire a lawyer to stop the foreclosure in my houses and to start the loan modification process again.
Reading the contract we signed with this company, I found a part were they mention that by law they were not able to collect any money at front and that the only way to charge a client was until the services were completed. This is something totally different to what they did to us. Also they were forging the statements and forcing the loss and profit reports to get us approved for a loan modification but when we started asking to many questions the problems began. I sent a letter to this company and an email requesting the return of my money but they are not answering my emails or either has sent the money at this moment. I have my mother and my Sister in the same situation with this company and I do not know how many more are like us.
My last hope was to contact the BBB to file a complaint but after 30 dais they closed the case due to no response (Inform Consumer - Case Closed UNANSWERED). At this point I feel like there is not justice for honest people like me, that are only trying to do the right thing but with the wrong people and there is nobody to stop them. Please, if you can help me and my family to recover our money and to teach this people a lesson please send me and email. my family and I will really apreciate your help.
