In '07, we took out a loan to replace the windows on our newly purchased home.    We borrowed $12,631.89. To date, we have paid $13,021.28. We recently filed bankruptcy, and these folks forced me to reaffirm the original loan, claiming we still owe $9588.77.   They used the threat of foreclosing on our home as a stick----these people have no carrots.

The original loan was signed under extreme pressure from the window salesman, and a LOT was not disclosed until it was to late; that we had just taken out a second mortgage on our home, that the payoff would be more that twice the original amount and that the loan started out 2 months in arrears.

The reaffirmation I was forced to sign under threat of losing my home puts us several more months behind.

This company has always been threatening, and they often lie over the phone.     Their loans are the very definition of predatory, but they get their panties in a bunch if you dare say those words in conversation.

I filed a complaint with the CFPB, and said that Amerifirst should have to disclose that these loans are predatory and that they will use the threat of taking your home fairly quickly in the process

Where was your bankruptcy attorney?

AUTHOR: FloridaNative - (USA)

POSTED: Thursday, October 22, 2015

Bankruptcy is meant to give you a fresh start. Reaffirming your 2nd mortgage was not the right thing to do, based on your post so far. I understand that the lender was intimidating, but your attorney was the one that is supposed to keep the creditor from discussing collection of this debt from you once you filed.

Where was the attorney in this bankruptcy?  It is highly unusual to reaffirm second mortgages. Consider going back to your bankruptcy attorney to see what he can do to help you. If the Bk case is too old and he suggests filing another one, find another bankruptcy attorney to help you. Someone that is a much better attorney. If you filed your own case, then find an attorney to help you.

Please get your the contract for this and write back some information, such as the amount you borrowed and the APR.  Most importantly, can you check the signature page and see if your signature is on the appropriate line, which indicates you agreed to these terms.
