I noticed two days ago my account balance was over $500. Yesterday I checked my balance there were $74 dollars in overdraft fees, and I had a balance of about $360. I was confused, and called ameriserv customer service to ask how in the world could I be charged overdraft fees...and still have a positive balance? They explained that even though I had deposited money on friday, and the money was credited on monday, they went back and rearranged the transactions over the weekend from highest to lowest leaving me with a negative balance BEFORE crediting my deposit...all on the same day!
On March 22nd 2009 USA Today reported that:
Bank of America (BAC) recently agreed to pay $35 million to settle a class-action lawsuit related to overdraft fees. The lawsuit alleged that BofA authorized transactions that led to overdraft fees and posted transactions in an order that increased such fees.
The National Consumer Law Center has also sued Washington Mutual now part of Chase (JPM) for its overdraft policies.
The Federal Reserve was accepting comments about overdraft policies until March 30. Consumers e-mailed them to regs.comments@federalreserve.gov referencing Docket R-1343
This information lets us know that we aren't alone in our dissatisfaction!
I am filing an online compliant to the better business bureau on bbb.org, Ameriserv is not a BBB Accredited Business and they already have a compliant on file (no surpirse there). Let's complain together, either Ameriserv will respond with fairer practices Or more customers will continue to complain leading to a class action suit.

To the person who filed the original complaint - ameriserv has done similar things, including taking overdraft fees on a balance 2 days prior to when they actually deducted the debit card use. A class-action lawsuit is just what they need.
To the other rebuttals - you can't use a debit card when there is no money in the account, so how can ameriserv charge an overdraft fee to a positive balance. Since you obviously don't know what you are talking about - stay out of it.

I am happy to report the day I closed my ameriserv account there were five people standing in line waiting to do the same. My Navy account has never been overdrawn and neither has my ING. Online check register should be just as accurate as a regular one. Period. If your going to offer online register as a bank, then the information should be accurate. It's the law.

'If you're trusting a bank to manage your money, they should be liable to report to you the exact amount of money in your account'
The bank does not MANAGE your money, you are supposed to.
The bank is merely a safe place to keep your money.
It is on YOU to be responsible, and keep track of YOUR OWN balance.
If you cannot grasp the concept of keeping a check register, hire an accountant.
If you cannot afford an accountant, then take your money out of the bank,
and 'manage' your money yourself. That way, you will never spend more money than you have.
As one poster put it, "A mattress doesn't have overdraft fees, then again, you can't overdraft a mattress."

I don't rush anywhere on Friday afternoon, I am at work just like every other hard working American. I wired the money from my credit union to my Ameriserv account like I do every pay day. My account was at a positive balance, and it remained at a positive balance on Saturday through Wednesday. On Thursday over draft fees were posted, and I still have a positive balance. To avoid this type of rip off from Ameriserv Bank in the future, try an ING account or an account with NFCU where the online register is updated electronically giving true and correct account balances up to the minute.

You rushed money to the bank on Friday afternoon when you realized you were overdrawn,
when you got the deposit slip, you looked at it, and everything looked okay.
Monday came along, and the overdraft fees were posted to the account.
The transactions that caused you to overdraft were already posted / rearranged on Friday.
You got the fees tacked on after the weekend.
That's how you got charged overdraft fees with a positive balance.
You deposited money after the Friday cutoff.
The re-arrangement of transactions should not be a surprise to you!!
you did read and sign a deposit account agreement when you opened the account,
didn't you??
Anyways, the way to prevent this, is to use a check register.
Hopefully you learned your lesson, and will use one from now on!
