On April 13th 2009 we received a letter from this law firm stating we owe $2,368.26 from an original company called WIC Home Improvement which is represented by CACH, LLC. We called them to try and find out how this debt occurred and who it was originally from. The lady that answered the phone was rude (by the way after my husband had called back 5 times and said he didn't want to talk with her again. The manager said this lady did everything by prodigal and that she has been with this company for 26 years) and would not let my husband talk. They have his name on an account from some home improvement company (back east). My husband tried to explain we do not have credit cards and that he hasn't had on since 1975. Also he gave up his business in Aug 2006. This charge concurred Dec 2006.

My husband kept trying to tell her that any home improvements we have done on our home has been a cash only business as we go along with his business as the money comes in. She would not listen after he said the bill isn't his. They have the wrong account number with his name on it. I have an account with GE Money (another name they said). I have an account with GE Money, but it is for Care Credit for dental. It has my name on it the account number is different and it is $1,400 dollars less.

My husband then asked this "spokes person lady" that has been there for 26 years for a copy of the original contract so he could compare his signature. The next day she calls my husband and ask if we got what she sent. You understand my husband talked with the lady only 15 hours before that. She said "well I guess I will just write this down as agreeing not to pay" and then hung up on my husband. It is now the 20th and still no verification of signature or copy of original contract.
My husband is being harassed daily and on weekends. 1-3 calls a day.

I looked up this WIC Home Improvement company that is back east and they are in bankruptcy. We have never heard of them and we would never do business back east even if we did use a home improvement store. We would go locally. But like I said, we use cash.

It is now June 16, 2009 and we still have not received verification about who the original contract belongs to. My husband is still being harassed with letters saying that we are ignoring every attempt to collect on this debt and that we are refusing to pay it voluntarily. We do not even know if it is our debt.

Vicky,
If these folks are calling you about 1-3 times a day I consider that harassment. I would ask the phone company about putting a block on thier #s so they can no longer call you

SOL On Credit Card Debt

The SOL or Statue of Limitations on credit card debt is 6 years. The company must be the actual company and not a 'collection agency'. If it is a collection agency you need to immediately type a letter to this agency (remember type, do NOT hand sign) asking them to produce the origianal contract with your signature or refrain from any further contact by mail or phone.

If the person suing you is someone other than the original credit card company, you should also include this line in your reply: The plaintiff does not have standing to bring this action.

They don't care - PERIOD! It does not matter this is not your debt, they don't care about illness, deaths. job losses etc..

If you want the collection to stop - GET OFF THE d**n PHONE!! NEVER EVER CALL A COLLECTION AGENCY - THEY ONLY LIE TO YOU.
