I'm a very broke 60yo unemployed manufacturing systems analyst and not being able to find a job now I decided to write a book to help youngsters into business successfully and hopefully to earn me a living helping others.
Through some error of the internet I received an email from Witherspoon in early October 2008, saying he was retiring from Internet marketing to focus on a writing career. I responded thinking he could proof read my very first book but what came back was a sob story of how he had all these web-building skills as well and they were to be wasted.
Ultimately, on 14th October we agreed he would build and establish a website for my book and use his expertise to take it to the market for me...for $300...."because I liked to help people."
He built a site of sorts, often without any recourse to me and set up all the blogs, social stuff and lodged my url etc. He took full control of everything and me now being internet savvy thought this was okay for a while. However, the site was bad and he changed it entirely about 6 times. It gained a maximum of 4 visitors per day for 3 months until in January I paiid an outside company to promote the site for me using the keywords he dictated.
During our relationship he advised a bit late that he was an alcoholic, had been in prison twice and rejected for jury duty when he told the judge he sided with the criminals as the courts stank.
Anyway, within a couple of weeks I was getting around 350 visitors per day but a massive bounce rate. Witherspoon said he didn't know why this was. I had a free e-book on site and yet after 9000 visitors not one freebie had been taken.
Obviously I asked what could be the reason but got nothing back except "I don't know".
As by then he had sucked me out for almost $800 for a variety of things that I didn't understand and he had convinced me to pay to set up a further 12 sites to feed the main site, (which I always paid immediately) I felt I had the right to ask him to find out why there were no takers or opt-ins at all and to correct things.
I heard nothing for the next 24 hours but I was trying to find the cause myself...and I actually did. He had fouled up about 10 links on site and all the autoresponder meassage links...everything pointed in loops to the wrong areas so visitors actually couldn't progress through the site even if they opted in...I would never know about these either as nothing told me. The first opt-in email sent any signer back to the sign in box!!
Once I found out I got immediately onto the IM and 'spoke' with him about the discovery. Instead of gratitude he was fierce and abrupt as he had been before when he had been drinking. I stayed calm and friendly anyway as I needed him to sort this huge issue out, but after about four messages his wife came on the IM and said he was busy on another pc. I assumed he was fixing things at last.
The next day, 16th Feb 2009 I received an email from him (I have it still) that simply said he had taken the trouble to erase my 13 websites from 'his hosting account' (that I had prepaid for) and deleted everything including all my backup copies.
That was it. I now had nothing except some three month old test files on my pc.
Since then I tried to persuade him to start putting the main site back together so I had some hope but despite agreeing he fooled me about with excuses for ten days such that I have had to hire another technician to actually restart the entire site again.
He blatantly offers no refund and says to sue him as he has nothing and will be a bankrupt instead. He has gone into several of my accounts...adsense, google stats etc and cancelled services I paid for.
Basically he is an angry spiteful drunk, convicted criminal and a confidence trickster. He brags about being a writer but has even had me edit some of his terrible work.
Worst of all he has apparently been very heavily involved with social networks and carries a huge amount of site space on such as facebook, squidoo, mybook etc. I need to warn other that this man will take your money and provide trash or nothing. If you complain he will bleat about bankruptcy to keep you off his back.
My new tech found that Witherspoon had set himself up with a CD of my book where the proceeds didn't come to me...and any funds from my adsense accounts don't appear to come to me either. (Adsense advise I don't have an account, despite dozens of ads Witherspoon had placed on my sites!!)
He is now sending me moronic emails about how he enjoys 'sparring' with me about not paying me.
Please take the time to Google Andrew Lee Witherspoon and if you know how to use social things like Twitter, Facebook etc, write up a pointer comment to this article and tell the system what this man is. He is very dangerous. He has advised he would like to set up and promote book-writing and website building for the oldies through target email marketing. Very dangerous and very nasty.
Oh yes and finally. He actually tells people he is an ordained minister too, no doubt to suck them in easier. I have that in writing as well.

It was quite expected that Witherspoon would attempt to portray a picture of honesty and diligent application to the subjects that he is accused of.
I note he did not rebut the criminal history or the alcoholic statement, but instead attempted to slant the accusations to be less accurate.
Sadly, the facts stand up. He entered a contract where everything was agreed beforehand. He failed many times (possibly the 6 that he mentions) to adhere to the value or topic of the product, such that any expert guidance to me (the victim) with nil experience with the internet, became of no value. What I DO understand is marketing and to have Witherspoon place OTO's all over a solid decent business book was idiotic, not requested, not authorised and had to be removed.
He did not refute using my site to promote a CD of MY PRODUCT in competition to my product...without my knowledge. He does not explain why he refused me access to the responder system...which simply raises the question regarding who was getting value from what I paid to purchase but he has never supplied.
He fails to refute that I paid every single invoice ever sent to me, despite they often being for reworking his own errors. He fails to mention regarding his 'offer' to refund that my 'rejection' email also said that I saw no reason for his dumping of my sites should financially impact his 6 kids and wife...I wanted my business all set back up.
He states that he did so much work for 'nothing' and no doubt we can both list what he did. He fails to comprehend despite my advice, that if you give me a TV you have no right to burgle my house to take it back...IT BECOMES MY PROPERTY. So what he destroyed, which he now tries to portray as an accident while trying to repoint the sites to another host (despite site repointing not being able to jeapordise anything) was unauthorised deletion of my legal properties. Yes, I have a copyright notice to all my original works, which encompass several books, several calculators and many other business items and data sheets. Everything is clearly marked so title is not an argument.
Anyhow, one kind reader has suggested I litigate for recovery. I thank him for the suggestion but it is a fool that chases down an empty box. Witherspoon has zero assets.
My last remark here that is where all this really needs to add value is for the public just not to ever give this man their passwords, their private codes, access to accounts or money in advance. Only pay him historically only after having it checked out and all will be fine.
I will admit Witherspoon has more skills than I do. Mind you, he didn't refute that he asked me to edit his own articles and ebooks as he was "too mechanical". On the Warrior Forum in Novemeber he actually made a public claim that HE was the author of MY book and I had to jump in and rectify that total fabrication. I doubt he has even read it.
As for his ridiculous statement above that the public don't wish to buy my book for some reason...it can hardly be, simply because nobody has yet been able to access iot to read it...because Witherspoon hadn't managed to supply ANY traffic in 5 months due to idiotic keywords. When I adjusted them I got 9000 visitors in one month...until I found his amateur (or intentional) responder loop that totally prevented anyone from even taking my freebie. That's just how good he really is. As a project manager, he actually held traffic off...was this to allow him to invoice more perhaps? (it was nearly $900 by then) or was the hidden responder working for his benefit alone?
Yes, I write under a pen-name as I find I write better. As do many authors. Every formal document. paypal, my company, accounts, my address, my tax info, my sites etc are in my own name. Do a WhoIs.
Witherspoon has admitted in writing that he has little ability to stay with a task until completed and with all my works there was not one item that was checked for accuracy or was accurate. Everything needed a touch more work to polish off because by Witherspoons own admissions he gets bored and moves on. I got very fed up keep trying to test and re-test every half-hinged change he made every few days without warning.
I have every communication between Witherspoon and me and can substantiate everything. I did demand he restore all the work he destroyed, which I maintain to this day was intentional, as evidenced by his own silly email to say it was accomplished. Anyone may ask me for a copy and I will happily supply, although I am in the throes of creating a free e-book made up entirely of these communications.
I shall miss out nothing, including gratis jeuvenile remarks written by Witherspoon and attributed to his spouse. Silly stuff really.
Witherspoon and I know the full truth about what went on here but the fact remains that he deleted my property. It is actually legally encumbent upon him to restore or refund, but as my attempt to allow him to restore met with resistance and his own limits to less than full restoration, I have since demanded a full refund. It is up to him what path he wishes to take, simply because I now have nothing better to do than to warn the public of a possible danger to their finances. He should show at least some honour for a change. I should have taken heed of all the warning signs, so I'm the old fool that has lost out. Brian

THIS NEEDS TO GO TO COURT AND LET THE LAWYERS FIGHT IT OUT.
SOUNDS LIKE THE ONE GUY DID NOT CHECK OUT WHO HE WAS WORKING WITH.
I DID NOT HEAR ANY MENTION OF A CONTRACT OR A FORMAL BUSINESS ARRANGEMENT.
ALSO, IT SEEMED TO ME THAT THERE WERE DETAILS LEFT OUT.
WHY DIDN'T THE GUY TAKE THE PROPER PRECAUTIONS TO COPYRIGHT AND PATENT HIS INTELLECTUAL PROPERTY RIGHTS? CAN HE PROVE THAT HE WROTE IT IN THE FIRST PLACE?
THIS IS A BIG MESS BEST RESOLVED IN A COURT WHICH SOUNDS LIKE IT MIGHT BE A FEDERAL CASE DUE TO THE INTELLECTUAL PROPERTY AT STAKE HERE.

This report is completely false.
In October or 2008 I was fed up with internet marketing and was working on changing course towards something that I liked better when I was contacted by Brian Bailey.
He informed me that he thought that I should not give up and should stick it out and also that he had a book that he wanted to turn into an e-book and sell online.
After a few short emails back and forth, I found out that he had tried to get help with his online business idea before but could not afford to pay for the type of help he needed, so, I decided to help him.
Initially, he and I agreed that he would need his book turned into a pdf file for distribution as well as a functional site that would inform potential clients about his offer and which allowed them to purchase and download his offer, which he called "With Your Success In Mind".
I also agreed to socially promote his product, write 7 autoresponder emails for Brian as well as three promotional articles and to set him up with the accounts that he needed to monetize his site and get an affiliate program going.
I also agreed to supply him with an autoresponder account and hosting for his site until he could find such services on his own.
The original invoice for doing this work, since he was broke was for $425 but I even went as far as deducting $100 because of his stated "poor financial status".
In brief, I created the site but had to stop working on the completed site as he did not want to use his real name but the pseudonym of Nathan Howard, therefore, I had to begin again and the domain I had purchased of "Brian Bailey" was scrapped.
Brian had paid me $100 to start the construction of his site and once we realized that I would have to begin again from scratch, he sent me another $100 because It did not seem fair to either of us that I had done so much work for free.
To make a long story short, what ensued was five months of working with a client who claimed to not understand anything concerning starting an online business and who wanted me to build and maintain his online business for him (which I did for free) but who constantly changed course of the project and requested items and services which he did pay for but said that he would once the site took off.
During the course of this business relationship, I rebuilt his site more than 6 times, per his request. I also promoted his site socially, managed all of his accounts, and even set up 20 of my spare domains to point to his site.
Eventually, I even set up 7 complete blogs with content for him that were niche based and which pointed to his product as well as 3 niche sites from a purchase he made of Niche Blueprint. He did not pay me for setting up or hosting any of these 10 sites.
He only paid me for two months hosting and two months of autoresponder service during the 5 months I worked for him.
In total, Brian Bailey paid me $725 dollars. $425 in total to build his original site. $116 for replacement of funds which I used to try all of the services he asked me to try and $184 for promoting his site and managing it for five months.
During the fifth month I was attempting to get Brian to move his accounts elsewhere due to our unsatisfactory working agreement but he claimed that he could not.
I procured other hosting for Brian's paid for site (there was only one) and attempted to download his information from my server and place it on the new one when I deleted much of his information by accident.
I informed Brian of this as well as letting him know that I did not want his business anymore.
After a lot of name calling on his part, we agreed that I would rebuild his site on the new server from the zip file data that I had sent him and that after this was done he would be switching to another service which had all the tools he needed.
When I finished this work I asked him for the codes I needed to load the site to his newest hosting account but the login codes did not work.
At this point, Brian decided to call it quits and asked me not to do any more work for him.
There is a lot more nuance to this story that what is written in my report and his.
I did offer to give him a refund of any funds that he honestly thought I owed him but he turned it down and claimed the work to restore his site instead.
Eventually he decided to dismiss me, without paying me for any of the extra loads of work I had done for him and actually claimed that I owed him, in very unkind language.
As to his accusations that I defrauded him, all I can say is that this accusation is a lie and was constructed by a person who is unhappy with himself.
If he had let me build the site and promote it without hindering me, he still would not have made a sale as it seems no one wanted what he was offering, not even the free ebook.
