In short I was sent a flyer about a way I could approch saving my home from forclosure due to the lenders that were involed in preditory lending against my wife and I. I had lost my job in November 2008 like so many other people this last couple of years, because I was sold the home and I had a prepayment penalty that would have cost me 16k to refinance our home I could n't. I was told I would get my money back if they could not do anything well I paid for the audit $1600.00 two checks $800.00 each they wouldn't even start doing anything till I paid them the seccond check, I met with these guy's including Phill The owner in an Escondido office. I had told them my case that I had put 30k down on the home and the builder (Maritage Homes) gave me a 25k insentive to use their lender they said I had a great case.

Well they took their time with finishing this audit by the time they got me a Lawyer I was a week or two away from forclosure and running out of options.Well we saw the lawyer he was a jerk to say the least Mark Potter in Vista, CA he tells me he does not usually use those guy's for his audits humm weird I thought the are sending him business it get's worse he try's to get us to do a Bankruptsy, that we had no intrest in, saying it's one of our only options. I said maybe the last worst case senario so we sign a retainer and gave him the check to save the house right, the next day he call's me say's he can't take the case. Somthing about just getting back from a trial and being tired yada yada not proffessional.I called Phill he was upset said the audit was good and we had a case so he gets me another lawyer with more day's going by closing the gap for me to fight this, to put this in perspective I bought the home in 2006 for $535,000 I was paying $3,400 for three years now a home thats was worth $300,000 still beatifull 2650 sf new constuction due to the market crash, I lost over $200k in equity $80 cash I never took money out of my home, when I lost my job I did not want a free ride I was making 100k a year so my unemployment is more thann enough to pay a reuced mortgage one that is woth the home's current value, well that is what I was told I was going to get though this audit and lawsuit.The last lawyer never Answered the Phone or return my call with all other options stripped from me I lost my home.

Moving is expense strorage units and rent is not cheap so I need my Money please help. ANLA told me the check was in the mail I have seen nothing then I call them I can't get through to anyone no returned calls I am ready to go down to their offices but I don't think that using force is a smart way to go please help.

1. You contacted the office in February, yet decided not to act until 2.5 days before the house was auctioned. You were instructed in February, March, April and May that waiting until the last moment would make everything very difficult. You were told the closer it gets to the Trustee Auction Foreclosure Date, the less choices that are available. 2.5 days is not enough time for the attorney to prepare the paperwork to file the lawsuit.

2. Services were provided at a substantial discount. This includes getting 2 different attorneys to work for less than $100 / hour. In addition, the attorneys were willing to put your case as a number one priority. Finally, the attorneys were willing to work on Saturday and Sunday (for free!) to try to help you.

2. The audit was finished in January. It was not released until you paid because we (the staff) can not afford to work for free.

3. The services were performed. The audit was completed. The attorney advised you and you did not want his help.

4. You chose not to take the advice of your attorney. This is an expert who is providing counsel to you.

5. Your house could have been saved. You chose to wait until the last possible moment to do something. Then you chose to walk away. You were told what you needed to do. You made the choice not to listen to the advice given multiple times.

6. A partial refund was sent to you.

The bottom line... Favors were called out to try to help you (even though you did not want to help yourself). You were warned (over and over) that waiting would limit your options. We exhausted all remedies trying to save your home. Even after all of this, you were given a partial refund (sent to your home address).
