For the first time in my life, I received a notice of a courtesy pay from my bank. Apparently I did not have enough money in my account to cover the $100 check I had written to my mother. Further investigation revealed that a company called AP9 Simply You had received payment in the amount of $14.95 on March 21, 2006 and $14.95 on April 18, 2006.

Needless to say, I was outraged. I had not even the slightest clue as to what AP9 Simply You was and certainly could not have authorized the charges. I immediately called the company (on Sunday) and cancelled a membership that I had not purchased or used.

The very next morning, I contacted the company to speak with a representative. I spoke briefly with Claire (ID# 4138) before being forwarded to Kathy (ID# 6041). I reiterated to Kathy that did not know what AP9 Simply You was and I had in no way enrolled in the program, and told her that they will reimburse me the amounts stolen from my account for the months of March and April as well as the $27.50 the bank charged me, since it was thier unauthorized debits that caused my account to have insufficient funds.

Kathy told me that her system shows they had already refunded me the $14.95 debited on April 18, but they would not be able to refund the one from March. She basically told me that I should been paying attention to my account and should have called earlier to cancel. I told her that I should not have to cancel something that I did not enroll in. She said I enrolled in the program when I purchased Sheer Cover (cosmetics endorsed by Leeza Gibbons). We went back and forth with me emphatically denying I had agreed to enroll in the program and she saying I did.

I had pulled some information from one of their websites, which stated that I would have received an enrollment packet, membership information, a membership number, some information detailing the program and how I would be charges as well as something for me to confirm enrollment. I told her I never received this information. She said her system showed that the information was sent out in February. I asked her where was this confirmation they should have received, to which I received no answer.

In the end, Kathy said they had refunded me the $14.95 taken in April (as of yesterday, they have not) and that they would investigate to determine if they could refund the $27.50 courtesy pay fee. Of course, I know better. Folk like these are only in the business of taking and being completely unscrupulous.

Per Ripp Off's Editor, I contacted my bank in writing and have asked them to issue me a new card. In this same letter, I have stated that I wish to dispute the transfers, as they were unauthorized and constitute fraudulent activity, and I have requested a full investigation into the matter. I have referenced this site and the hundreds of cases like mine. I even mentioned that a law firm (Girard Gibbs & De Bartolomeo, LLP) is looking into bringing a possible class action suit against MemberWorks, Inc., which includes PremierHealth Plus, Simply You, 24 Protect Plus, Privacy Matters, HomeWorks Plus, ValueMax, Your Savings Club, Galleria, and Simple Escapes, among others.

If you have not, all of you who has been scammed by Simply You and one of the companies listed above should sign on to be a part of the class action lawsuit, should it come to fruition. I will get back to you with the web address.
