A dead beat insured by Apollo Insurance side swiped my car causing $3000 of damage. He was driving (Southbound) towards me, lost control of his car and swerved onto the wrong side of the road hitting my car (as I travelled Northbound).He accepted liability at the scene several times in front of a Police Officer.
I submitted a third party claim against Apollo Casualty, his insurance company.They denied my claim stating that another car had cut off their insured, casuing him to swerve into oncoming traffic.The third party phantom driver was not seen by anybody else, including myself.
Apollo insurance are known to avoid paying out on any claim. They blame whoever they are not insuring.They are a disgrace to the insurance industry. Avoid them at all costs.

Just go after the person who hit you. You should be able to sue in small claims court which takes days - not years to be heard.
After you get a judgement against the person who hit you, you can request the order be inforced by hitting their bank account or garnishing his/her wages.
Let the client of apollo deal with the fact that he/she paid insurance premiums to a company that isn't paying. Let the client of apollo sue apollo for failure to perform. You need to sue the person who hit you.
The person who hit you is responsible for the damage - not the insurance company. Check it out for yourself with any attorney you like. Better yet, look up the small claims court where you live in the telephone book and speak to the clerk of the small claims court.

I have handled insurance claims in Illinois for 7 years. You are one of the many victims of Apollo and their ilk. (People in in the insurance business call these companies the "dirty Dozen")
Even if their driver admits fault Apollo will offer you less than you have coming. They do this for two main reasons. 1 Save/Keep their money. 2. Force you or your insurance company to file a lawsuit.
By making a low-ball offer, if they make one at all, allows them to slow down the process, especially if you do not have your own collision coverage. They know that it can take years to get your case heard in any of the Chicago area counties. They use this fact to hold on to their money. The whole time you are waiting for your case to get into court they are earning interest on their money.
Even if you have collision, they would make the same low-ball offer to your company. Then since Apollo is not a member of Insurance Company Arbitration they make your company sue them and then the time-factor works in their favor again.
If you have collision coverage use it. You will be out your deductible but you may get part of it back in about 3 to 5 years. Your company will do the dirty work of suing the other driver and dealing with Apollo.
If you do not have collision, then you are in for a long fight. Once you get over the fact that it can takes years to get in front of a judge you still have to win. So if there are any witnesses to the accident try to get a written and notarized statement from them that you can take to court. Write down your version of the accident so you have something to refer to in court (many people get nervous and forget important details)
Take plenty of photos of your car and the scene where the impact happened. Get two estimates of your damages.
In most cases, if you win in court Apollo will then pay you to keep their policyholder from having you garnish their wages etc.

You should sue the person who hit you.
The person who hit you is responsible for your damages. After the person is served, watch how fast he/she contacts the insurance company to find out why they aren't paying you.
I did this way back in 1978 - somebody hit me and his insurance company offered to pay substantially less than what the dealer was going to charge for repairs. My lawyer told me to sue the person, not the insurance company.
As soon as he was served, I got a phone call from Farmers Insurance Group offering to pay the full repair bill, plus my legal/filing fees.
The insurance company didn't hit you - the driver of the car did. You can sue the driver and the owner of the car if they are different people.

Apollo Casualty Company sounds like a high-risk insurer for drivers with driving (or other) problems.
Your only solution is small claims &/or your state's insurance department. If you had collision, your insurance company would beat it out of them for you.
