Seller was offering a special price of $150 for website design, with 24 hour turnaround promised. 

1) It took weeks, not 24 hours. Seller failed to inform me of all the information he needed from me first. Even when he had it, it took weeks and mutliple messages to get him to deliver the site.

2) Repeated requests to get the site live on my domain went unanswered. Tried one last time and the response was "I designed your website, what else am I obligated to do?" My response was get it to go live as promised. Seller told me on a Sunday he would help me on Tuesday. When I contacted him on Tuesday morning to ask when we could talk, he informed me I had to make an appointment and he was unavailable that day. I asked why, when he promised that we were going to get it straightened out that day. He said that he decided the day before he was only talking to people by appointment. I was surprised, confused and unhappy. I said, anyway, I've made an appointment for tomorrow so we will talk then. He responded that he took offense at my use of the word anyway, that it was "dismissive' and that he didn't like the "energy" of this exchange and it wasn't bringing him "joy" to do this task so he was choosing not to speak to me for 30 days. (I have the written record of this exchange.) Sellter then told me to contact the platform he designed it on as they have excellent customer service. Needless to say, he did not call the next day at the time I blocked off on the scheduler he sent me.

3) I contacted said platform due to lack of response from Seller. I discovered that he had designed a free website from a template that would have taken him less than an hour to complete. I could have done it myself. For me to use the site he designed, I would have had to pay the platform approximately $200 a year to get rid of their name on the free version, which was unusable for professional purposes. I further found clearly stated on this platform's website that they do not have the capability of porting to an outside domain at this point in time. The Seller would have known this fact, and if he didn't, he is negligent as iit was his duty to know and inform me. The site he designed is completely useless to me. I've wasted $150 and months. 

4) It is unclear why the Seller chose this platform. if the Seller was an affiliate or reseller, he would have received commission on my upgrade to the $200/year site, so he may have been motivated to use this platform which I had never heard of to make more money off this project, which would be something he would need to disclose. 

5) The Seller should have disclosed to me that he was designing a site on a free platform. I never would have bought his services if I had known. I could have done this myself.

6) The Seller refused to take PayPal or a credit card, only a debit card, so I am unable to charge back. 

If you are buying services from this Seller, recommend not paying in full until work is done and definitely do not use a debit card.

Asa,

I'm very disappointed that you did not issue a refund today or even reply to my emails of yesterday regarding the refund.

I was not under any obligation to provide you "proof of purchase" as a condition of refund. I did do it. Furthermore, you could have easily looked up your own bank records for December 29 to find the transaction as the money went through the Facebook payment service and came out of my account on my debit card instantly, so you would have received it that day or no later than 24 hours. Your own terms were payment in full before work began, so the fact that you worked on it is prima facie evidence you received payment.

This email serves as my final correspondence to you directly. I've consulted a lawyer and I am able to file a small claims courts case here in state redacted) as I"m the consumer and it's my place of residence. You are hereby notified I intend to do so as you have not provided the refund or indicated when you would do it, and we are 25 days past the date you said you would refund. There's no reason you couldn't have responded to my emails of yesterday even if you weren't able to process the refund right away.  

This situation beggars belief; it just wouldn't have been that hard to get on the phone with me for 15 minutes back in March as I repeatedly, politely requested or to just issue a refund. I can't understand why you would treat a customer this way. 

I've just downloaded the paperwork from the court and I will before the end of the week go and file the case. You will be served via email, registered mail and in person by a sheriff if necessary. 

Once that's done, I will not accept just the $150, I will require reimbursement for the court fees as well before I will drop the case. If you refuse to do that, I will press the case. My lawyer will be with me, the cost for which you will also be liable, and I know I can win because I have the entire thread of conversation from the time this started available to present to the judge. I"m sure you know that if you don't show up, I will win by default. 

So it's up to you how much you want to pay to end this dispute. The sooner you send the refund via Western Union, Moneygram or Zellepay, the more likely you are to catch me before I've made the trip to the courthouse, which incidentally is within walking distance of my home.

It is unfortunate that your experience was negative in regards to getting your website designed. Your complaint, from what I can tell is valid and heard. There is no intent to further an experience that does not serve you well. At your earliest convenience please send an email to info@leveauxgroup.com with your receipt of purchase so that a full refund can be sent to you.
