On the morning of Friday, June 12, 2009, my husband, notified me that he needed a new crack sealer machine for a big job he had coming up the end of the following week. He asked me to call the AsphaltKingdom.com (he had found them on line while surfing for such equipment the night before) and see if they had such a machine and if it would be possible to receive it early the following week (which would have been Wednesday, June 17, 2009).
SoAt approximately 11:00 a.m. on Friday, June 12, 2009, I called AsphaltKingdom.com at 1-866-399-5562 and pressed 1 for sales. I was greeted by a salesperson named ANDRE.
I explained the situation to ANDRE and he assured me that it was no problem to receive the machine by Wednesday, June 17th, 2009, but at the latest, we would have it by Friday, June 19, 2009. I told ANDRE I would have to make sure that date would work out for the job my husband had planned and that I would call him back if I was going to order.
I checked with my husband and he said as long as he did not receive it any later than Friday, June 19th, 2009, that it would work and he could still get the job done. I called ANDRE back and told him as long as we had the AK-10 hot pour crack fill applicator (aka: crack sealer machine) no later than Friday, June 19th, 2009 that the order would work for us. He assured me with (the greatest false intent as I would find out) that we would have it at the absolute latest on that Friday, June 19, 2009, so I went ahead and placed an order with the ASPHALTKINGDOM.com
When Wednesday, June 17th, 2009 came around, my husband asked if I had heard anything from AsphaltKingdom.com on our delivery and I had not heard anything so he continued to sit home awaiting a delivery from them. He continued to wait all day at home for the delivery on Wednesday (June 17), Thursday (June 18), and Friday (June 19) until the late morning. Shortly after 11:00 a.m., my husband called the AsphaltKingdom.com at 1-866-399-5562. He spoke with ANDRE and asked where our equipment was and reminded him that I had placed the order and that he had promised it to us no later than this day, Friday, June 19th, 2009.
ANDRE told my husband that he would have to speak to their Customer Service Department and that no one was in at this time, but he would have them call him back at our home number. He waited until approximately 3:00 p.m. for a return call, he did not receive one. He called ANDRE back and ANDRE said he couldnt understand why he had not received a call back and that he would request that my husband be called again. At this time, mu husband asked ANDRE if they had the machine (AK-10) in stock and ANDRE replied YES, he had them sitting there.
Within 5 to 10 minutes after my husband hung up from ANDRE, a woman, named SABRINA, in the customer service department at the AsphaltKingdom.com, called my husband back at our home. She apologized for not returning his call right a way. My husband then asked her to check on our order. She then indicated that there was no shipping or tracking number for her to check our order in her system yet because the machine was not yet even made. She informed my husband that it takes approximately 4 weeks for them to make and that the machine was not made yet.
My husband, getting upset, informed her that that was bull---- because he had just hung up the phone from ANDRE and ANDRE just told him that they had it in stock. My husband then said to SABRINA, well then ANDRE lied to him and that was bull---- and that he wanted to cancel our order. Sabrina said that she would cancel the order with no problem, but we would have to pay $125.00 cancellation fee. John said bull---- I am not paying the $125.00 because I was lied to. He then told her to put ANDRE back on the phone because ANDRE, once again, had just assured him that the machine was in stock. Sabrina then told my husband that he should have read the fine print on the website because it states that the order would take 4 weeks. He said well ANDRE promised us otherwise so put him back on the phone.
My husband
He said fine but he informed my husband that he didnt like the way he was talking to him, my husband said well fine, but I dont appreciate being lied to and costing us business. ANDRE said it would cost $125.00 to cancel the order. My husband said Bull----, put your boss on the phone, you lied! ANDRE replied that - this doesnt go any further than this desk. My husband said fine and that we have been in business for 20 years and we will cancel this transaction through the credit card company because we were lied, never received the equipment ordered and should not owe anything! ANDREs response to that was fine you wont win - we never loseand he hung up.
Well guess what we never received the equipment and totally got screwed out of the $1,500.00! We had charged it on a Capital One credit card and they claim they sent us letters asking for our side of the story and didn't get a response. We never received such a letter! ASPHALT KINGDOM AND CAPITAL ONE ARE BOTH LIARS, LOSERS AND RIP OFFS!!!!! DON'T USE EITHER ONE.....

Fortunately ripoffreport.com provides the opportunity for a company to share a few thoughts as well.
The good news is that we are getting this all resolved with the client and are in communication with the client John Denison right now.
As many people know, there are hurdles in business that we have to face. If we face them ethically and professionally we can overcome the hurdle and grow stronger.
We just reviewed this case and here is what we have determined.
1) The client called our toll free line on the 12th of June 2009 to place an order for an AK10 Crack Melter Applicator.
2) The client did not want the AK10 any later than the 17th of June because of a large job they had booked.
3) Our sales manager contacted one of our suppliers at the time to see if they could ship the AK10 out and have it to the client by the 17th of June. The supplier told Andrei that they thought they could get it there for the 17th but could not promise this.
4) The client was called back and informed that we felt that the AK10 could be there by the 17th of June (Based upon what our supplier had told our sales manager) but could be a little longer as our shipping policy is 7 to 10 business days from time of order.
5) We took the order and processed this order with one of our suppliers as per the thousands of other orders we process.
6) Our supplier ended up shipping another AK10 order via expedited shipping instead of shipping it to John Denison. A shipping error, which we take blame for.
7) The AK10 finally reached John Denison area on the 1st of July 2009, which he then refused the shipment. We never knew that John refused this shipment as it is marked on the shipment tracking that it was delivered and John never let us know that he was refusing it.

8) The AK10 was then returned to our supplier. Our supplier never told us that it was returned so we had thought that the unit was delivered and all was well.
Unfortunately, not knowing, our client didn't have their equipment that they had paid for and we still had their funds.
We called the client back this afternoon to explain the situation and to apologize for all of this.
We are filling out the paperwork with our merchant processor as we speak in order to refund John Denison the full amount $1,499.
Again, we apologize to our customers for having to read this case. This really isn't the way that we do business. Our clients have fantastic things to say about us, they really do.
