This is at least 7+ year credit account (8-10 years in reality). Here is the story, contract was signed by my fiance 8-10 years ago for credit. On income, she put 'Social Security Disabilty'. When I got with her, she was in debt to the gills. I worked with most to stop interest charges and close accounts even though there was a balance and paid them off. I explained she was on Disabilty and it was a mental disability. As I said, most were very cooperative. I noticed one was getting higher every month, over $125 without card being used. I continued making generous payments to cut-away at the balance. At same time I was disputing all the bull service charges they were adding. 4-6 months of this, I stopped paying till they start working with me. After 1.5 years of useless debating over the phone (in that time a collection agency bought it), I sent a certified letter that I want all communications to the matter to stop and decease for I (fiancee, not I)will not discuss the dispute anymore. I welcome you to excersise your right to take legal action. Again, 8+ years ago, obvious I have no proof to anything in 2006. What do I say/do at court? My facts are this:

A) Can someone on Disabilty even be bined to a credit contract with creditor knowing the fact?

B) Isn't there a time period they have to take legal action?

C) Would they even have the statements showing transactions after 8+ years?

Myself, this is extortion, using intimidation and fear to collect money. On copunty records, status is:
04/24/2006 Praecipe for ordinary mail filed
04/24/2006 Praecipe for Alias Summons filed

What does that mean?

Each state has a Statute of Limitations for debt collection.

When was the last time you actually made a payment to ANYONE on this debt?

Any payment restarts the SOL for collections, AND the 7 year negative reporting.

The first rule when dealing with ANY debt collector is to NEVER do anything over the phone. Do EVERYTHING in writing!! Use ONLY certified mail, return reciept requested. Be sure to put the certified# on the letter itself.

Read the FDCPA at the FTC.gov website, then send a DEBT VALIDATION letter where you specifically dispute that you owe ASSET ACCEPTANCE anything, and request to see proof of debt such as something you signed and an account history.

If they bought the debt, they MUST prove they actually own it and show how much they paid for it.

FYI...SS Disability can only be garnished by the IRS. If that is your only income, even if they sue you and win, they cannot get paid.

Asset Acceptance Corp.(AAC) is now a publicly traded company. (Nasdaq: AACC)

They purchases old portfolio's of mostly worthless charged-off accounts for pennies on the dollar. Once owned, they inflate the value of the portfolio, send out dunning notices and try to collect at a ridiculous profit.

Don't be surprised if you notice the date of last activity on your credit report, as stated by AAC is WRONG! Deliberately changing the date of last activity is a way to scam consumers into thinking they are entitled to money they would not legally be allowed to collect.

This is standard procedure for them -- from "re-aging" the debt on the credit history, to suing on what is probably a statute of limitations claim, to reneging on a written promise. These liars, thieves and snake-oil salesmen are trying ALL the con's known, to grease their pockets with your money.

Watch out too for the mystery $50-$75 payment that is claimed to have been revived on the account. When pressed, they claim to do an investigation and "discover" that they made a "clerical error" and mistakenly posted someone else's payment to your account. (LIARS!)

NOTHING this 'House of Cons' does should be believed or taken at face value. They have proven over and over they are liars and thieves!

Under federal law, the Fair Credit Reporting Act (FCRA) an account may ONLY stay on a credit report for seven years. One of the cons being used by Asset Acceptance is to claim you made a $50 payment, which would have re-started that clock. Unfortunately this is a 'bogus-claim' by AAC, is illegal and violates your rights.

Asset Acceptance Corp has earned the distinction of one of "AMERICA'S WORST COLLECTION AGENCY'S". They lie, steal, cheat, misrepresent, file bogus claims, create phony documents and commit perjury in the court system JUST to increase their bottom line.[Compliments of budhibbs.com].>>>>>>>>>>>>>

It sounds like they are making empty threats but go to FTC.gov and file complaints anyway.
