I obtained a loan with Associates mortgage in 2000 for 89,000. Associates' reported that they did not receive my first payment. I argued the point to no avail and resent the payment against my better judgement. I did so because I had sent a check and at the time could not produce my a receipt. I gave the second payment by check by phone. I requested a payment history several times over the course of this loan, then finally I received a complete hsitory showing the orignal payemnt was received and posted to interest only.
Associates sold my loan to Citifinaical in 2001. In 2002 Citifiancial stated I was in default by 2 payments, again I argued this point thru documentation to no avail, I agreed to a deferrment which was accepted to bring the loan current and prevent foreclosure. Citifinacial then demanded the two payments upfront or face foreclosure again...I paid the 2 payements and proceeded to refinance this property. Citifinacial reported on my credit report that I had been >90 days late and sent me a payoff quote showing that I owed 4 deferred payemnts on top of this loan, thus reducing my loan to value ratio and preventing me from refinancing this property.
In 2003, I took ill and was behind 1 payment Citifinacial again offered a deferrement which I took but it was noted for 2 payemnts. In 2004 Citifinacial stated I was again in default 2 payments, although I argued this point I knew it was useless agreed to another deferrment of 2 payments and proceeded immediately to a Chapter 13 protection. I reaffirmed my loan in chapter 13, converted to a chapter 7 after 18mths, Citifinacial then proceeded to petition the Bankruptcy Court with false and erroneous information stated that they had not received a payemnt from me since July 2005.
I went into a court action in the lower courts in 2006 and lost summary judgement because I represented myself and the judge did not review any documentation presented by me to the courts. Please note Citifinacial never denied my allegations against them. I filed a formal report with the Federal Trade Commission and the Attorney Generals Office in the State of Indiana. A investigation was opened by the AGO and Citifinancial was suponened but has failed to respond it has been 11 months as yet.
My home was sold and rebought by Citigroup for 52,000.00 in December of 2006. I maintain possession of this property to date. I obtained legal representation and filed appeal with the Indiana Appeals court which agreed to hear this case. Citifinacial has yet to respond.

I have a response from Citifinacial regarding my alleged claims of fraudlent accounting practices, intimidation, misrepresentation of facts, coersion and intimidation. Citifinacial after requesting two separate thirty day extensions from the appeals court so does here and now answer my alleged claims, issues and facts of the cited case against them in the Appeals Court for their representation under the counsel of their Attorneys. THEY AGREE ON ALL ISSUES OF FACT SUBMITTED TO THE LOWER COURTS.
They have also claimed a technicallity in the process of the Legal system in which they should not be held accountable for the gross and irreputiable damage they have caused me. Let me tell you here and now any time you appear in front of a judge and affirm the facts of your case you do so under the grounds of perjury. At this point I must say..IF GOD BE WITH ME WHO CAN STAND AGAINST ME! ............
Also the Attorney General offices states they still have not responded to their subpeona related to information on the facts of this case; their hands are tied......and I have done what I set out to do; expose this mortgage company and at very least slowed the process in which they have persistenly and methodically corrupted the honest citizens in the State of Indiana.

To those of you in Indiana, who struggle relentlessly to pay and keep your homes from foreclosure and repossesion by Citifinacial or any other preditory lender, I pray this information will help you thru your court action.
Indiana Code 26-1-9-1,609,625,628, deals with issue of "Breach of Peace" and "Must pursue Repossesion in court action" as well as, "Liability of damages"in laymans terms this means keep making your payments, if they refuse them, hold on to them anyway {in your own acount), in the lower courts, submit copies of your facts or records, {preferably thru a Attorney}, if you lose Summary Judgement, {File an appeal of your case) to the Appeals Courts, at no time must you surender your property willing thru-out this process.....NO Matter what they offer you, NO Deal, Make them prove it...and finally if you lose you are liabile for damages and costs associated with this action but if you win so are they!!!!!
It is not easy by know means and it will drive you crazy thinking how much effort and time your spending of your life regarding these matters, whether your health will stand up under continual stressors, or whether your family will give up on you, or that job that questions your character as a result of their tactics, But know this God gives you no more than you can bear! Any individual who stood up for him or herself lost more than they gained but over time, thru the next generations your efforts may make the difference.
