AT&T will not allow me to simply cancel my contract and pay the $175 early termination fee unless I pay an additional $133.77 for services never used.  I never activated my phone, I never turned it on, I never used it in any way.  I had to leave the country so I took the phone with me and signed up for a new contract and immediately canceled the old one.  The first operator I talked to said no problem, when the cancellation bill never came I called them to find out why and they began trying to extort an additional partial months services, a full months service and an "activation fee" for a phone I never used or activated.  They claim contracts can't be canceled within the first 30 days.  Not true, the contract says nothing about it, it does say you can return the phone for a full refund otherwise the cancellation fee is $175 with $5 deducted for each month you use the service.  0 months = $175.  Total scam!

wording straight from the contract

Just add the language straight out of the contract:

Subscriber must live and have a mailing address within AT&T's owned network coverage area. An early termination fee of $175 applies if service is terminated before the end of the contract term and will be reduced by $5 for each full month toward your minimum term that you complete. If phone is returned within 3 days, activation fee will be refunded. If phone is returned within 30 days in like-new condition with all components, early termination fee will be waived.

Clearly AT&T cannot even do 3rd grade math: It clearly states $5 is to be deducted for each month of the contract not completed but there is NO statement about adding fees when no months are completed.  $175 - (0 * $5) = $175.
