WAKE UP AMERICA!!!! Retired 63 year old handicapped person who was victimized by these SCUM BAG ATTORNEYS and their idiot employees...They used my address to file a collection case for the national crooks, LVNV FUNDING....

It was supposedly served to my address and the documents also stated that a neighbor owned my property and that her DMV records showed my address...Due process was never completed...Valley Process Services supposedly served the documents and notarized the documents which in turn incriminated Judge Karston Rasmussen who signed the default judgment...My property was liened illegally...

All of these attorneys use nothing but Post Office Boxes...Their physical address is 1666 West 12th Street, Eugene, OR...Signage reads "Professional Offices"...Valley Process Service's address is 4978 Morley Loop, Eugene, Oregon...Jason Williams, Process Server...Abigail Williams, Owner & Notary...Notary number 2008OO3369 Expires May 14, 2011...Cars at the Morley Loop address are a late model Red 2 door Honda and Dark Grey Nissan Club Compact...

File Small Claims against process servers...It's easy and cheap...In Oregon, get up to $7,500.00 from both process server and company...File complaint with the Secretary of State and State Attorney General for your state...

Bittersweet ending...

In 2006, after diligently paying back creditors via a debt repayment service for two years, McGavic sent me a summons (which turned out to be fake).  Unfortunately for him (and his client, Capital One), it backfired.  I retained an attorney immediately.  He phoned McGavic's office and told him the demands in his summons were outrageous ... and that unless he modified his demands, I'd file a Chapter 13 bankruptcy.  All of a sudden, his demands became smaller - three times (grin).  But since they were, in my opinion, still outrageous, I did the one thing he'd never want me to do - file Chapter 13.

Oddly, if he'd left me alone, all my bills would have been paid off in full in less than two years.  And this is what I wanted to do.  In no way did I want to stiff anybody.  But McGavic left me no choice if I wanted to secure my financial survival.  Under the terms of the Chapter 13 plan, my creditors were forced to accept roughly three-quarters of their remaining due amounts - and the court denied every penny of his attorney fees.

The five-year Chapter 13 plan, beginning in 2006, was successfully completed six days ago.  In fact, I even have a "refund" check coming to me from the court (grin) - not to mention an Order of Discharge.

In my case, timing was everything.  I was able to get under the umbrella of Chapter 13 protection before McGavic had a chance to file liens, judgments, or garnishments.  So, I didn't suffer a loss at McGavic's hand.  However, a number of people did - and I have a suggestion for them.

The Attorney General's complaint is a matter of public record.  The Willamette Week article about the closing of McGavic's office had a number of comments unfriendly to the process - suggesting the AG should have done more.  I think that's a bit unfair on the AG.  His primary responsibility was to end McGavic's legal business and assess a fine for his misdeeds.  That was done - and the AG's decision didn't surprise me at all.  What DID surprise me was that no legal firm I'm aware of jumped at the chance of contacting the complainants (mentioned in the AG's public-record complaint) and filing a class action lawsuit to recover civil damages for those complainants.

The results of the AG's investigation of McGavic should make such a class-action lawsuit a walk in the park.  And I'd suggest that ANYONE who suffered a loss due to McGavic's chicanery contact a debtor attorney - and ask them to consider such a lawsuit.  In most cases, your first visit to an attorney is either cheap or free.  So, you have nothing to lose and possibly a lot to gain.

McGavic made his living by kicking people when they were down.  I say it's time to return the favor.

I was an employee of Jason and Abigail Williams last summer, working in their new "office" in Junction City. They now have their own company, however do still serve for Valley and other companies throughout Oregon. Because of the restrictions this site gives on the rebuttles I have to must from divulging all of the illegal activities and cruel views of both Abigail Williams, and their daughter whom are working for the company as well. I strongly disagree with the cruelty I have personally seen shown to the people they serve. And strongly urge the people who have been served by them to post a report on Angies list.

I too was a victim of this company. Totally unprofessional. The person on the other end of the phone was eating and chomping in my ear. They wanted other phone numbers of people I knew.

Derrick McGavic caught, fined and no longer a lawyer

It happened today...The McGavic and Finney law firm in Eugene, OR has been SHUT DOWN!!!!  Derrick McGavic has been fined $70,000 and is NO LONGER AN ATTORNEY!!!!  The State of Oregon was finally able to get them because of all of the complaints filed with the Oregon Attorney General's office....Thank you to the AG's office and all the other government officials that made this happen...It takes time for things to happen, but when it happens it sure feels good!!!!
