I, XXXX XXXXX, have been a victim of fraud, resulting in the loss of over$10,000. The incident came about after being informed that I could make hundreds of thousands of dollars if I invest $10,000 into starting a hard money lending company. The informant of this opportunity, originating from a third party in California, was a resident of Tennessee, licensed as Real Estate Broker, whom I had known for about two weeks, named Aubrey Bruce Wring.
Within the two week period of knowing Mr. Wring, he assisted me in locating a property. On February 21, 2012, I signed a lease agreement with Wring’s company, Affordable Management LLC, leasing property, located at XXXX XXXXXX XXXXX XXXX, XXXXXXXX, TN 38002.
Following the signing of the lease agreement, making a deposit, and paying an application fee, Wring acted very persistent, insisting that I wire $10,000 to a third party to start a hard money lending company. “You’re going to miss out on the opportunity of receiving thousands of dollars coming to your mailbox every month if you don’t agree now,” he stated repeatedly.
Eventually, I went into four agreements with Wring to start a hard money lending company, resulting in the $10,000 bank wire from my bank account in Tennessee to the account of a third party in California.
Provided, is a description of the four agreements which took place to form the company, Funding Co. USA, although it was never established:
February 22,2012—Awaiting the $10,000 bank wire to post, Mr. Aubrey Bruce Wring signed an agreement acknowledging and confirming that the company would be formed with the money. Further, the agreement assigns 75% of the company’s net earnings me — leaving the remaining 25% to him. This 75%—25% split was set to go into effect once the $10,000 was recovered to me, along with an additional $2,500 for furnishing the money up front, that day.
February 23, 2013— Mr. Aubrey BruceWring signed a Participant Confirmation Agreement. In the Participant Confirmation Agreement, signed by Mr. Wring, he confirms and acknowledges that he will participate in real estate/ private lending training conducted by Stand & Deliver, Inc. (Stand & Deliver). The agreement from this third party included the following:
I will attend and/or participate in the real estate / private lending investment training (the “Training”) conducted by Stand & Deliver”). As a condition to my attendance and participation in the Training, I, for myself and anyone who may act on my behalf, hereby confirm the following for the benefit of Stand & Deliver, its agents, employees, officers, and any person or organization associated with Stand & Deliver and its activities (collectively, the “Host Parties” and each a “Host Party” . . .
Further, the Participant Confirmation Agreement addresses Particular Investment Opportunities in section #2. After reading it carefully, please find that this section has nothing to do with training conducted on the behalf of the third party, Stand & Deliver, therefore does not obligate Participants to participate in opportunities, outside of the training. *Solely, the purpose of this section has nothing to do with tying Participants into the training program. It is for investment opportunities independent the training.
February 23, 2013— Mr. Aubrey Bruce Wring signed the Private Placement Profits Terms and Agreements. In the Terms and Agreements signed by Mr. Wring, he confirms and acknowledges the terms and conditions that govern the membership of the program. Out of eight topics, including payments, Wring only complied to Payments, remitting the membership fee of $10,000 on or before February 23, 2013 through bank wire transfer made in exchange of an agreement to start a business.
Twenty-one days, following the $10,000 bank wire and signing several documents, regarding the creation of the entity, Funding Co. USA, Wring stated the following:
“Meet me on Highway 64 at UPS so that I can sign the company over to you,” and “After this, you're going to have to get your money back the best way you can.”
March 15, 2012—During this last encounter with Wring, he transferred Funding Co. USA over to me. Within days of searches to business filing organizations, I discovered that Funding Co. USA had never existed. Searches included the Tennessee Secretary of State, U.S. Securities and Exchange Commission, U.S. Patent and Trademark Office, Better Business Bureau, Dun and Bradstreet, Memphis Chamber, I.R.S. (Internal Revenue Service), and Tennessee Department of Revenue.According to a public records search, Aubrey Bruce Wring filed a Chapter 11 Bankruptcy February 19, 2010.
