I rented a car from Avis through "name your price" of Priceline.com.  I prepaid the total rental amount with my credit card, including all taxes and other charges and I declined the insurance.   When I went to Orlando Airport Avis Rental Kiosk, a representative name JERROD, informed me that he I got a great deal on rental, and offered me to get insurance for the vehicle.  I told him I do not want the insurance and that I have the insurance coverage from GEICO, which he noted on my contract.

I excused myself for a few minutes while I made sure my luggage is still safe.  When I returned to the counter, he informed me my friend already signed the contract for me.  I thought that was highly irregular practice, but because we have kids traveling with us, that are too tired from long flight.   I trusted him that he did not add insurance coverage on my rental.   When I returned the vehicle, I was surprised that they charged me additional $192.46 for Loss Damage Waiver (LDW) and other charges they cannot explained to me.

I contacted the Priceline because I thought they are the ones who added those charges, and they informed me that AVIS with JERROD, is  the one who charged us for LDW.   I called AVIS and the reprentatives I talked to (3 total) are very rude and unhelpful and they informed me that I signed the contract (which I did not), and I am out of luck.   I asked to be transfered to a supervisor  but I was told I have to wait for a return call within 24-48 hours.  I did not get any return call.  To my surprise, after a few days, I received an email which just reiterates what the earlier representatives told me.  Then, they declaired my case closed.  Here is copy of the email:

RE:  Avis Escalation

Avis Case:  13704040

Reservation:  21298117US1

Rental Agreement:  199838520

Dear Customer,

This email contact is in response to your recent escalation request. Your case file has been reviewed. Upon review we find the charge for the additional services you received for coverage are valid and will be upheld. The signed rental document shows the service you agreed to at time of rental.

When renting a vehicle with Avis, you have the option to accept or decline coverage. The choice is authorized by the renter, and that decision is noted on the individual rental agreement when the customer signs for the coverage. We have checked our records carefully and find that the coverage was offered to you, and you indeed signed the agreement.

We understand you may not agree with our findings. However, we do find your rental billing to be correct and no adjustments warranted for services received and billed. We consider your case file closed. No further action is to be taken.

Sincerely yours,

Avis Budget Group

Escalation Team

I research on this matter online and found out this is a common practice in AVIS because they won a previous law suit (Chabraja VS AVIS) similar to my case, and they continue to do this practice and even provide more incentives to representatives who can hard sell the insurance coverages to unsuspecting buyers like me.  Avis has to be stopped from this deceptive practice.   I do not know who else can help me.  Please someone must help me, I am an honest individual who fell victim of a huge unprofessional and dishonest  company like AVIS.
