November 2009 I was fortunate to find a vehicle that I preferred however the prior experience was a let down due to the finance dept not following my request in writing located on the companies credit application and verbally several times to the finance manager handeling my case.  As requested both verbally and in writing I requested that only one credit inquiry pulled.  After the finance manager received my credit application he acknowledged my request and stated that no one will pull my credit other than one time.  After pulling my credit he stated my credit score is 710 but the lender Huntington National Bank has only qualified my loan at 8.33% interest rate.  I told the finance manager no problem, do not pull me credit anymore I will go with with my lender/bank and have your funds in the next 2 to 3 days.  My lender offered me a 5% rate.  Only 2 days later the head finance manager ( Mr. Turner ) over the entire Bachman auto group contacted me at my office and stated he had great news that he pulled my credit today and got me a rate in the 5's.  I asked him did he read my credit application request and he said he did but wanted to control the rate and lending. That pulling my credit 5 more times with 5 different lenders would not effect my credit score, that he has been doing this a long time.  I asked him what gives him the right to overlook my request? His reply was that he knew it would not hurt my credit score, that he has been doing finance for 20 years and this is standard industry practice.  He then without apologizing or no regard for my request asked me would I be interested in going with his lender at 5%, that his company will only make 150.00 from the lender but they would prefer to control the rate. 

I told him that I would think about it, hung up the phone left a message with the sales/finance manager I spoke with at the hummer dealership originally and told him i will pick up hummer tommorow that my bank will send him his check. The finance manager I am talking about was off at the time of my voice mail message.

I showed up next day with papers from my bank and took possesion of vehicle. I waitied purposly for several weeks after my purchase to make anymore follow up calls due to my prior experience with how this dealership frivously handled my complaints. I had two Trade-ins and Payoffs that need to be made in a timely manner by the dealership.

After several weeks and the payoffs were made,  I contacted steve bachman owner of bachman auto group.  I was able to leave him a voice mail, during  the voice mail I explained what had happened and requested that his company contact all lenders unauthorized to pull my credit to contact the credit bureaus they report to and request their removal from my credit file which was decreased 30 points prior to the actual open account hitting my credit. (What that means is 30 points decrease from 4 addtional inquiries in less than 30 days and no new accounts had a chance to show up on bureaus). The owner Steve Bachman turned over my compalint to the General Manager ( Randy Hutchins).  The GM contacted me by phone, asked me what i wanted.  I requested same from the GM and for him or someone in his company to contact his banks that pulled my credit based on his companies request. He stated he could not do this but he will provide me with a letter that I could send to the bureaus.

I received his letter and it says and I quote, We certainly have no objection to these inquiries being removed and respect Mr. Wilkins right to choose the lender of his choice; however, we realize that the request must ultimately come from the customer along with this letter for any potential change to be affect. What?

I sent the GM a letter and e-mail requesting that his company not overlook my request nor my legal binding credit application. Unfortunatley the GM only would provide me a letter that states the consumer Robert Wilkins request the credit inquiries be removed.. blah blah blah.  I contacted Steve Bachman again and requested that he please help me correct this wrong that I was not pursuing financial gain from this only that my credit be corrected due to thier oversight and bad credit practices.

To date nothing has been changed, the credit bureau's denied the letter provided to me from bachman chevrolet,  Since this is my profession and expertise (credit) I was very leary of this letter and requested several times for the letter to state the obvious, that bachman chevrolet over looked my request and preferred to slide this under the rug with no regard to the damage they have caused.

The BBB (Charles Mattingly-President of Ky), Consumer Protection Agency, Federal Trade Commission, Louisville Police Dept for fraud and the Ky State Atty Office Jack Conway are also being contacted as well as the 4 other banks who were requested to pull my credit without merit or authorization by Bachman Auto Group: JP Morgan Chase-submitted 11/05/2009, Fifth Third Bank-submitted 11/05/2009, BB&T Bank-submitted 11/05/2009, and Old National Bank-submitted 11/05/2009.

Note to Consumers Reading Evidence:  Are you not happy with Bachman Auto Group and its so called standard industry practices, e-mail me today to join in on a class action lawsuit for criminal violations to the FTC and FCRA.

I am not in the car business, but I am in lending.  There is no way they are going to do anything for you. 

-Even if every employee at the dealership and the banks spent the next week working on your case I don't think they would be able to remove an inquiry from your credit report.  The system that my bank uses to correct credit reporting errors will not even allow us to remove an inquiry.

-You are correct that having a ton of inquiries will drop your credit score.  Just wait a couple of months and it will bounce back.  It is not like they are incorrectly reporting a bunch of missed payments - your score will bounce back to exactly where it should be after accounting for your new loan.

-Seriously - what is the big deal?  I HATE it when guys like you tie up my people for hours over issues that are totally irrelevant (in that you are not harmed at all by this, and no matter how hard they try to help you they can't anyway.)  How is it impacting you if your score is lower for a couple of months?  You already have your loan!  If there was something on the horizon that you needed to maximize your score for (Like an insurance quote etc) you should have taken care of it before your report was hit for your new loan anyway.  Otherwise WHAT IS THE BIG DEAL???
