Barbara Hernesman - Fresh Connection Construction Ripoff fraud Took $42K to build home shell No Building, contractor lost binding arbitration, bankruptted debt Nevada City California

In May, 2003, contractor Barbara Hernesman abandoned the site of what was contracted to be a home shell and septic system, after receiving $42K from client. Over the following year, client pursued CA State License Board Binding Arbitration and won $38K award. Rather than paying the award, Hernesman avoided arbitration penalties, any notation on her CSLB record, and mandatory revocation of her license, by filing for Chapter 7 Bankruptcy. Three days before she was required to produce records of the client's job, she filed to change to Chapter 13 Bankruptcy. Because the money was not a secured debt, she has, after more than two years since the original theft, been releived of the debt.

No records of the expenditure of money has ever been made in any venue. Client supplied overwhelming evidence, including cancelled cashiers checks payed to Hernesman, photographs, expert reports, and fraudulent contracts.
