Basil Resale Delaware Screwed me out of my deposit! kenmore New York

On 4/2/15, I put a deposit on a car.  The following day i changed my mind and called the salesman.  He wasn't in but the receptionist stated he checks his messages frequently so i left a message for him cancelling the car.  Just before I left the message the financing company called and left me a message.  They needed to confirm information.  I didn't call back because I had just cancelled the car. 4/ 4/15 the salesman calls me to confirm i'm taking ownership of the car on Monday, pretending like he never received my message, I reminded him I  cancelled the car and asked how i go about getting my deposit back.  He said i wasn't intitled to it because i was already approved for financing.  How could i be if i never confirmed info with the company?!  Then he said it was up to his manager if i get my deposit back.  4/6/15 the manager of the dealership called and spoke rather rudely to my husband and told him we arent getting our deposit back because they missed out on a sale.  He claimed two people came in offering cash for the same vehicle.  Yeah right!  It's been sitting on the lot since Aug and now all of a sudden there's all this interest on it!  Besides, why didnt they take their names and numbers in case the deal fell through!  I never received funding and never signed a purchase order, I want my money back!
