Like everyone looking to save a little money on a high-priced item, I did my research online and came up with Best Price ATVs, aka bestpriceatvs.com. I guess I should have followed my Dad's old advice, "If it sounds too good to be true, it probably is."

I ordered a mid-sized "mini" 110cc ATV for my son for Christmas over the phone on November 14, 2006. It took me several phone calls to even get a live person to answer my newbie questions and take the order, which should have been my first clue.

The website (and the salesman) both stated that I would receive the ATV within 10 to 14 days. One month and two more phone calls later, I finally received the unit -- in a ripped cardboard box sitting on a dented steel frame.

When my son first rode it, it wouldn't stay started for more than a minute and had almost no power. So we charged it overnight, only to discover that there were loose wires and it hadn't taken the charge. We went out and bought a soldering iron and reattached the loose wires toi the battery and tried to charge it again. Still no charge. A friend looked at it over New Year's a proclaimed that, in addition to several faulty connections, it also had atleast a bad starter cylinoid. (I don't know anything about mechanical stuff, but that sounds REALLY expensive to fix.)

So now, my husband and I have each spent hours every day on the phone trying to contact these idiots and find out how to remedy the situation. All we want them to do is pay to have it fixed! Either the phones rings for several minutes with no answer, or a girl puts us into the parts and service department voice mail (which is full half the time and can't accept messages). No one has ever called us back or responded to our e-mails, including one to the owner's personal aol e-mail that I tracked down.

Last night, when I had finally reached my limit, I decided to check them out with the BBB. Lo and behold... They had an unsatisfactory record for selling faulty equipment and failing to respond to phone calls about it.

Today I called my debit card company and had the charges reversed. I'm sure that, once they realize that I have my $619 back, they'll be eager to contact me. I plan on letting the phone ring forever and ignoring their e-mails. :)

Hard to NOT ACCEPT damaged item if you don't know it's damaged until you put it together!

Dear John -

This item was delivered to my work while I was out of town. It wasn't until my husband put on the handlebars and tires and connected the battery that we realized it didn't work.

Sending it back was also not an option because the box that it came in was pretty well destroyed and the metal frame badly bent.

And for the record, I HAVE paid for the item. I've also had to pay out of my own pocket (currently) to have it repaired.

I still can't figure out why everyone is so concerned about the company that took advantage of us. Am I wrong, or isn't this a website for consumers to voice their concerns about being wronged?

No, you have every right to NOT ACCEPT a damaged item and then, not pay for it.

As long as you did accept it, it's in your possession, and the bill is owed on it, you have to pay.

Technically, you have stolen the piece of equipment since you still have possession of it and not paid for it.

I don't know who you are or why you think that this Ripoff Report pertains to you in any way at all, but...

A. What I did is NOT illegal. As a consumer, I have every right to refuse payment on a damaged item. Check with your lending institution for rules and legal questions regarding this right.

B. Just because I paid less, that does not entitle me to treatment as though I were less of a person. That makes as much sense as saying that the food you buy on sale at the grocery store should taste worse than the food purchased at full price.

I recommend that all people wronged by a company like I was make their voices heard. At this point in time, after having filed my own BBB claim against Best Price ATVs, we are still working on an amicable resolution. Stay tuned...

First of all, what you did is illegal! You cannot legally do a chargeback unless the company that shipped your unit acually has the unit back in their hands! This is a crime! I suggest you answer the phone when they contact you so that you dont have any big problems! Remember if a company is selling something so cheap, they have no money to pick up the phone, give customer support, or send parts out. Try one next time that is a little more expensive that can actually take care of you!
