Since Febuary 2005, I traded in a 2003 Mitsubishi, Galant at the dealership of Billy Young Mitsubishi, a privately owned dealership here in Killeen, Texas. In return the dealership agreed to payoff the car because at the time of trade-in there was a standing balance on the car. Up until this day, September 11, 2005, Billy Young has failed to uphold their side of the agreement. Billy Young Mitsubishi has been notified on numerous occasions by myself, my husband, and the lean holder of the car. So at this point in time the car is no longer in the presence of Billy Young Mitsubishi, it was sold. At one point in time in the dealership did attempt to pay off the car, but due to insuffient funds their check was declined.

I highly doubt that the check bounced.

The original response has said it all but I have something to add. It is highly doubtful for a new car dealership, to have it's check bounce due to insufficient funds. Those new cars cost the dealership money (more than you may have owed on the car.) They aren't just given them. They must pay a fee for them. (Hence the markup in cost.)

Also if the payment amount was more than the worth of the car, you never would have gotten a trade in.

Another point, (unlike other states that I have lived in.) in the State of TX, the dealer must have the title and registration under their name. And then when they sell a car, they transfer the registration into the buyers name. And put on the registration who holds the title now (be it a bank or just bought outright.)
