biosagentplus.com was referred by phoenix.com as a partner that would provide computer BIOS updates for Phoenix-Award bios products. biosagentplus.com offers a "free" software tool that analyzes/scans a computer to determine if upgrades to computer bios and drivers are available. One is forced to buy a subscription to receive the available bios or drivers.
After their tool said that a bios update was available for my system I was induced to buy a subscription and downloaded the bios that they recommended. The bios received was obviously unsuitable for my system and I did not install it. During the following week I had to work through a cumbersome, frustrating process with them (designed to fail in my opinion) to resolve the issue. biosagentplus.com finally conceded that their recommended bios was invalid.
They authorized a refund which I had to specifically apply for and am awaiting.
I assert that their software tool will deliberately mislead a consumer to buy their service and thereby fraudulently obtain access to monies to which they are not entitled. Their deficient bios would have destroyed my computer system had it been installed, hence I also assert that they distribute malware with the foreknowledge and intention of harming consumers' property. Caveat emptor.

The case for misrepresentation to induce payment issue was adequately addressed by me and by the 3/4/11 poster's initial rebuttal. If the company was dealing in good faith they would tell you specifically what bios or driver(s) they were proposing prior to purchase (then require payment to obtain the product recommended). Remember that their system scan said there "IS" an upgrade, not that "THERE MAY BE" an upgrade.
Despite rebuttal and spin by biosagentplus.com, it is obvious that their technicians do not review much of anything and a claim otherwise is a lie. Most of us would agree that a qualified bios update would be for the right computer, the right processor and be dated more recently than that detected by their bios scan software. In my case none of the three criteria were met, not even close to that of a compatible system. Any reasonable person would conclude that the proposed bios for my system could never have been a valid upgrade, which in my opinion is fraudulent.
Beyond this, biosagentplus.com disclaims responsibility that their recommended bios is suitable for the purpose indicated. The customer is forced to agree that s/he alone is responsible (at time of download, after purchase) to ascertain suitability. Could it be that they know they're providing product that is likely deficient? Perhaps. This is backing their service and dealing in good faith? I don't think so.
If a wrong bios is installed, a computer will likely exhibit new problems, from operating system crashes to nonresponsive hardware. To me, that is destroying my system should I lose functionality or data through resultant system malfunction. Forget the time to untangle the mess caused by the wrong bios. Forget inability to recover. Forget the cost to my business.
biosagentplus.com seems more concerned about my "complete lack of knowledge of our service" than in providing the quality service that a reasonable customer expects when making a purchase. Companies rise and fall through their business practices regardless of how long they've existed or their relationships. My experience has been unsatisfactory.
The company asks "I'm not sure how exactly we can be called a ripoff if we provide the customer with a refund when we do not have a BIOS for them??" I hope I provided sufficient reasons: 1) fraudulent representation to induce payment via their bios scan, and delivery of grossly deficient product that would make any reasonable person scream for refund. 2) Providing deficient product that constitutes malware because of harm that could be done to a customer's system and otherwise. Payment refund or not, from my experience biosagentplus.com is a ripoff in capital letters, exclamation point. Caveat emptor.

When it comes to BIOS updates, the BIOS ID string which identifies the BIOS, can be very similar on many machines. That is why we require the customers to submit a BIOS request. This allows our technicians to review the request and be sure the customer is getting the correct BIOS. In some cases, after reviewing the request it is determined that the customer's BIOS is up to date and they are informed.
At this point they are given full access to our BIOS database and can update the BIOS on as many other systems as they choose. If they do not want to do that, then they are entitled to a refund.
As this person stated, the refund was approved. Refunds can take up to 24 hours to process.
The customer's assertion that our BIOS would have destroyed his system and that we distribute malware just shows his complete lack of knowledge of our service. We have been around for 25+ years and are the authorizes BIOS upgrade provider of AMI, AWARD, and PHOENIX. I hardly think we would have existed for this long and maintained relationships with these companies if we destroyed people's computers.
I'm not sure how exactly we can be called a ripoff if we provide the customer with a refund when we do not have a BIOS for them??
